CITY OFFICIALS TO EXECUTE SAID AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE,. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That that certain Agreement between City of Dania and Port Everglades Authority for Inspection Services to be Performed by the City of Dania Building and Zoning Enforcement Division, a copy of wY.ich is annexed hereto and made a part hereof as Exhibit "A" , be and the same is hereby approved and the appropriate city officials are directed to execute same. ADLER, City Attorney s Resolution No . 110-89 4 4 J AGREEMENT BETWEEN CITY OF DANIA AND PORT EVERGLADES AUTHORITY FOR INSPECTION SERVICES TO BE PERFORMED BY THE CITY OF DANIA BUILDING AND ZONING ENFORCEMENT DIVISION EXHIBIT "A" n AGREEMENT Between CITY OF DANIA And PORT EVERGLADES AUTHORITY For INSPECTION SERVICES TO BE PERFORMED BY THE CITY OF DANIA BUILDING AND ZONING ENFORCEMENT DIVISION THIS AGREEMENT, is made by and between: CITY OF' DANIA, Florida, a municipal corporation existing under the laws of the State of Florida, hereinafter referred to as "CITY"; and PORT EVERGLADES AUTHORITY, a public corporation existing under the laws of the State of Florida, hereinafter referred to as "PORT"; W I T N E S S E T H: WHEREAS, the CITY OF DANIA maintains a Building and Zoning Enforcement Division that conducts plan examinations and inspections pursuant to the South Florida Building Code; and WHEREAS, the PORT EVERGLADES AUTHORITY is desirous of procuring the services of CITY for the performance of plan examinations and inspections pursuant to the South Florida Building Code within the Port Jurisdictional Area; and WHEREAS, CITY through said division is willing to perform such services on the terms and conditions hereinafter set forth; NOW, THEREFORE, IN CONSIDERATION of the premises and mutual covenants hereinafter contained, the parties agree as follows: 2 J I I. SCOPE OF SERVICES: PERFORMANCE OF FUNCTIONS AND DUTIES I PORT agrees to transfer to CITY the authority to perform the functions indicated below as needed: INSPECTIONS PLAN REVIEW (a) Building inspections (b) Plumbing inspections (c) Electrical inspections (d) Mechanical inspections (e) Landscaping inspections (f) Mobile home inspections (9) Code enforcement of the South Florida Building Code X X and all Port Everglades resolutions pertaining thereto (h) Fire inspections CITY shall perform the above-described functions(s), as indicated by an "X", through its Building and Zoning Enforcement Division or any successor division which may be created. CITY shall provide the Inspections and Plan Review required under the South Florida Building Code and all Port Authority resolutions pertaining thereto. CITY shall perform threshold inspections as needed at CITY's cost to Port. such services shall be for the entire Port jurisdictional area except that area in Northport as provided in the City of Fnrf Lauderdaleis Municipal ordinance C-89-9 and Development Order dated February 7, 1989. Port shall provide administrative office facilities and personnel associated with the services selected by Port, provided however, that CITY agrees to provide such facilities and personnel for a period of time necessary for Port to complete its staffing and set up of such office facility. Adler, City Attorney 6 L� PROPOSED FINAL ORDINANCE NO. 36-89 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING IN ITS ENTIRETY SECTION 8-3 OF THE 1980 CODE OF ORDINANCES OF THE CITY OF DANIA AS ENACTED BY ORDINANCE NO. 234 ON APRIL 22 , 1980 , ENTITLED 'GENERAL, STRUCTURAL, PLUMBING, ETC. , PERMIT FEES' ; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. i WHEREAS, Section 8-3 of the 1980 Code of Ordinances of the City of Dania , Florida, was promulgated , enacted and ordained by Ordinance No. 234 , which was passed and adopted on April 22 , 1980 ; and WHEREAS, after an extensive study and review of the existing fees, charges and regulations concerning same made by the Building Official of the City of Dania with the assistance and advice of the City Engineer the results of which have been presented to the City Commission of the City of Dania with the recommendation that a new schedule of fees, charges and regulations concerning same be adopted; and WHEREAS, it is the opinion of the City Commission of the City of Dania , Florida, that the fees to be charged by the City of Dania for permits regarding all structural , plumbing , electrical , zoning and other incidental matters should be amended to reflect said recommended changes as the same are hereinafter set forth in order to meet the substantially increased costs of operation of the Building Department and to provide additional personnel and equipment for a more efficient operation of the Building Department ; and WHEREAS , it is the intent of this ordinance to adopt a new schedule of fees, charges and regulations concerning said subject matter. Fill or earthmoving, per acre 28 of Cost J -13- Ordinance No. 36-89 i A MISCELLANEOUS PROVISIONS Improvements to property and installations not specified in this ordinance shall be based on cost , the charge to be determined as per building permit fee schedule. Failure of licensed contractor to request final inspection on any work shall subject said contractor to payment of a fee of $55.00 and an approved final inspection prior to the issuance of any further permits. For any other building work not mentioned in this ordinance the fees required by this ordinance or any other ordinance of the City shall be paid , and all requirements of this ordinance or any other ordinance shall be enforced by the inspectors specifically charged with such enforcement , or by city employees designated by the City Manager, if not otherwise specifically provided for. The said fees shall include payment for the permit and for inspection of the work , after the same shall have been completed. If the Building Inspector shall , upon his inspection after completion of the work or apparatus find that the same does not conform to and comply with the provisions of this ordinance, he shall notify the contractor or owner, indicating the corrections required; and when he shall be notified that the corrections have been made , he shall again inspect the work apparatus , and when due to any one of the following reasons, a charge of $38 . 50 shall be made for each trip: I . Wrong address 2. Condemned work , resulting from faulty construction. 3 . Repairs or corrections not made when inspection is called. 4 . Work not ready for inspection when called . The payment for reinspection fees , correction of workmanship or violations, shall be made before any further permits will be issued to the person responsible for or owning same. "Licensed persons or firms" doing installations or work without a valid permit shall be charged a $110. 00 fee or double permit fee , whichever is greater. "Homeowners" doing their own work without a valid permit shall be charged a double permit fee, as provided for in the South Florida Building Code. Section 2 . If any section, sentence , clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaininq portions of th; G Section 3 . It is the intention of the City Commission that the Provisions of this ordinance shall become and be made a part of the City of Dania Code; and that the sections of this ordinance may be renumbered or relettered and the word "ordinance" may be changed to "section" , "article" or such other appropriate word or phrase in order to accomplish such intentions. J Ordinance No. 36-89 1 I Section 4 - That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict.
