HomeMy WebLinkAboutR-1989-061 RESOLUTION NO. 61-89 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, DECLARING CERTAIN PERSONAL PROPERTY AS BEING OBSOLETE AND SURPLUS AND NO LONGER NEEDED FOR MUNICIPAL PURPOSES AND FURTHER DECLARING THE INTENT OF THE CITY OF DANIA TO SELL SAME; AND PROVIDING THAT ALL RESO- LUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS , the City Manager has determined that the continued use of the personal property described in EXHIBIT "A" , attached hereto and made a part hereof , is uneconomical and inefficient and serves no useful function; and WHEREAS , the City Manager has recommended that the City Commission declare said property to be surplus and that it be offered for sale to the highest bidder . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That with respect to the personal property described in EXHIBIT "A" , attached hereto and made a part hereof , the City of Dania makes the following declarations: (a) That said property serves no useful function and is no longer needed for public purposes. (b) That the City of Dania does hereby declare such personal property to be surplus and further declares its desire to sell same . Section 2. That the proceeds derived from the sale of said property shall be deposited in the General Fund. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . Resolution No. 61-89 I I i i Section 4 . That this resolution shall be in force and take effect immediately upon its passage and adoption. After approval of these items, they will be catalogued by Fisher Auction Company for the City Auction, to be held on Saturday, May 20, 1989 , located at our City Garage facility. I would like to request that this list be submitted to the City Commission for their approval on the May 9, 1989 Regular Commission Meeting. WITNESSETH This Agreement is by and between the above named person(s), hereinafter called •Seller(s)• and FISHER AUCTION COMPANY, hereinafter called •Auctioneer.• The Seller and Auctioneer do hereby covenant and agree that the Seller shall employ the professional services of the Auctioneer to sell the personal property of the Seller by the terms and conditions of this Agreement , and outlined as follows. I. INVENTORY A. Within seven (7) days after signing this Agreement, Seller shall deliver to Auctioneer a complete inventory listing all items to be sold at Auction. B. No item shall be withdrawn or sold from said inventory by Seller prior to the Auction. C. Seller shall deliver all titles and keys to any automobiles, ... boats, airplanes, or all such equipment as requires same for legal transfer to the Auctioneer within the time limits mentioned under •A)• above. II. TITLE A. Seller guarantees that all inventory to be sold at Auction is free and clear of all liens and encumbrances of any kind whatsoever. B. Seller guarantees that any vehicular equipment of foreign manufac- ture or origin, subject to any federal regulatory agency require- ments for modification, shall have completed such modification prior to.Auctioneer accepting same for Auction. C. Seller shall present evidence to the Auctioneer that all such equipment is in compliance with standards established by the E.P.A. of the U.S. Government as to pollution control devices at the time Seller delivers title. Title alone shall not serve as evidence. III. ABSOLUTE A. All property is to be sold at •Absolute Auction• to the highest bidder(s) without restriction, reserve, or minimum as to price. B. If Seller bids on any property to become the highest bidder so that said property does not in fact transfer title to new owner, Seller shall pay full commission to Auctioneer on all property bought in such manner. Seller agrees to pay for all advertising expenses necessary to promote Seller 's Auction, B. The amount of advertising expenses not to exceed One Thousand Five Hundred Dollard ($ 1500.00 ) V.
