r RESOLUTION NO. 93-89 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR FUNDING UNDER THE FLORIDA RECREATION DEVELOPMENT ASSISTANCE PROGRAM FOR DANIA BEACH PARK; DESIGNATING THE CITY MANAGER OR HIS DESIGNEE AS THE OFFICIAL LIAISON AGENT; CONFIRMING THE AMOUNT OF FUNDS REQUESTED IN THE GRANT; CONFIRMING THE AVAILABILITY OF THE REQUIRED MATCHING FUNDS; CONFIRMING THE TOTAL COST OF THE PROJECT; CONFIRMING THE CITY' S RESPONSIBILITY TO DEVELOP, OPERATE AND MAINTAIN THE PROJECT; CONFIRMING THAT THE CITY OFFERED ALL CITIZENS THE OPPORTUNITY TO PARTICIPATE IN THE PLANNING PROCESS RELATIVE TO THE ADOPTION OF THE RECREATION AND OPEN SPACE ELEMENT; CONFIRMING THE CITY' S ON-GOING CONCERN FOR CITIZEN PARTICIPATION IN PLANNING AND SELECTION OF RECREATION PROJECTS ; AND PROVIDING FOR AN EFFECTIVE DATE . WHEREAS , the City of Dania , Florida, has prepared a grant application for the development of Dania Beach Park under the Florida Recreation Development Assistance Program; and WHEREAS, it is a requirement of the application that this resolution be adopted and become an official part of the application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That the city manager is authorized to submit an application for funding under the Florida Recreation Development Assistance Program for the development of Dania Beach Park for use as an outdoor recreation area. Section 2 . That the city manager or his designee is hereby designated as the official liaison agent and is authorized to execute all appropriate documents and contracts for the purpose of administering the grant for the city. Section 3 . That the City of Dania is hereby requesting funds totaling $120 , 000 .00 from the Florida Recreation Development Assistance Program. Section 4 . That the City of Dania has committed the required program matching cash to the project from the operating budget of the city. J Resolution No . 93-89 L� Section 5 . That the total cost of the project is estimated to be $186,460. 00. Section 6. That the City of Dania is fiscally and legally responsible to satisfactorily develop, operate and maintain the project site in accordance with program requirements . Section 7 . That the City of Dania has an officially adopted local comprehensive plan , including a recreation and open space element , pursuant to the Local Government Comprehensive Planning Act of 1975 (Chapter 163 . 3151 , F.S . ) and all segments of the public were offered an opportunity to participate in the planning process leading to adoption of the document . Section B . That the City of Dania has an ongoing program of public participation which encourages involvement by all segments of the population within its jurisdiction , including minority and disadvantaged citizens, in the planning for and selection of recreation projects . Section 9 . That this resolution shall be in force and take effect immediately upon its passage and adoption . The request is to expand and improve the facilities within Dania Beach Park which is identified in the Comprehensive Plan as a 26.5 acre community park. The proposed improvements include adding landscape materials throughout the park, providing a picnic area, adding parking spaces, adding lighting and landscaping to existing parking areas , and providing wooden walkovers over the dunes to the beach. These actions are consistent with the goals , objectives and policies within the appropriate components of the Comprehensive Plan including Future Land Use, Coastal Management and Recreation and Open Space. The proposed actions enhance the recreational potential of the area without endangering the dunes and beach or disturbing natural • •� vegetation. Dania Beach Park is depicted on the future land use plan map as Parks and Recreation. The primary intent of the recreation category is indicated in the text as insuring the provision of facilities to satisfy the needs of Dania residents and visitors. Permitted uses in such areas are for active and passive recreational uses. The proposed improvements enhance all of the acitivities within the parks as well as improving accessibility to the park. The proposed improvements are consistent with objectives to achieve the goal of providing recreation facilities and open space areas for residents and visitors. Specifically, objective I deals with maintaining public access to all recreational facilities and open space. The policies toward achieving this objective include having facilities open to the public and additional parking makes these areas available to more people . The City prides itself on the 1 improvements it has made in the past in expanding open spaces . (1 While the City is in an urban area , it has been successful in meeting or exceeding the open space and recreation element of its comprehensive plan . The City of Dania is committed to providing sufficient open space and recreation, accessible to all residents and tourists, now and in the future. The Dania Beach Park is already providing some of the open space and recreational opportunities required to meet that commitment . Lloyd State Park ; on the west by the Intracoastal Waterway/New River Sound ; and on the south by Hollywood ' s North Beach State Park . The only commercial or residential development existing is to the South . West Lake Preserve is across the Intracoastal Waterway, thereby eliminating any future development immediately to