A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
RELATING TO N. E. 7TH AVENUE SPECIAL ASSESSMENT
DISTRICT IN ACCORDANCE WITH CHAPTER 170 ,
FLORIDA STATUTES, ADOPTING THE SPECIAL
ASSESSMENT FOR THE STREET IMPROVEMENTS AS
PREPARED BY THE CITY CLERK; CONFIRMING SUCH
ASSESSMENTS ; PROVIDING THAT SAID ASSESSMENTS
SHALL BE A FIRST LIEN AGAINST THE PROPERTY;
PROVIDING THAT AN ADMINISTRATIVE CHARGE BE
PAID IF THE PROPERTY IS SOLD, CONVEYED OR
TRANSFERRED IN ANY FASHION; DIRECTING THE CITY
CLERK TO PREPARE THE IMPROVEMENT LIEN BOOK;
PROVIDING FOR A PENALTY OF ONE PERCENT (1 % )
PER MONTH FOR ASSESSMENTS THAT ARE NOT PAID
WHEN DUE; PROVIDING FOR A WAIVER OF INTEREST
PAYMENT ON THE ASSESSMENT IF PAID WITHIN
THIRTY (30 ) DAYS OF THE COMPLETION OF THE
IMPROVEMENTS; PROVIDING FOR SEVERABILI'TY;
PROVIDING THAT ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED
TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS , the City Commission of the City of Dania, Florida ,
has considered the need for improvements to N. E. 7th Avenue; and
WHEREAS , the City Commission , on the 24th day of October,
° 1989, at 8 : 00 P.M. , sat as an Equalization Board ;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1 . The city commission hereby confirms the
Assessment Roll attached hereto as Exhibit "A" without
modification .
Section 2 . In accordance with Section 170. 09, Florida
Statutes , said special assessment liens shall remain liens
co-equal with the lien of all state , county, district and
municipal taxes, superior in diqnitv to all other liens, titles
and claims, until paid and shall bear interest at a rate per annum
of one percent ( 18) in excess of the interest rate on the Special
Assessment Improvement Bonds from the date of completion of the
improvements . In the event that the properties assessed hereby
are sold , transferred or conveyed in any fashion, then in that
event a reasonable administrative charge shall be assessed by the
City of Dania and said administrative charge shall be paid in full
thirty ( 30 ) days thereafter. Any failure to so pay these
assessments shall be a default hereunder and shall subject these

Special Assessment Liens to foreclosure in accordance with Chapter
170 , Florida Statutes.
Section 3 . The City Clerk is directed to prepare the
Improvement Lien Book specified in Section 170 . 08, Florida
Statutes.
Section 4 , Any payment not made when due shall be subject
to a one percent ( 18 ) per month penalty interest as specified in
applicable state statutes .
Section 5 . Any property owner who pays his assessment
within thirty ( 30 ) days after the improvement to his property is
completed and a resolution accepting the same has been adopted by
the city commission may do so without incurring any liability for
any interest normally due under this special assessment program.
Section 6 . In the event that any portion of this resolution
is found to be unconstitutional or illegal , it shall be severed
-A herefrom without affecting the validity or enforceability of the
remaining portions of this resolution .
Section 7. That all resolutions or parts of resolutions in
conflict herewith be repealed to the extent of such conflict .
Section 8 . That this resolution shall be in force and take
effect immediately upon its passage and adoption.
