RESOLUTION NO. 62-89
A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
APPROVING THE AGREEMENT BETWEEN PUMPING
STATION SERVICE CENTER AND THE CITY OF DANIA;
AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS
TO EXECUTE SAID AGREEMENT; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS , the City Commission , City Manager , Acting Utilities
Director and City Attorney of the City of Dania, Florida , have
reviewed the attached form of agreement and find it to be
appropriate to the needs of the City of Dania.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1 . That the City Commission of the City of Dania ,
Florida , does hereby approve the agreement between Pumping Station
Service Center and the City of Dania, a copy of which is attached
hereto and made a part hereof as Exhibit "A" .
Section 2 . That the Mayor-Commissioner , City Manager and
City Clerk-Auditor are hereby authorized and directed to forthwith
execute said Agreement on behalf of the City of Dania , Florida.
Section 3. That this resolution shall be in force and take
effect immediately upon its passage and adoption.
PASSED and ADOPTED this 9th day of May, 1989 .

MAINTENANCE AGREEMENT (305) 781-8446
THIS AGREEMENT, made and entered into this A day of 19 _, by and between:

PUMPING STATION SERVICE CENTER, hereinafter called "Contractor."
WITNESSETH:
WHEREAS, the Contractor is desirous of maintaininq complete service of the sanitary sewage lift

WHEREAS, PUMP STATION SERVICE CENTER, is desirous of maintaining said system on an
independent contractor basis with city of Dania
NOW, THEREFORE, for and in consideration of the premises and the mutual promises and under-
takings herein contained, and for other good and valuable considerations, the parties hereto mutually
covenant and agree as follows:
CONTRACTOR COVENANTS AND AGREES THROUGHOUT THE CONTRACT TERM:
1. To provide the owner a certificate of insurance in a responsible insurance company, or companies,
authorized to do business in the State of Florida, generally known as comprehensive public liability policies
insuring the Contractor against all claims and demands made by any person or persons whomsoever for
injuries of property damage received in connection with the operation and maintenance of the Contractor's
business. Coverage shall be as follows:
• Not less than $50,000 for property damage.
• Not less than $300,000 to cover claims for any single or specific accident or occurrence to any
one person.
• Not less than $1,000,000 in connection with any one particular accident or occurrence, as
required.
2. That the Contractor shall provide the owner with certificates of insurance showing public liability
and workmen's compensation to be in force throughout the term of this contract. Said certificates shall
contain a provision stating that in the event the policy or policies are cancelled by the insured or the
insurance company, the owner shall be given immediate notice of cancellation.
3. The Contractor shall comply with all applicable state statutes and municipal ordinances of the City
which relate to the operation of its maintenance company.
-..,� 4. To furnish all labor, tools and equipment and to do all things necessary to perform preventative
maintenance on the equipment maintained and to maintain the system in good operating condition and
specifically to provide the following:

OWNER COVENANTS AND AGREES THROUGHOUT THE CONTRACT TERM:
5. The Owner agrees to the following:
• All materials required will be billed at cost plus 1 0%
• Furnish meter and water for flushing and cleaning system.
• Furnish all electric power.
• To have the wet well cleaned as necessary.
• To pay the cost of electric motor and pump repairs.
THE PARTIES MUTUALLY AGREE:
6. The contract work is to take effect and the Contractor is to commence work and services on
