RESOLUTION NO. 429
A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
REQUESTING THE LEGISLATURE OF THE STATE OF
FLORIDA TO ENACT LEGISLATION LEVYING AN
ADDITIONAL SALES TAX WITH A DISTRIBUTION
FORMULA THAT IS EQUITABLE AND JUSTIFIABLE
AND IN PROPORTION TO THE NEEDS OF THE CITI-
ZENS OF THE MUNICIPALITIES TO PROVIDE NECESSARY
AND ESSENTIAL SERVICES ; AND PROVIDING THAT ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH BE REPEALED TO THE EXTENT OF SUCH
CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE .

WHEREAS , the municipalities of Florida provide a substantial

level of public services to the citizens in the urban areas of
# Florida; and
WHEREAS , the municipalities of Florida have been unable to
I
j meet the urgent needs of their citizens primarily because of a lack
of general fund revenue ; and
WHEREAS , the citizens of Florida have authorized a $25 , 000
Homestead Exemption and the equity requirement for 100% assessment
of property values has caused severe concern as to the continued
viability of this source of local government revenues ; and
WHEREAS , nearly one-third of the general sales tax is paid
by visitors to the communities of our State which are required to

provide local services to such visitors ; and
WHEREAS , the Constitution of Florida preempts all taxing
authority to the State except as provided by General Law (excluding
Ad Valorem Taxes) ; and
WHEREAS , Florida communities cannot secure adequate growth-
oriented funding for transportation, public safety and public
utility services without authorization for such taxing authority
from the State Legislature ; and
WHEREAS , a sharing of the State sales tax authority would
provide an alternate and growth source of general fund revenues
to the municipalities of Florida.
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF
j THE CITY OF DANIA, FLORIDA:

Section 1. That the Governor and the Florida Legislature
are hereby requested to enact legislation levying a sales tax

with a distribution formula that is equitable and justifiable

and in proportion to the needs of the citizens of the munici-
palities to provide necessary and essential services ; and
Section 2. That mandatory , minimum reduction in property
i
taxes from fiscal year 1981-1982 levels equal to the increase in
revenues to local governments resulting from the 10 sales tax
legislation, multiplied by the percentage of the sales tax paid
by Floridians be guaranteed.
Section 3. That a copy of this Resolution be forwarded

to each member of the Legislature and the Governor of Florida.
