A RESOLUTION OF THE CITY OF DANIA, FLORIDA
DECLARING LOTS 7, 8, 9 AND 10 OF MCKENZIE EYSTER
ADDITION, ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 8 , PAGE 9, OF THE PUBLIC
'i RECORDS OF BROWARD COUNTY, FLORIDA; SAID LANDS
SITUATE, LYING AND BEING IN BROWARD COUNTY,
FLORIDA, AS BEING SURPLUS AND FURTHER
DECLARING THE INTENT OF CITY OF DANIA TO SELL
SAME ; AND PROVIDING THAT ALL RESOLUTIONS OR
PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE
REPEALED TO THE EXTENT OF SUCH CONFLICT; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 1 , Article 3 , Part XII , of the Charter of
{ the City of Dania, Florida, states the methods and procedures to
follow with respect to the sale of public property; and
WHEREAS, City of Dania desires to sell the hereinafter
described lands in accordance with such procedures .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1 . With respect to the following described lands,
to-wit:
LOTS 7, 8,9 AND 10 OF MCKENZIE EYSTER ADDITION,
ACCORDING TO THE PLAT THEREOF, AS RECORDED IN
PLAT BOOK 8, PAGE 9, OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; SAID LANDS SITUATE,
LYING AND BEING IN BROWARD COUNTY, FLORIDA
the City of Dania makes the following declarations:
(a) That the said property fronts on South Dixie Highway,
Dania, Broward County, Florida. The property has a street address
of No. 1506 South Dixie Highway, Dania, Broward County, Florida.
(b) That the only improvements on said lands is an old CBS
building used as a site and place for a business.
(c) That the lands were acquired by City of Dania on January

18, 1989 by virtue of Certificate of Title issued by the Clerk of
Circuit Court of Broward County, Florida, pursuant to a Summary
Final Judgment of Foreclosure entered on Septemer 15, 1988, in
action entitled City of Dania vs. Hubert H. Smith, et al . , Case
No. 88-11895CP which directed the foreclosure sale on November 8 ,
1988, all of which was bottomed upon a lien resulting from an
order of the Dania Code Enforcement Board dated February 9, 1987,
and recorded February 27, 1987, at Official Records Book 14707,
Page 66, of the Public Records of Broward County, Florida; said
lands have been used since that time by said Big Nassau Daddy's
Septic Tank business.
c (d) That the said lands are not needed for public purposes.
(e ) That City of Dania does hereby declare such lands to be
surplus and further declares its desire to sell same .
Section 2 . That the said lands shall be offered for sale to
the public at the meeting of the city commission to be held on
Tuesday, June 12, 1990 , at 8: 15 P.M. The city clerk - auditor is
authorized to publish notice of such sale in a newspaper for two
weeks before the date of the sale, with the first publication to
be not less than ten days before the date of the sale and the
second publication to be one week after the first publication. At
8: 15 p.m. , on Tuesday, June 12, 1990, sealed bids shall be
received and protests heard . All bids shall be accompanied by
cashier ' s checks or certified checks, payable to City of Dania ,
equal to the amount of at least ten percent ( 10% ) of the bid
price.
Section 3 . The minimum bid which City of Dania shall
consider is $25,000 . 00 although the city shall have no

obligation to accept any bid even though submitted bids may equal
$ 25 , 000 . 00 or more.
Section 4 . All bids must provide that the bid price is "net"
to the City of Dania. That is, City of Dania shall have no

obligation to pro-rate or adjust taxes and City of Dania shall
have no obligation to pay for any state documentary stamps or
state surtax due on the deed of conveyance. City of Dania shall
not furnish an abstract of title. City of Dania shall close the
transaction by making, executing and delivering a special warranty
deed subject to all restrictions , limitations and conditions of
record including the following specific restrictions to-wit :
1. That the subject property is to be conveyed in an "as is"
condition and subject to all liens and/or encumbrances of
every nature including but not limited to mortgage, taxes
and persons in possession of the subject premises.
2. That the use of the subject property by the purchaser
shall be in strict compliance with the present zoning and
building codes of the City of Dania, Florida, without
regard to any non-conforming use, if any, that presently
exists .
Section 5 . The City of Dania expressly reserves the right to
reject any and all bids . the city shall have the specific right to
reject bids even though same may exceed the aforesaid minimum of
$ which City of Dania adopts as the minimum price it
will consider.
Section 6. That the proceeds derived from the sale of said
property shall be deposited in the general fund.
Section 7. The city manager and city attorney are authorized
and directed to prepare bid forms and agreement forms which are
consistent with the terms of this resolution.

Section 8 . That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed to the
extent of such conflict.
Section 9 . That this resolution shall be in force and take
effect immediately upon its passage and adoption.
