AN ORDINANCE IMPOSING, SETTING AND
I REQUIRING PEOPLES GAS SYSTEM, INC . ,

A FLORIDA CORPORATION, TO PAY THE 3%
FRANCHISE FEE PERMITTED BY AUTHORITY
OF SECTION 9. , ORDINANCE NO. 406,
I CITY OF DANIA, FLORIDA, ADOPTED ON
j JANUARY 4, 1960; AND PROVIDING THAT
SUCH FRANCHISE FEE OF 3% SHALL BE
j PAID ON GROSS RECEIPTS DERIVED BY
PEOPLES GAS SYSTEM, INC. , FROM THE
RETAIL SALE OF UTILITY GAS WITHIN
THE CORPORATE LIMITS OF THE CITY OF
DANIA ON AND AFTER MAY 1, 1971; AND
PROVIDING THAT SUCH FRANCHISE FEE SHALL
BE IN ADDITION TO ANY UTILITY TAXES DUE
CITY OF DANIA FROM THE PURCHASERS OF
UTILITY GAS FROM PEOPLES GAS SYSTEM,
INC. ; AND PROVIDING THAT ALL ORDINANCES

OR PARTS OF ORDINANCES IN CONFLICT HERE-
WITH BE REPEALED TO THE EXTENT OF SUCH
CONFLICT; AND PROVIDING THAT THIS ORDI-
NANCE SHALL BE IN FULL FORCE AND TAKE
EFFECT AS OF ITS PASSAGE AND ADOPTION
ON THIRD AND FINAL READING.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA:
Section 1. That City of Dania, Florida does hereby
impose, set and require Peoples Gas System, Inc, to pay the 3% i
i
franchise fee which is permitted to City of Dania, Florida,
j
under the terms of the franchise which is the subject of Ordi-
nance No. 406 of City of Dania, Florida, adopted on January 4,

1960. Specifically, such 3% franchise fee (allowed under Sec-
tion 9, of said Ordinance No. 406) shall be paid on gross
i
receipts derived by Peoples Gas System, Inc. , from the retail
sale of utility gas within the corporate limits of City of
I
Dania, Florida, on and after May 1, 1971.
Section 2 . Said franchise fee shall be in addition
i

to any utility taxes due City of Dania, under separate ordinances ,
from the purchasers of said utility gas even though Peoples Gas
,
System, Inc. may have the responsibility for collection of said
i

utility taxes .
Section 3 . That all ordinances or parts of ordinances !
in conflict herewith are hereby repealed to the extent of such
i
I
conflict.
1 Section 4. By unanimous consent of all commissioners
present, this ordinance has been introduced, read the first time,
read by title only the second time and the third time and passed
on the first reading, second reading and third reading at the

meeting of the city commission held on May 17, 1971.
Section 5 . That this ordinance shall be in force and

take effect immediately upon its final passage and adoption. ''""'•l

and on Third Reading on the 17th day of May, 1971.
