HomeMy WebLinkAboutO-1976-086 ORDINANCE NO. 86 AN ORDINANCE APPROVING THE PLAT OF "FLORIDA VILLAGE HEIGHTS" SAME BEING i A SUBDIVISION OF THE SOUTH 1/2 OF THE SOUTH 1/2 OF THE SOUTHWEST 1/4 OF THE NORTHEAST 1/4 LESS THE WEST 785 FEET AND LESS THE NORTH 7. 50 FEET, IN SECTION 34 , TOWNSHIP 50 SOUTIi, RANGE 42 EAST, DANIA, BROWARD COUNTY, FLORIDA; AND ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL STREETS , HIGHWAYS AND ALLEYS , AS SHOWN ON THE SAID PLAT OF "FLORIDA VILLAGE HEIGHTS" AND PROVIDING FOR CERTAIN SETBACK REQUIREMENTS REGARD- ING LOTS 7 , 8, 9 and 10 OF SAID PLAT i NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That the plat of "Florida Village Heights" j f same being a subdivision of the South 1/2 of the South 1/2 of the I Southwest 1/4 of the Northeast 1/4 less the West 785 feet and less i the North 7. 50 feet, in Section 34 , Township 50 South, Range 42 East, Dania, Broward County, Florida, is hereby accepted and approved. With respect thereto, City of Dania consents and agrees that such plat may be recorded in the Public Records of Broward County, Florida, upon further approval by all. agencies of Broward County, Florida, having jurisdiction in the matter. ... ' e Sectionl. That the dedication for public use of all � streets, highways and alleys, as shown on said plat, is hereby f accepted by City of Dania. Section 3. That the city commission affirmatively recognizes E that Lots 7, 8, 9 and 10 of the plat of "Florida Village Heights" f face, or front on, a circular drive commonly known as a cul-de-sac f 7 and that, with respect to the frontage of each of said lots along j said cul-de-sac, the width of each of the lots is less than the minimum width of 60 feet required by existing zoning ordinances of 4� the city concerning the zoning classification where the sub- i j division is located. Vk F 7: residential construction in the particular area where the lands (described in Section 1. ) are located require a front width of i i 60 feet and a minimum setback of 20 feet so that, in effect, the i application of the existing zoning ordinances to the construction � of a single family residence on a lot in the area where said lands are located requires a minimum front yard having an area { not less than 1, 200 square feet on which building improvements shall not be constructed. As to Lots 7, 8, 9 and 10 of the plat of Florida Village Heights, the building official be and he is hereby authorized to issue building permits for the construction of a single family residence on each of said lots if the plot j plan (submitted at the time of an application for a building i permit) shows that the front yard area of each of said lots is { {I not less than 1,200 square feet and, with respect to any proposed f construction of a single family residence on any of said four lots, it shall not be necessary for the applicant for a building {' permit to obtain a variance (or exception) if the plot plan shows I that the front yard area of each lot shall have a minimum of 1, 200 square feet. Specifically, without limitation on the fore- going, the setback from the front lot line (that is, the line coinciding with the cul-de-sac line) as to Lots 7, 8, 9 and 10 shall be whatever setback is required to produce I P a front yard area of 1, 200 square feet per lot on which there shall be no construction of building improvements. That is to say, a single family residence may be constructed on each of said four lots if the residence is set back from the front yard line (coinciding with the cul-de-sac line) for whatever distance (even though it i may exceed 20 feet) that may be required to produce a tot al front yard area of 11200 square feet per lot and with there being no type of building improvements to be constructed in the said front yard area of 1, 200 square feet per lot. Section q. With respect to the provisions in Section 3. J -2- 4 h � 1 c ,r.� i providing that it shall not be necessary to obtain a variance (or exceptional permit) regarding construction on Lots 7, 8 , 9 and 10 of the plat of Florida Village Heights if there is a minimum front yard area of 1,200 square feet per lot and with i there being no 'construction of any type of building improvement j on the said 1, 200 square feet of front yard area per lot, it is understood by the passage of this ordinance that every applicant for a building permit on any lot in the said subdivision shall I comply with all other existing building and zoning ordinances of the city at the time of the filing of each application for a i building permit. i I Section 5. That all ordinances or parts of ordinances and I all resolutions or parts of resolutions in conflict herewith be i and the same are hereby repealed to the extent of such conflict. i Section 6.
