A RESOLUTION APPOINTING A PERSONNEL DIRECTOR;
PUBLIC WORKS DIRECTOR; RECREATION DIRECTOR
AND BUILDING INSPECTOR FOR THE CITY OF DANIA,
FLORIDA;

PROVIDING THAT ALL RESOLUTIONS, OR PARTS OF

RESOLUTIONS, IN CONFLICT HEREWITH ARE HEREBY
REPEALED TO THE EXTENT
SUCH CONFLICT; AND
PROVIDING THAT THIS RESOLUTION SHALL BE IN
FORCE AND TAKE EFFECT IMMEDIATELY UPON ITS
PASSAGE AND ADOPTION
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA:
Section 1. That Charlene Moore be and she is hereby appointed

Section 2 . That Gus Brice be and he is hereby appointed to
serve as public works director of City of Dania, Florida, at an

Section 3. That Richard Dickerson be and he is hereby
appointed recreation director of City of Dania, Florida, at an
annual compensation in the amount of $12 ,127. 50 per year. In
addition, said Richard Dickerson shall be paid an automobile
allowance of $50 .00 per month.

Section 4 . That Hubert C. Walker be and he is hereby
appointed building inspector of City of Dania, Florida, at an
annual compesnation in the amount of $12 ,127. 50.

Section 5 That all resolutions, or parts of resolutions, j
in conflict herewith are hereby repealed to the extent of such con-

PLANNING, AS PROVIDED FOR IN SECTION 201

REPEALED TO THE EXTENT OF SUCH CONFLICT; AND
PROVIDING THAT THIS RESOLUTION SIIAL•L BE IN
FORCE AND TAKE EFFECT IMMEDIATELY UPON ITS
PASSAGE AND ADOPTION
WHEREAS, the City of Dania, Florida, finds it necessary
and desirable to participate in Regional Wastewater facility
planning, as provided for in Section 201 PL 92-500 ,
NOW, TIIEREFOP.E , BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF DANIA, FLORIDA:
Section 1. That the City of Dania, F1or-4da, desires
and intends to participate in Broward County 201 Wastewater
Facility Plan after the same has been developed and apj1rcvcd;

� and will cooperate in good fain: in implementing the plan upon
jits completion, so long as it shall find and determine that such
plan is reasonable, effective, and just in its application;
Section 2 . That the City of Dania, Florida, will, in
good faith, participate with other affected governing and
imanagerial bodies in the planning activities required to develop
and complete the 201 facility plan, including service on a
committee or committees to be constituted for such purpose;
Section 3 . That the City of Dania, Florida, deems it
necessary that such plan be developed through the bonafide
participation and input from all affected parties , both
governmental and private;
Section 4 . That the City of Dania, Florida, agrees that
the lead applicant for the 201 facility planning grant shall be
the Board of County Commissioners of Broward County;

Section 5. That the City of Dania, Florida, agrees that
the planning implementation shall be conducted in accordance with
memorandum of Conference date November 9 , 1974 , to which this
resolution is attached.
Section 6 . That Mayor-Commissioner Robert H. Duncanson
and City Manager Woodward M. Hampton shall represent the City
of Dania, Florida in any meetings and conferences held by the

regional wastewater planning group.
Section 7. That all resolutions , or parts of resolutions,
i
in conflict herewith are hereby repealed to the extent of such
conflict.
Section 8. That this resolution shall be in force and take
effect immediately upon its passage and adoption .

Following a discussion and presentation by Federal, State,
I
(County, Municipal and private utility company representatives,
it
it was in order to develop a direction and guideline for the
conference.
It was agreed by those present to recommend to their
respective governing boards, both public and private, that a .
resolution substantially in conformance with the form attached
hereto should be adopted.
j There shall be created an executive committee known as
201 Technical Advisory Committee (201 TAC) hereinafter referred

j to and regional sub-committees hereinafter referred to with the
I '
following respective duties and responsibilities: l
- A, For organizational purposes Broward County will be
divided into three regions, which will be as follows:
I. North Broward f
. 2: Central Broward
3, South Broward
. As more fully delineated in the regional wastewater utilities
. plan of May, 1972 (omitting the S. W. region), the regional
boundary lines shall be subject to' revision pursuant to re-
commendation of the Planning Consultant for optimization of
the County regional system.
j B. Each region shall constitute a sub-committee to be made
up as follows:
1 1. Each municipality operating its own wastewater _
t .
system shall have two representatives. Those municipalities
I
not operating their own wastewater system shall have one
representative.
' 2. Each private utility which is subject to the

1 regulation of and certification by the Florida Public
� Service Commission shall be entitled to one representative.