the west. i This project will not only expand and improve the recrea- tional opportunities at Dania Beach Park , but combined with the Ladjacent John U . The entire area acts as a buffer to the urban congestion to the west . ( This project will allow more visitors access to picnicking , swimming , fishing and nature observing. It may be possible for visitors to view the endangered manatee, which frequents the a adjacent Intracoastal Waterway. It should be noted that development of this park will not endanger any wetlands or disturb any natural vegetation . In fact , when this park is completed and landscaped with species native or compatible with the environment , the environmental impact will be a positive one. Lr Necessary utilities to serve the facility are located on site and adjacent to this park . Vehicular access is provided via State Road ALA ( the westerly and southerly extension of this road converge at the Isite ) . This park is included on the Broward County Transit Authority bus routes . Designated bicycle routes include Dania Beach Boulevard and SR AIA, thereby creating safe and easy access to the park for cyclists . Access for the handicapped visitor will be provided by strategically located handicap parking spaces , ramps and special handicap picnic tables . Already existing is a handicap ramp I . through the sand that leads to a "handicap only " chickee pavilion on the beach . This is just north of the picnic area . Handicap visitors will be able to use the picnic tables and the chickee but with uninterrupted access between the two sites . IV 11 J B. Site Description iDania Beach Park is 26 . 5 acres of City owned property. Its current land use is recreation and open space . ( The site consists of undeveloped and underdeveloped property that runs parallel to the Atlantic Ocean on the east and the IIntracoastal Waterway on the west. John U Lloyd State Park is to the north and Hollywood North Beach State Park is to the south. This site is one of the rare , open, free public beaches in the area , not obstructed by residential and commercial development . The beach is typically sandy with recently planted sea oat 1 dunes . The site to be improved is uniformly flat with an elevation of 8 ' above mean sea level . There is little tree canopy or vegetative cover . There are no wetlands on the site . New River Sound, an inlet of the Intracoastal Waterway, abuts the western boundary of this project site . The water quality of this inlet and of the ocean is good . The Florida Manatee has been known to frequent the nearby Intracoastal Waterway. Sea turtles return every summer to nest f on beaches generally north and south of the park. L The site is at the westerly and southerly convergence of IState Road AlA. Block 206 has no significance today because it has disappeared under the Atlantic ` I Ocean (see paragraph 6 of the recitals) . (13) Lots 1, 2, 99 and 100, Block 172, Holl}n000d Central Beach, are immediately North of the North line of Block 203, Holly- Iwood Central Beach. The 1924 plat of 1ollywood Central Beach does not show any type of East-West waterway which might serve to connect New River Sound and the Intracoastal Waterway, in proximity to said Lots 1, 2, 99 and 100, Block 172. However, at some point in time • between approximately 1924 and 1965, Lots 1, 2, 99 and 100, Block 172, Hollywood Central Beach, were dredged and dug out so as to form an existing East-West waterway connection today as between New River Sound and Intracoastal Waterway. That is, immediately North of the North line of Block 203 as it exists today, there is a wide waterway connection which connects New River Sound and Intracoastal Waterway so that, at such location, boat traffic may pass to and I � from New River Sound and Intracoastal Waterway. I (14) With respect to Block 203, Hollywood Central Beach (as ^: same appears on the 1924 plat) , the block is divided by the right of way of a roadway described in 1924 as Ocean Drive (on the plat) and known generally today as North Ocean Drive. Such drive is a _ . North-South thoroughfare, with there being a curvature in the route Iof the thoroughfare as same bisects Block 203 on the 1924 plat. Notwithstanding its appearance on the 1924 plat as a dedicated right of way as it proceeds Northerly, said Ocean Drive was never opened, improved or otherwise used as an actual public thoroughfare until approximately 1965. In approximately 1965, the actual route of Ocean Drive (or North Ocean Drive, as it is known today) was straightened as it bisects Block 203 and the route was actually 1 opened and paved for use by the public for vehicular traffic. (15) North Ocean Drive, as it now exists and as it begins a route from South to North fron a point below (that is, South of) Block 213, proceeds Northerly alongside, and parallel to, the -11- '�' . 24 South-North route of the Intracoastal Waterway and on the East side r of the Intracoastal Waterway. However, such road is only a dead end road which passes through John U. Lloyd State Park (located im- mediately North of Dania Beach) and then leads to the rocks forming Ithe South jetty of the channel entrance into Port Everglades. Ve- hicular traffic using the road must turn around in the vicinity of the rocks forming the South jetty of said channel and return to . the roadway system in the general area of Dania Beach in order to continue with any route of travel. (16) When North Ocean Drive was first improved in approximately . 