HomeMy WebLinkAboutR-1978-255 j RESOLUTION NO . 255 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, REQUESTING THE BOARD OF COMMISSIONERS OF BROWARD COUNTY TO AGREE TO MAKE THE CITY OF DANIA AND ALL OTHER UNITS OF GOVERNMENT HAVING LARGE USER SEWER AGREEMENTS WITH THE CITY OF HOLLYWOOD PARTICIPANTS IN THE PRO- CEEDINGS AND PARTIES TO ANY AGREEMENT WHERE- BY THE CITY OF HOLLYWOOD SEWAGE TREATMENT PLANT AND CERTAIN OR ALL SECTIONS OF SEWERAGE LINES WOULD BE CONVEYED BY SALE, LEASE OR OTHERWISE BY THE CITY OF HOLLYWOOD TO BROWARD COUNTY OR WHEREBY THE CITY OF HOLLY1400D SEWAGE TREATMENT PLANT AND/OR ANY COMPONENT OF THE CITY OF HOLLYWOOD SEWERAGE SYSTEM WOULD BE TURNED OVER TO BROWARD COUNTY FOR OPERATION; AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS , the City of Dania did on June 7, 1972, enter into an agreement with the City of Hollywood, along with other cities , so as to establish the Hollywood Plant as an area-wide sewage Y•1 treatment plant and thereby make it eligible for Federal grants ; and WHEREAS , the contract set forth an agreement by Hollywood to permit Dania to connect its wastewater collection system to the A„ Hollywood system and have its sewage treated by the Hollywood Sewage Treatment Plant, subject to certain terms and conditions ; and WHEREAS , the City of Dania has been paying during the ensuing five and one-half years not only the operational and maintenance costs for the Hollywood Sewage Treatment Plant and for the Hollywood trans- mission and collection lines through which Dania' s sewage is trans- ported to the Hollywood Sewage Plant , but also capital charges for purchase capacity of 1. 05 million gallons per day to the end of the fiscal year of 1975, and capital charges based on 1 . 50 million gallons per day since October 1 , 1975 , which capital costs included payment 1- existing facilities financed from bond proceeds from a 1954 General Obligation and Revenue Bond Obligation, and in 1967 a General Bond Obligation Bond Issue, and subsequent bond issues including the 1971 Bond Issue ; and , r`1 I ' WHEREAS, the City of Dania has also paid a charge in the amount of ten percent on each monthly bill for a special renewal replacement and improvement fund and also paid charges for de- preciation and equipment reserve; and WHEREAS, the City of Dania has a vested interest in the Hollywood Sewage Treatment Plant and system, along with other municipalities having Large User Agreements with the City of Hollywood; and WHEREAS , the City of Dania did support Broward County under the 201 Plan to have Broward County become the jurisdictional authority over Broward County ' s sewage treatment facilities ; and WHEREAS , the City of Dania, as a large user of the Hollywood Sewage Treatment Plant and system, has a vested right in that system; and WHEREAS, the City of Hollywood and Broward County are currently in negotiations relative to the conveyance of the Hollywood Sewage Treatment Plant, and possibly sections of the Hollywood sewerage system which would materially affect the City of Dania and other cities with large user agreements with Hollywood. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . To request the Commissioners of Broward County, Florida, i to make the City of Dania and all other units of government having Large User Sewer Agreements with the City of Hollywood as participants in the proceedings and parties to any agreements whereby the City of Hollywood ' s Sewage Treatment Plant and certain or all sections of sewerage lines which would be conveyed by Hollywood to Broward County by sale , lease, or otherwise , or any agreement whereby the City of Hollywood' s Sewage Treatment Plant would be operated for Broward County by the City of Hollywood. Section 2 . That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . -2- J Section 3.
