A RESOLUTION OF THE CITY OF DANIA, FLORIDA, DECLARING
REAL PROPERTY DESCRIBED AS COMMLENCING AT THE SOUTHWEST
CORNER OF THE NORTHWEST QUARTER (NW4) OF SECTION 35 ,
TOWNSHIP 50 SOUTH, RANGE 42 EAST , THENCE RUN NORTH 87°
38 ' 02" EAST FOR 997 . 03 FEET TO THE PERMANENT REFERENCE
MONUMENT AT THE SOUTHEAST CORNER OF THE PLAT OF "ROYAL
PALM VISTA AS SHOWN ON PLAT BOOK 41 , PAGE 12 , OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; THENCE RUN
NORTH 1028' 09" WEST FOR 60. 00 FEET TO THE POINT OF
BEGINNING OF THE PARCEL OF LAND DESCRIBED AS FOLLOWS :

BEGINNING, SAID LANDS SITUATE , LYING AND BEING IN THE
CITY OF DANIA, BROWARD COUNTY , FLORIDA, AND CONTAINING
0 . 2093 ACRES , MORE OR LESS ; AS BEING NO LONGER NEEDED FOR
PUBLIC PURPOSES AND AS BEING SURPLUS AND FURTHER DECLARING
THE INTENT OF CITY OF DANIA TO SELL SAME; AND PROVIDING
THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT ; AND
PROVIDING FOR AN EFFECTIVE DATE .
WHEREAS , Section 1 , Article 3, Part XII , of the charter of City
° of Dania, Florida, states the methods and procedures to follow with
respect to the sale of public property ; and
WHEREAS , City of Dania desires to sell the hereinafter described
lands in accordance with such procedures ,
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
' Section 1. With respect to the following described lands , to wit :
Commencing at the Southwest corner of the Northwest Quarter (M,) of
Section 35 , Township 50 South, Range 42 East, thence run North 87 °38 ' 02"
East for 997 . 03 feet to the Permanent Reference Monument at the Southeast
corner of the Plat of "Royal Palm Vista" as shown on Plat Book 41 , Page
12 , of the Public Records of Broward County, Florida; thence run North
1°28 ' 09" West for 60. 00 feet to the Point of Beginning of the parcel of
land described as follows : From the Point of Beginning continue North
1 °28 ' 09" West for 71 . 06 feet ; thence run North 87°38 ' 02" East for 100 . 00
feet ; thence run South 1°28 ' 09" East for 106 . 06 feet ; thence run South
87 °38' 02" West for 57 . 50 feet ; thence run North 1°28 ' 09" West for 35 . 00
feet ; thence run South 87°38' 02" West for 42 . 50 Feet to the Point of

j Beginning, said lands situate, lying and being in the City of Dania,
j Broward County, Florida, and containing 0. 2093 acres , more or less ,
the City of Dania makes the following declarations :
(a) That the said property fronts on Northeast Second Street
and there are no improvements on said lands .
(b) That the said lands together with a contiguous parcel lo-
cated south and west of the within described parcel (which is the site
of Lift Station M) were acquired by City of Dania during the time that
sanitary sewers were being installed in the area of the city in which
the said lands are located.
(c) That the said lands are no longer needed for public purposes .
(d) That City of Dania does hereby declare such lands to be j
surplus and further declares its desire to sell same .

Section 2. That the said lands shall be offered for sale to the
public at the meeting of the City Commission to be held on Thursday,
July 20th , 1978 , at 9:00 a.m. The City Clerk-Auditor is authorized
to publish notice of such sale in a newspaper for two weeks before the
date of the sale, with the first publication to be not less than ten
days before the date of the sale and the second publication to be one
week after the first publication. At 9:00 a.m. , on Thursday, July 20th
1978 , sealed bids shall be received and protests heard. All bids shall
be accompanied by cashier ' s checks or certified checks , payable to City
of Dania, equal to the amount of at least ten per cent (10%) of the bid
price. E

Section 3. The minimum bid which City of Dania shall consider

is $ 12,500 although the City shall have no obligation to accept
any bid even though submitted bids may equal $ 12,500 or more . f
Section 4. All bids must provide that the bid price is"net" to
i
City of Dania . That is , City of Dania, shall have no obligation to pro- ;

rate or adjust taxes and City of Dania shall have no obligation to pay

for any state documentary stamps or state sur tax due on the deed of
i
conveyance . City of Dania shall not furnish an abstract of title . City
of Dania shall close the transaction by making, executing and delivering

a special warranty deed subject to all restrictions , limitations and
conditions of record and also subject to any conditions that would be
revealed by an accurate engineering survey.
Section 5 . City of Dania expressly reserves the right to reject
any and all bids . The City shall have the specific right to reject
bids even though same may exceed the aforesaid minimum of $ 12,500
which City of Dania adopts as the minimum price it will consider.
Section 6 . That the proceeds derived from the sale of said
property shall be deposited in the General Fund.
Section 7. The City Manager and City Attorney are authorized and
directed to prepare bid forms and agreement forms which are consistent
with the terms of this resolution.
Section 8 . That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed to the extent of
such conflict.
Section 9. That this resolution shall be in force and take effect .. ,

immediately upon its passage and adoption.