1965, same was evidently a county road under the jurisdiction of I Board of County Commissioners, Broward County, Florida, as the r road is referred to in certain maps as the county beach road. For � 1 example, see the reference which appears on the 1978 Berry land sur- I Vey. At some date after 1965, the jurisdiction over North Ocean Drive was evidently transferred to Department of Transportation, II State of Florida, with the transfer probably being made at about the time (subsequent to 1965) when State of Florida acquired the f large land area North of Dania Beach to form the present John U. Lloyd State Park. Today, North Ocean Drive is properly identified as a state road as same appears on Florida State Road Department right of way map, Section no. 86514-2601. (17) The 1927 chain of title of city of Dania (or the Western chain) concerns basically Block 203, Hollywood Central ~ ' � "r"�`•" '�'"°`""��`ry Beach. Block 203 is shaded in yellow on the 1978 Berry land sur- Vey• The block, as it is shaded in yellow on the 1978 Berry land survey, is still bisected by the right of way of Ocean Drive as I- it actually exists today. The survey further shows that portion of thG right of way which is no longer needed for road right of way purposes as the result of the aforesaid action in straightening the right of way and removing the curvature of the right of way (which is apparent on the 1924 plat) as same pa:;ses through Black 203. As to the part of the right of way which is no longer actually -12- 25Y J i fr i needed, a notation appears on the 1978 Derry land survey which r designates such right of way as "Platted Ocean Drive Rlw to be vacated." A correct legal description of the right of way is as follows: That part of Ocean Drive (which appears on the record plat but which has never been open for use by the public generally) adjacent to Block 203, HOLLYWOOD CENTRAL BEACII, according to the plat thereof recorded in Plat Book 4, page 20, Public Records of Broward County, Florida, said lands situate, lying and being in Broward County, Florida, and Which is to the West of the West right-of- way of "Ocean Drive" as same appears on ' Florida State Road Department right-of-way map, Section no. 86514-2601, and Which is the North of the South line of I Block 203, HOLLYWOOD CENTRAL BEACH, according to the plat thereof recorded in Plat Book 4, page 20, Public Records of Broward County, Florida, said lands situate, lying and being r4 in Broward County, Florida. 1 By a resolution adopted by the city commission of City of Dania • ! on August 26, 1980, the right of way was vacated. Based on the Igeneral rule, which has been previously stated in these recitals, that where a street originally dedicated by one owner is vacated - ...lI .. through legal process, the abutting owners on each side of the it vacated road take the fee title to the center of the vacated right of way, City of Dania became the owner of the Northerly one-half II of that part of the right of way which was vacated and State of Florida (Department of Transportation) became the owner of the Southerly one-half of that part of the right of way which was vacated. State of Florida has acceded to its rights in the Southerly (, one-half of the right of way because the Southerly one-half of the vacated right of way abuts the present actual right of way of Ocean Drive which is vested in State of Florida (refer to Florida State Ppad Department right-of-way map, Section no. 86514-2601) . (18) With respect to the 1927 chain of title which concerns basically Block 203, Hollywood Central Beach, and as indicated on the 1978 Berry land survey, there now exists a bridge, constructed as a part of North Ocean Drive, which passes over and above the -13- - 'r. m 26 l East-West waterway which is immediately North of Block 203 and which connects Intracoastal Waterway and New River Sound. As the i - I route of the road passes in a Northerly direction and bisects Block 203, it begins to rise at an appreciable anglo so that the horizon- tal plane of the road right of way will line up with the elevated bridge constructed over the waterway.I Y• A substantial part of the rise in the road right of way, as well as the adjacent bridge i structure itself, are constructed on concrete piling, which are li of a sufficient height and which are also sufficiently wide apart I - to allow vehicular traffic and pedestrians to pass under the structure (which is described as being in the nature of an "over- ' I I Pass") so as to pass back and forth from the East side of Block 203 to the West side of Block 203. In effect, such route (passing under the overpass structure) is an East-West route which is ad- jacent to the South line, or South bank, of the canal. Inasmuch as State of Florida (Department of Transportation) is vested with r «yL the title to Ocean Drive and inasmuch as the use of the East-West route (under the overpass structure) to travel from the East side of Block 203 to the West side of Block 203 involves crossing lands - owned by State of Florida as a part of the right of way of North f Ocean Drive, a permit should be obtained from Department of Trans- Iportation if legal and proper permission is desired to use the - route passing under the overpass structure. I (19) The 1941. chain of title (referred to as either