The primary responsibilities of the regional sub-committee
shall- be: I1
1. The election of two municipal representatives from
region to serve on the 201 Technical Advisory Committee
(hereinafter referred to as 201 TAC).
2. To provide continuing input into the work of technical
advisors, engineers and others hereinafter referred to in the
development of the Countywide 201 Regional Plan.
• 3. To consider for purposes of ratification the final
proposed plan developed and approved by 201 TAC.
C. The 201 Technical Advisory Committee (201 TAC) shall be
up as follows:
1. Two municipal representatives from each region j

elected as above provided.
j2. Two, representatives appointed by the Board of
County Commissioners of Broward County.
3. A member who is a representative of the private
utility companies regulated and certified by the Florida
Public Service Commission to be appointed by the Board of
County Commissioners of Broward County upon the recommendation
i
of the private utility representative of the regional sub-
committee.
A resource advisory council shall be established, composed
of each of the following organizations:

These members shall be continuously notified of and invited

to any and all meetings of 201 TAC and all plans and documents shall
be sent to these representatives at reasonable times to facilitate
their continuous understanding of an input into this Council.
The functions of 201 TAC shall be:
1. To serve as the selection committee to the Board of County
Commissioners of Broward County, under the requirements of
11 the Competitive Negotiations Act, for the selection of a
Planning Consultant in accordance with Public Law 92-500.

2. To coordinate the development of the 201 Regional Waste-
water Facility Plan hereafter referred to as the "Plan".
3. To approve the disbursement of funds for planning fees
and costs necessary for development of the Plan.
i
4. To approve the Plan for submission to the Regional Sub-
committees for ratification.
5. 201 TAC shall likewise perform all functions and carry j
out all acts hereinabove referred to and in a timely
and expeditious manner..
Said Plan, as approved by 201 TAC, shall be submitted, in
i
writing, to a designated chairman of each Regional Sub-Committee,
after receipt of which each Sub-Committee shall have thirty (30)
days within which to approve, disapprove, or approve such Plan
with suggested modifications. In the event of failure of any
3 Regional Sub-Committee to so act upon said written Plan within
a period of thirty (30) days, after receipt thereof, the Plan
shall be deemed in all respects to be approved by such Sub-Committee.
In the event of disapproval by any Regional Sub-Committee of
the Plan so submitted, or approval with recommended modification's,
201 TAC shall have the options of:

q. Overriding the disapproval of such Sub-Committee by
a vote of two-thirds of its entire membership, or
8. In the event changes or modifications are recommended
to the Plan so submitted, to approve such recommended
modifications or to disapprove and override such re-
commended modifications by a two-thirds vote of its
1 entire membership. Upon final vote of 201 TAC, as
herein provided, the Plan shall be then submitted to
Commissioners of Broward County

for final approval and performance of functions then

necessary to implement the Plan. f
Duties and Responsibilities of the Board of Count Coanissioners f
of Broward county shall be:
1. To serve as the lead applicant of the section 201 i
-PL 92-500 Plan and to act and discharge all responsibility
{ pursuant to said Act.
j2. To constitute by appropriate ordinance or resolution
the above referred co 201 TAC, and enact such ordinance

or resolution necessary to implement this memo.
3. To receive the final Plan submitted by 201 TAC, and
days after receipt thereof, approve

4. In exercising its fiscal responsibilities of the 201
1 planning program, the Board of County Commissioners
shall expend monies only upon the recommendations of .

share of funds necessary to develop the 201 facility
plan, not to exceed $100,000.00.
All committees and sub-committes and members hereof, when
discussing official business of sub-committees or committees are
