RESOLUTION NO. 252
A RESOLUTION OF THE CITY OF DANIA, FLORIDA, FINDING THE
NEED FOR AND DECLARING A MORATORIUM FOR A TERM OF 90
DAYS ON THE ACCEPTANCE OF APPLICATIONS FOR THE ISSUANCE
OF BUILDING PERMITS, OCCUPATIONAL LICENSES OR SPECIAL
EXCEPTION USES AS PROVIDED IN CITY OF DANIA ORDINANCE
NO. 100 AND OTHER CITY ORDINANCE MATERIAL HERETO WHICH
WOULD PERMIT THE ESTABLISHMENT AND OPERATION OF BOOK
AND/OR MAGAZINE STORES WHICH SELL, DISTRIBUTE, DISPLAY
OR OTHERWISE PROVIDE PORNOGRAPHIC ITEMS OR MATERIALS OF
EVERY KIND AND NATURE; PERMIT THE OPERATION OF PORNO-
GRAPHIC MOVIE THEATRES IN ANY FORM REGARDLESS OF WHETHER
OR NOT CHARGES ARE MADE FOR ADMISSION OR OTHERWISE; OP-
ERATION OF MASSAGE AND/OR RELAXATION PARLORS, SPAS, AND
ANY BUSINESS ESTABLISHMENTS THAT USE NUDE PERSONNEL OF
EITHER SEX FOR THE ENTERTAINMENT, RELAXATION, ENJOYMENT
OR OTHERWISE OF THEIR CUSTOMERS, CLIENTS OR FRIENDS
REGARDLESS OF WHETHER OR NOT CHARGES ARE MADE FOR SAME;
AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLU-
TIONS IN CONFLICT HEREWITH BE SUSPENDED AND HELD IN
ABEYANCE DURING THE TERM OF THIS MORATORIUM; AND PRO-
VIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA:
Section 1. That the City Commission of the City of Dania finds that
there is a need to update and revise the Code of Ordinances of the City to
prevent and/or regulate the establishment and operation of certain types of
business establishments within the City of Dania that they have determined
are detrimental and harmful to the general welfare of its citizens; and,
° pursuant to said findings, a moratorium is hereby declared for 90 days here-
from on the acceptance of applications for and issuance of building permits, ,
occupational licenses or special exception uses for the establishment and
operation of book and/or magazine stores which sell , distribute, display or
otherwise provide pornographic items or materials of every kind and nature;
permit the operation of pornographic movie theatres in any form regardless
of whether or not charges are made for admission or otherwise; operation of
massage and/or relaxation parlors, spas and any business establishments that
use nude personnel of either sex for the entertainment, relaxation, enjoyment
or otherwise of their customers, clients or friends regardless of whether or
not charges are made for same.
Section 2. That all resolutions or parts of resolutions in conflict here-
with be suspended and held in abeyance during the term of this moratorium.
Section 3. That this resolution shall be in force and take effect im-
mediately upon its passage and adoption.