the r Central chain or the Southern chain) concerns approximately 8.64 acres of land at Dania Beach. Over the ears, _—`- Y the total of the I8.64 acres which make up the 1941 chain of title represents, primarily, a portion of New River Sound, as same appears on the �- 1924 plat of Hollywood Central Deach, which had gradually become filled in by accretion • The accretion was as a result of the - phenomenon which is more particularly described in paragraph (6) of these recitals. The conveyance of the 8.64 acres from Trustees 27 1� dl of the Internal Improvement Fund, State of Florida, to City of Dania was authorized by Chapter 21130, 1941 Special Acts of Florida. Such special act expressly provides that the lands shall be used for "public park purposes." Pursuant to the authority granted by such special act, Trustees of the Internal Improvement Fund, State of Florida, conveyed the 8.64 acres at Dania Beach to City of IDania*by deed no. 18,669 of the Trustees, dated December 2, 1941, - recorded December,22, 194f, in Deed Hook 398, page 56, Public , Records of Hroward County, Florida under clerk's registry no. I22G679 (with the clerk's registry number not being fully legible) . The improved parking area will allow the City residents convenient access to the beach and its related activities . ( 2) (g) As part of the City of Dania ' s Comprehensive planning , a resident survey was conducted . This Comprehensive Plan was j adapted by the Dania City Commission on December 9 , 1980 (Ordinance 252) The following five pages are excerpts from the Comprehensive Plan. 61 Federal Highway and Dania Beach Boulevard: This major intersection defines "downtown Dania, " an area not readily discernible to the casual observer. This intersection is subject to high volumes of peak-hour congestion. The downtown contains a large number of antique stores forming an antioues district, a planning influence that deserves recognition and enhancement . Dania Jai Alai Fronton (Planning Area J) : The fronton provides a unique form of entertainment in pleasing surroundings , imparts some definition to the downtown area, and generates commercial enterprises catering to the jai alai patron. Dania Beach and Pier (Planning Area A) : A superb natural feature and an asset to the commu- nity, the beach offers considerable potential for more recreational development. Dania Marine Facilities : The water-related activities in the city are enhanced by the Dania Cut-off Canal, the C-10 Canal, and the many marinas , all of which are important planning influences . Marine features include not only marinas for pleasure craft, but also , areas such as Port Laudania where large vessels are refurbished. ' Abandoned Amusement Park (Pirates World) (Plannincr Area H) : The abandoned Pirates World property provides a large tract of land ready for redevelopment. Mangroves and Wetlands (Planning Areas B, J and H) : The large amount of mangroves and wetlands in the �y 1 �7 Since Dania is close to major transportation nodes and links , the economic growth of the city is assured. How to coordinate that growth without degrading the environment (air, water, . wetlands , etc. ) has to be considered. (Refer to Conservation and Coastal Zone Protection Element. ) How to provide for the future population growth of the town is another important concern. This projected economic and demographic growth, f and the community' s goals and objectives were considered in assessing the City of Dania' s future land use needs. One of the characteristics of Dania's Future Land Use Plan is the retention of the diversity of land uses found in the city. An analysis of the future land uses for each planning area follows. Planning Area A (Zone 78) 1 � This area will continue to be the city's chief recreation area. It is the community's link to the sea. Those responding to the city 's questionnaire agreed that the facilities at Dania � ( Beach should be improved. However, since the beach is a major asset of the city, any improvements must be made with the proper sensitivity to the environment. The residents want to make a sure that there is to be no development of "honky tonk" ( ' facilities at Dania Beach. I Planning Area B (Zone 79) The area immediately east of the Fort Lauderdale-Hollywood International Airport and running along Federal Highway, the I airport' s eastern boundary, is characterized by commercial establishments to serve the needs of the traveling public. Car rental firms , restaurants and gift shops abound along that stretch of the highway. Much of this planning area is currently l ; undeveloped, with mangroves covering the eastern portion and o plant nurseries covering the major part of the remaining portion that is not utilized for commerce. The construction of SR 845 which generally follows the N.E. 5th Avenue alignment, will help open this underutilized corner of Dania for development. This large relatively vacant area which is proposed for industrial uses, provides the community with a rare opportunity to see that land is developed in conformity to the plan, in an environmentally sound way, aandaccording measurto the wishes and desires of the community. Appropriate es should be included in the city ordinances to make sure that the primarily industrial development occurring in this area would be compatible with either the Fort Lauderdale-Hollywood International Airport or Port