Home My WebLink AboutR-1978-279 I j RESOLUTION NO. 279 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING THE SITE DEVELOPMENT PLAN PREPARED 5 BY FRIMET DESIGN ASSOCIATES , 0 N BEHALF OF ANTHONY DRAKAS , CONCERNING ALL OF DANIA GOLF COURSE , ACCORDING TO THE PLAT THEREOF RECORDED i IN PLAT BOOK 32, PAGE 17 , PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, SAID LANDS SITUATE , LYING AND BEING IN BROWARD COUNTY, FLORIDA, LESS AND EXCEPT THE NORTHWEST ONE-QUARTER (NW4) I OF THE SOUTHEAST ONE-QUARTER (SE4) OF THE SOUTH- EAST ONE-QUARTER (SE4) OF SECTION 34, TOWNSHIP 50 SOUTH, RANGE 42 EAST, BROWARD COUNTY, FLORIDA, LESS THE WEST 25 FEET AND LESS RIGHT OF WAY FOR DANIA BEACH BOULEVARD, WITH THE LANDS WHICH ARE THE SUBJECT OF SUCH SITE DEVELOPEMENT PLAN CONSI- STING OF 35 . 3432 ACRES , MORE OR LESS ; AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. i WHEREAS , the lands which are the subject of this resolution are defined herein as those certain lands situate, lying and being in �r Dania, Broward County, Florida, more particularly described as follows , to-wit : All of DANIA GOLF COURSE, according to the plat thereof recorded in Plat Book 32, page 17, Public Records of Broward County, Florida, said lands situate , lying and being in Broward . + County, Florida, LESS and EXCEPT: i The Northwest one-quarter (NW4) of the South- east one-quarter (SE4) of the Southeast one- quarter (SE4) of Section 34, Township 50 South, Range 42 East , Broward County, Florida; and i WHEREAS, the lands which are the subject of this resolution were rezoned to R-3A zoning classification--a zoning classification allowing the construction of 17 residential units per acre--by Ordinance No . 32 on September 4, 1973 ; and WHEREAS , subsequent to the adoption of such Ordinance No . 32 on September 4, 1973 , the City Commission then adopted a new or master or comprehensive zoning ordinance known as Ordinance No . 100 on or about July 20, 1976 ; and I ` J 1 1 F WHEREAS, the lands which are the subject of this resolution are in the Southeastern section of City of Dania; and i WHEREAS , the lands which are in the Southeastern section of the i city were generally rezoned to new zoning classifications defined under Ordinance No . 100 on or about March 2 , 1977, when Ordinance No. 134 (rezoning most of the lands in the Southeastern section of the city) was adopted; and WHEREAS , at the meeting of the City Commission on March 2 , 1977 , the lands which are the subject of this resolution were specifically excluded from rezoning under Ordinance No . 100 so that such lands are subject to zoning ordinances in effect prior to the adoption of the most recent master zoning ordinance No. 100 on July 20, 1976 ; and WHEREAS , the zoning ordinances in effect prior to July 20, 1976 , provided with respect to rezoning in any type of R-3 zoning classifi- cation, the applicant should submit a site development plan to the planning and zoning board for its review and recommendations ; and WHEREAS, with respect to the lands which are the subject of this ^` resolution, Anthony Drakas (the applicant) did publish a notice of hearings in the Hollywood Sun-Tattler on August 24, 1978 , and August 31, 1978, with such notice stating that a site development plan would be presented to the planning and zoning board on September 5 , 1978 , and to the City Commission September 12, 1978; and WHEREAS, at its regular meeting on September 5, 1978, the planning ` and zoning board did approve the site development plan submitted by Frimet Design Associates on behalf of Anthony Drakas concerning the lands which are the subject of this resolution; and WHEREAS , the City Commission desires to approve the said site development plan submitted by Frimet Design Associates on behalf of Anthony Drakas , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That with respect to the following described lands situate , lying and being in Dania , Broward County, Florida, to-wit : J All of DANIA GOLF COURSE, according to the plat thereof recorded in Plat Book 32 , page 17, Public Records of Broward County, Florida, said lands situate, lying and being in Broward County, Florida , LESS and EXCEPT The Northwest one-quarter (NW,) of the South- east one-quarter (SE4) of the Southeast one- quarter (SE4) of Section 34, Township 50 South, Range 42 East , Broward County, Florida, containing approximately 35. 3432 acres , more or a less , the site development plan submitted by Frimet Design Associates on behalf of Anthony Drakas and considered by the planning and zoning board on September 5, 1978, and by the City Commission on September 12, 1978, after due and proper advertised notice in accordance with the ordinances of the City of Dania, be and the same is hereby approved as to the development of the said described lands . Section 2 . That this resolution shall be deemed to authorize the immediate issuance of building permits by the building official of the city, in accordance with the said site development plan prepared by s Frimet Design Associates on behalf of Anthony Drakas . However, no building permits shall be issued until the applicant also complies with other ordinances of the city concerning provision and payment for water and sanitary sewer service to the property which is the subject of this " resolution in accordance with the rate schedules and previous policies adopted by ordinance or resolution of the city. Further, as may be determined by the administrative staff of the city, the applicant shall pay the usual charges imposed for issuance of building permits and any other required permits . However, no further appearances shall be required before the City Commission concerning the site development plan and its approval. i Section 3. That all resolutions or parts of resolutions in con- flict herewith be and the same are hereby repealed to the extent of such conflict . Section 4.
