ORDINANCE N0, 7.1 AN ORDINANCE RE-ZONING LOTS 1, 2, 3 AND 4, BLOCK 19 , TOWN OF DANIA, ACCORDING TO THE PLAT THEREOF, RE- CORDED IN PLAT BOOK "B" , PAGE 49, PUBLIC RECORDS OF DADE COUNTY, FLORIDA, SAID LANDS SITUATE, LYING AND BEING IN BROWARD COUNTY, FLORIDA, FROM EXISTING ZONING CLASSIFICATION TO B-2 ZONING CLASSIFICATION; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT BY UNANIMOUS CONSENT OF ALL COMMISSIONERS PRESENT, THE ORDI- NANCE HAS BEEN INTRODUCED AND READ THE FIRST TIME AT ONE MEETING, READ BY TITLE ONLY THE SECOND TIME AND THIRD TIME AT THE SAME MEETING AND FINALLY PASSED AT THE CONCLUSION OF THE SECOND AND THIRD READINGS 1 WHICH WERE AT THE SAME MEETING; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: i Section 1. That the following described lands, to wit, Lots 1, 2, 3 and 4 , Block 19, TOWN OF DANIA, according to the plat thereof recorded in Plat Book "B" , page 49, Public Records of Dade 1 County, Florida, said lands situate, lying and being in Broward County, Florida, J be and the same are hereby re-zoned from existing zoning classifi- cation to B-2 zoning classification. Section 2. That all ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict. Section 3. The ordinance was introduced and real in full on February 21, 1972. Then, by unanimous consent of all commissioners ' I present, the ordinance has been read by title only the second time i and third time, and finally passed at the meeting of March 13, 1972. Section 4. That this ordinance shall be in force and take effect I f t immediately upon its final passage and adoption. i PASSED and ADOPTED on First Reading on the 21st day of I February, 1972. Dear Mrs. Mullikin: i You gave me a copy of a handwritten list evidently prepared by Mr. Clay and concerning his notes regarding a listing of ordi- nances and resolutions. I have started checking the items on Mr. Clay' s list to verify that our records agree with his. As I will mention in a number of instances in separate correspondence on each item, our records indicate that we have generally delivered the copies at the time they were approved and/or Mr. Clay's understanding was in error. However, as I further indicate in the correspondence, I am in the process of going through the items, one by one, so that we can verify our records with yours. i Mr. Clay does not have a record of an ordinance re-zoning 1 property of M. Stirling Collins to B-2 zoning classification. This property is briefly described as Lots 1, 2, 3 and 4, Block 19 , TOWN OF DANIA. i The property in question is a parcel approximately 100 feet deep in a north-south dimension lying immediately south of, and adjacent to, West Dania Beach Boulevard and extending from S. W. s 5th Avenue on the east to S. W. 6th Avenue on the west. We actually advertised this matter for hearing before the city commission on February 21, 1972. The ordinance was passed on first reading on February 21, 1972. At the time, my notes indicate that Mr. Hampton wanted to table further readings until he could work out some understanding with Mr. Collins regarding payment of several past due special assessment liens. Subsequently, Mr. Hampton did report to the commission that he had reached a satisfactory understanding and that he recommended the final passage of the ordinance. As a result and by unanimous consent of all commissioners present, the ordinance was passed on both second reading and on third reading on March 13, 1972. i j If your further check of the city' s records does indicate that Mr. Clay filed a copy of the ordinance, the draft which we delivered may not have had an explanation in the title showing that the ordinance was passed on more than one reading at the same meeting. We would not have made a separate or specific file for a routine ordinance of this type and would have ordinarily handled the original to Mr. Clay at the time of reading. At any rate, the ordinance was passed on final reading on March 13, 1972. I am enclosing a replacement copy which we have currently { prepared and to which I have assigned the number 7. 1 so that I will have a proper record in my correlation table. Please file the copy in your ordinance file. I shall include mention of the ordinance in our report to the commission when we complete our final verification + of records with the somewhat informal record which Mr. Clay evidently maintained. i Sincerely yours, Clarke Walden _ a CW/dms Encls. fi ; i4 �4n 1 i ORDINANCE NO . 7 AN ORDINANCE AUTHORIZING THE CITY OFFICIALS OF CITY OF DANIA TO ENTER INTO A LARGE USER WASTE WATER AGREE- MENT WITH CITY OF HOLLYWOOD; AND PRO- i VIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION. i i WHEREAS, City of Dania has been negotiating with City of Hollywood regarding an agreement between the two cities so i that City of Dania may connect its waste water collection system i to the facilities of City of Hollywood; and a WHEREAS, an extensive form of agreement identified as "Large User Waste Water Agreement" has been circulated among the officials of City of Dania and is on file with the City i Clerk-Auditor of City of Dania; and i WHEREAS, the City Commission of City of Dania desires to enter into such agreement, i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF CITY OF DANIA, AS FOLLOWS : j Section 1. That the Mayor-Commissioner, City Manager and City Clerk-Auditor are hereby authorized to execute the said large user waste water agreement on behalf of City of Dania and i to deliver executed copies to City of Hollywood for execution by City of Hollywood. I I Section 2 . That City of Dania does hereby declare its purpose and intent to enter into said agreement and to be bound by all of the terms of the agreement. A ' I i ) f Section 3 . That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 4. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 13th day of March, 1972 .