Everglades , or both. The interchange of 'SR 845 and the extension of N.W. 10t Street easterly to its junction with SR 845 will make the land at this intersection most advantageous from -a transportation viewpoint. The whole prime industrial area, located between two major transportation nodes in the county, allows for development of interfacing facilities . The location I. of Foreign Trade Zone 25 at Port Everglades also adds international I - 21 63 L� B. DANIA'S PARK, RECREATION, AND OPEN SPACE FACILITIES To provide the basis for assessing the adequacy of the City of 111 Dania's parks , recreation and open space system, each component of that system is described below. Dania Beach (Zone 78 , Planning Area A) is the city ' s link to the sea. This 1000-foot stretch of sand is a remnant of the {1 city' s formerly much larger holdings along the shoreline of the t Atlantic Ocean. Besides the swimming and sunbathing facilities normally associated with an ocean beach, one of the four public fishing piers in the county is located at Dania Beach. The 775- foot long, city-owned pier there provides choice fishing oppor- tunities for the angler. Brooks Park (Zone 79 , Planning Area B) , which is located near ll t e southeastern corner of the Fort Lauderdale-Hollywood Interna- tional Airport, is a small roadside park. The picnic tables al- low travelers to enjoy a meal in a verdant setting of grass and 1 trees , -while the proximity of the airport and Federal Highway , provides them with visual and auditory diversion. Collins School Park (Zone 83 , Planning Area C) , Dania School Park Zone 4, Planning Area H) , and Olsen School Par one Z 34, Planning Area H) , belong to the Broward County School Board. For these properties , the City of Dania has 40-year, $1 .00 per 1 annum leases . The leases for both the Dania and Olsen Schools ,,^ og were signed on June 2 , 1975 , while the Collins School property was leased even earlier. These leases permit the city to use the recreationally valuable facilities of the school as long as advance arrangements are made with the school principal , and school personnel are available on site during an event . The city is thus able to use the schools ' cafetoriums , athletic fields and other facilities , particularly for the summer pro- grams run by the Parks and Recreation Department . Modelo Park (Zone 83 , Planning Area C) contains the only city- operated swimming pool . In addition, it has tennis and basket- ball courts , a lighted baseball field , football field , and soccer field as well as a recreation building and play and picnic areas . This park plays an important part in meeting the recreational needs of the residents of the city' s western section. 7 VI-2 64 D. HOW DANIA'S CITIZENS PERCEIVE THE PARK, RECREATION AND OPEN SPACE SYSTEM One way to determine if the needs of a community are being met, is to ask those being served. In May 1978, as part of the city 's comprehensive planning process , a questionnaire was sent out to every household in the municipality (see Appendix) . Several of the questions asked pertained to park and recreation issues . For example: Question 16 asked, "Are adequate recreational facilities available?" Of those responding , 60 percent said "Yes" while 40 percent said "No. " Question 17 asked, "What kind of new recreational facilities would you like to see in Dania?" The greatest response (17 percent of respondents) was for a new swimming pool. (It should be pointed out that the now -_ undeveloped Southeast Park was to include a swimming pool to serve the east side residents , but with the restriction on devel- opment in that area, the likelihood of its being constructed there is greatly reduced. ) Other recreational facilities requested by respondents to the questionnaire included: - Improved parks or tennis courts (9 percent each) - Bike paths , jogging/exercise tracks , or senior citizens activities (7 percent each) L - City golf course , paddleball and racquetball courts , _ movie theaters , or an improved beach (6 percent each) = Civic/cultural center (4�; percent) More baseball fields (3 percent) - Improved playgrounds (2 percent) The remainder of the respondents wanted: - More programs for 15-18 year old persons - More open space = Canoeing Bowling v VI-9 65 Ice skating rink - Another recreation center - More grills at park Square dancing Band concerts Question 22 asked, "Are there features in Dania worth preserving?" 86 percent said "Yes" while 14 percent said "No." Question 23 asked, "If 'Yes , which features?" Responses included: The old Dania School (24 percent) * - The brickfront stores , antique shops , and old buildings (19 percent) - Dania Beach (13 .percent) - Dania Golf Course** (10 percent) _ Trees (9 percent) -� Parks (6 percent) !� - Small town atmosphere (2 percent) * The Old Dania School was torn down in January 1980. on September 12 , 1978 the Dania Golf Course site was rezoned for commercial and residential uses. ,l Question 26 asked, "Would you like to see more recreational development at Dania Beach?" 63 percent of the respondents to the questionnaire said "Yes" ; 37 percent said "No." i The responses to this questionnaire are being considered by the f� city in the formulation of future budgets and policies. t i - VI-10 66 (2) (h) IThe public has been intimately involved in development of an open space/recreation program in the City.
