ORDINANCE NO. 581
AN ORDINANCE AMENDING §18, CODE OF
ORDINANCES, CITY OF DANIA, FLORIDA,
AS PREVIOUSLY AMENDED, BY PROMUL—
GATING AND ENACTING A SECTION KNOWN
AS SECTION 18-17, PERMITTING AN
i EARLIER SALE OF OCCUPATIONAL LICENSES
FOR THE LICENSE YEAR WHICH BEGINS ON
OCTOBER 1ST OF EACH YEAR AND ENDS ON

THE 30TH DAY OF SEPTEMBER OF THE FOL—
LOWING YEAR, AND ELIMINATING THE
POLICY OF ALLOWING ANY GRACE PERIOD j
WITH RESPECT TO PAYMENT OF LICENSES;
AND PROVIDING FOR A PENALTY OF 25%
OF THE AMOUNT OF THE LICENSE FEE
WHERE THE LICENSE IS NOT PURCHASED
PRIOR TO THE 1ST DAY OF OCTOBER OF
THE LICENSE YEAR; AND PROVIDING THAT
ALL ORDINANCES OR PARTS OF ORDINANCES
i IN CONFLICT HEREWITH BE REPEALED TO
THE EXTENT OF SUCH CONFLICT; AND PRO-
VIDING THAT THIS ORDINANCE SHALL BE
i IN FULL FORCE AND TAKE EFFECT AS OF
ITS PASSAGE AND ADOPTION ON THIRD
AND FINAL READING.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
i
DANIA, FLORIDA:
„�, Section 1 . That §18, Code of Ordinances, City of Dania,
!! Florida, as same may have been previously amended, be and the
same is hereby further amended by promulgating and enacting a
Section 18-17, which such section shall read as follows:

iSection 18-17 - Dates for sales of occu-
pational licenses and penalties f
" (1) Occupational licenses shall be
issued for a license year beginning on the
1st day of October of each year and ending
on the 30th day of September of the follow-
ing year. "

" (2) With respect to the license year
beginning on the 1st day of October, 1971,
the proper administrative officers of the
city are directed to make such licenses {

j available for sale during the period from
August 1, 1971 to September 30, 1971, and
during the term of the license year, and,
thereafter and in future years , the ad-
ministrative officers of the city shall
allow occupational licenses to be pur-
chased or renewed for any license year
at least sixty (60) days prior to the be-
ginning of the license year. "

" (3) To the extent that it has been
the policy of the city during past years,
by resolution, motion or otherwise, to
allow any type of grace period regarding
the purchase of occupational licenses, such
policy is hereby terminated and ended and
the administrative officers of the city are
instructed to enforce all licensing laws
j strictly and to charge any person, firm or
entity with a violation of the licensing
ordinances of the city if such person, firm
or entity continues in business without re-
newing his license or if such person, firm
or entity commences a business without ob-
taining a license . "

" (4) To the extent that the admini-
strative officers of the city determine
that a licensee was actually doing business
in the city as of the 1st day of October of
any license year and to the further extent
i
that said licensee was delinquent in pur-
chasing an occupational license prior to
the 1st day of October of the particular
j license year and, as a matter of fact, is
delinquent in the purchase of an occupational
license, the administrative officers of the
city are authorized and directed to collect
i
a delinquent fee or delinquent penalty equal j
j to 25% of the ordinary annual license fee at
the time that the license is actually issued.
That is, the City of Dania does hereby impose
a penalty or charge equal to 25% of the annual
occupational license fee (at the time of the
issuance of an occupational license) , where
the licensee was actually doing business in
the city as of the 1st day of October of a
particular license year and where the licensee
did not purchase an occupational license prior
to the lst day of October of said year. "

Section 2 . That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed to the

extent of such conflict.
Section 3. That this ordinance shall be in full force i
and effect as of its passage and adoption on third and final
reading.

June, 1971.
