RESOLUTION NO. 30
A RESOLUTION OF THE CITY OF DANIA, FLORIDA AMENDING
RESOLUTION NO. 20 AS PASSED AND ADOPTED ON MAY 5,
1983, URGING THE BROWARD COUNTY COMMISSION TO ENTER
INTO AN INTERLOCAL AGREEMENT WITH THE CITIES IN
BRO14ARD COUNTY PERTAINING TO THE LEVY, DISTRIBUTION
AND USE OF A LOCAL OPTION GAS TAX; PROVIDING THAT
- ALL RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO
THE EXTENT OF SUCH CONFLICT AND PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, the Florida Legislature in special session during
March 1983 passed SB 8A which among other things authorized county
government to enact a local option gas tax of up to 4Q per gallon

for a period of up to five years ; and
WHEREAS, the proceeds of such a local option gas tax must

J be divided among the County and its municipalities according to

either prior transportation expenditures or by interlocal agreement;
,. and
WHEREAS, both Broward County and its municipalities have ,.
indicated a desire to enter into an interlocal agreement regarding
f the distribution of the proceeds; and
WHEREAS, the Broward County Metropolitan Planning Organiza-
tion had identified in a recent unified statement of the City and
County transportation needs approximately $430 million in needed
improvements ; and
WHEREAS, it has been determined that the levy of a 4� per
gallon local option gas tax will generate approximately $97.5 million
over the full five year period allowed by law.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF

THE CITY OF DANIA, FLORIDA:
Section 1. That the Broward County Commission is hereby

urged to prepare an interlocal agreement for execution by the munici-
palities located within the County, pertaining to the equitable distri-
bution of a local option gas tax and subject to the following provisions:
(a) That the Broward County Commission is encouraged to enact the
full 4 local option gas tax for the maximum period allowed by
law; ;
(b) That the revenues derived from the levy of the local option

gas tax be divided GO% to the County and 40% to the munici-
palities and further that the municipal share be divided
among the cities according to the existing half-cent sales
tax distribution formula;

(c) That each municipality be allowed to have self-determination
with regard to the allocation of its respective share in
accordance with the transportation expenditures allowed by

(d) That for the period of the local option gas tax levy, the

County maintain the present distribution level to the munici-
palities, in dollars, of road and bridge tax revenues , or j
should such distribution be reduced, that the percentage of
the gas tax distribution be increased to the municipalities
i }
by a corresponding amount;
(e) That the interlocal agreement between the cities and the
County stipulating the terms and conditions of the local
option gas tax be in effect for the full term of the levy
and would continue thereafter until renegotiated;
(f) That the municipalities who are party to the litigation with

the County over the distribution of the current and past road
and bridge tax proceeds are hereby encouraged to reach a
settlement in that litigation;

Section 2. That copies of this resolution be forwarded to the
J Broward County Commission.
II Section 3. That all resolutions or parts of resolutions in conflict

herewith be and the same are hereby repealed to the extent of such con- j

flict. !i
Section 4. That this Resolution shall be in force and take effect
i
immediately upon its passage and adoption.
