RESOLUTION NO. 327

A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
VACATING CERTAIN STREETS AND ALLEYS LOCATED
IN NORTH WYLDWOODE PARK, A SUBDIVISION AC-
CORDING TO THE PLAT THEREOF RECORDED IN PLAT
BOOK 10 , PAGE 4 , OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; AND PROVIDING THAT
ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT HEREWITH BE REPEALED TO THE EXTENT
OF SUCH CONFLICT; AND PROVIDING FOR AN EF-
FECTIVE DATE.
WHEREAS, Section 3, Article 3 , Part IX, as amended, of the
Charter of City of Dania, sets forth the procedure for vacating
and abandoning streets , alleys or other property dedicated to
the public use; and
WHEREAS , FLORIDA COAST BANK, as Trustee, and BALMORAL IN-
DUSTRIAL CORPORATION,duly petitioned the City Commission , City
of Dania, Florida, for the vacation of certain streets and alleys
legally described as follows :
The following described streets and alleys
as shown on the plat of NORTH WYLDWOODE
PARK, recorded in Plat Book 10 , Page 4 ,
of the Public Records of Broward County,
Florida, to wit:
(1) That portion of Wyldwoode Drive (now
known as N.E. 13th Street) lying east of
the southerly extension of the west line
of Block 5; and
o„- (2) Parkway Avenue and Botanic Avenue
(now collectively known as N.E. 2nd Court) ;
and
(3) The ten (101 ) foot alley lying within
Block 5; and
(4) The ten (10 ' ) foot alley lying east
of and adjacent to Blocks 8 and 9 .
WHEREAS, the said City Commission referred said petition to
the city planning and zoning board for its recommendation ; and
WHEREAS, the City Commission at its meeting of May 22 , 1979 ,
determined that the submission and approval of a new plat showing
the condition of the area after such vacation and abandonment
would cause and undue hardship to the petitioners, and therefore,
by unanimous vote waived the submission and approval of same ; and

WHEREAS, at the meeting of the planning and zoning board
of June 5 , 1979 , the planning and zoning board unanimously voted
to recommend that the said streets and alleys be vacated and
abandoned; and
WHEREAS, after publication of notice as required by Section
3 , Article 3, Part IX of the Charter of the City of Dania , a public
hearing was held before the City Commission at its regular meeting
held on June 26 , 1979 .
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF DANIA, FLORIDA:
Section 1. That the City Commission of the City of Dania,
Florida, does hereby vacate, abandon, renounce and disclaim all
of the right, title and interest of the City of Dania in and to
the following described streets and alleys , to wit:
The following described streets and alleys
as shown on the Plat of NORTH WYLDWOODE
1k PARK, recorded in Plat Book 10 , Page 4 ,
of the Public Records of Broward County,
Florida , to wit:
(1) That portion of Wyldwoode Drive (now
known as N.E. 13th Street) lying east of
the southerly extension of the west line
of Block 5; and
(2) Parkway Avenue and Botanic Avenue
(now collectively known as N.E . 2nd
Court) ; and
(3) The ten (10 ' ) foot alley lying within
Block 5; and
(4) The ten (10 ' ) foot alley lying east
of and adjacent to Blocks 8 and 9 .
Section 2. That the City Commission does hereby find and
determine that the procedure for the vacation and abandonment of
the subject streets and alleys has been in strict conformity with
the requirements of Section 3 , Article 3, Part IX of the Charter
of the City of Dania.

Section 3 . That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed to the ex-
tent of such conflict.
Section 4 . That this resolution shall be in force and take
effect immediately upon its passage and adoption.
PASSED AND ADOPTED on this 26th day of June , 1979 .
