AN ORDINANCE PROVIDING FOR OFF-STREET PARK- j ING IN VARIOUS ZONING AREAS OF THE CITY OF DANIA; PROVIDING FOR PAVING OF SAID AREAS AND MAKING THE PROVISION FOR OFF-STREET PARKING BY THE OWNER A PREREQUISITE TO THE a CONSTRUCTION OF ANY HOUSE OR BUILDING; PRO- VIDING FOR APPROVAL OF PROPOSED OFF-STREET ! PARKING BY THE BUILDING INSPECTOR; AND PRO- I VIDING THAT ALL ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT THIS ORDINANCE SHALL BE IN FORCE AND i TAKE EFFECT IMMEDIATELY UPON ITS FINAL PASSAGE AND ADOPTION. WHEREAS, The City of Dania finds it necessary to pro- . ! vide a uniform system for providing off-street parking for all future construction within the limits of said city; and i a s ^' WHEREAS, a provision for such off-street parking will i be for the best interests of the public welfare of the city, NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: j I f Section 1. Off-Street Parking Permanently maintained, F Off-street parking for vehicles shall be provided in connection i with any building or premises used or designed to be used for r purposes as set forth herein. For the purposes of this ordinance, E one automobile parking space shall be a minimum of ten by twenty s feet (200 square feet) , usable for the parking of an automobile. In addition, adequate interior driveways shall be provided so as to connect the parking space with a public street or area. More particularly, said off-street parking shall comply with the mini- mum requirements, to wit: � pp l c I I i I (a) Dwellings - Single, Duplex and Multiple Family: - One parking space for each single family dwelling, y three parking spaces for each two family dwelling, 1.25 parking spaces for each efficiency unit in a multiple family dwelling; 1. 5 parking spaces for each one bedroom and two parking spaces for each two bedroom or over unit in a multiple family dwelling. (b) Hotels, Rooming Houses, Clubs, Motels, i i Tourist Courts and Transient Accommodations. At least one park- . i i ing space for each of the first forty individual guest rooms or i suites; one additional parking space for every two guest rooms ! or suites in excess of forty. Public meetings rooms in hotels ! and clubs shall be further controlled by (c) of this Ordinance; i restaurants located in any of the foregoing shall be controlled v by (f) of this Ordinance and meeting rooms located in any of i the foregoing and not governed by any of the foregoing shall be controlled by (g) of this Ordinance. i i i (c) Churches Theatres, General Auditoriums, Sta- diums, Recreational Establishments and other similar places of HRRPTIh'IP_ At least one parking space for every six seats provided. I (d) Hospitals Sanitariums and Welfare Institutions. j One parking space for each two hundred square feet of sleeping room area for patients contained in said building. I i (e) Commercial. One parking space for every three j hundred square feet of floor area in such building. In addition, one parking space must be provided for every four persons employed or intended to be employed in such business. i (f) (1) Restaurants or similar places dispensing food, drink or refreshments. One parking space for each fifty -2- I a square feet of floor area devoted to patron use within the estab- lishment . In addition, one parking space must be provided for every four persons employed or intended to be employed in such business . (f) (2 ) Drive-in Restaurants and similar places dispensing food, drink or refreshments to vehicular patrons out- side of building. Parking layout shall be subject to the approval of the Building Department . II (g) Private or Public Educational, Recreational 1 i and Entertainment use involving the assembling of persons and not governed by any of the preceding provisions shall provide one parking space for every two hundred square feet of area in- volved in such use. q (h) Office, Professional Buildings or similar uses. one parking space for each three hundred square feet of floor area so used. (i) Industrial. one parking space (exclusive of service roads, entrance and exits) shall be provided for each i 1000 square feet of the gross floor area in the building, or one i parking space for each two employees shall be provided, whichever requires the greater amount of parking space; such parking spaces 1 shall be located not further than 1500 ' from the industrial use in question, and covered by a Unity of Title; such non-continguous property must be located either in a Business or Industrial zone. If retail sales are conducted in connection jwith such industrial use, additional off-street parking will be provided as applies to the commercial uses; the portion of the j structure allocated for retail sales shall be used as a basis for determining the additional off-street parking to be provided. i -3- I I c 1 A r y As a prerequisite to the issuance of a build- ing permit for the erection of a new structure, or for an addi- tion to an existing structure, used for industrial purposes, or for the issuance of a Certificate of Use or Occupancy for the i conversion of the use of, or a change of zone on, an existing i z industrial structure, an affidavit must be executed by the owner f and/or tenant or lessee, which shall include the information hereinafter listed; if such information is unknown, the same shall be so noted; all information furnished shall be honest i I and true to the best knowledge and belief of the affiant : 1. Number of company and/or other vehicles used in the business. i - 2 . Number of employees when use is in I i I full operation and structure is fully occupied. 3 . How the industrial use will be ser- viced and supplied (that is, railroad, truck, other) ; if by truck or similar vehicles, the estimated number per day and the type and size of same. i I 4. If any retail sales are to be conduc- ted, the floor area to be devoted to such sales. i I 5 . The number of tenants, lessees, or I i separate occupants of such industrial building. In addition, such affidavit will include a j statement to the effect that the owner, tenant, and/or lessee understand that the off-street parking as required in accordance with the applicable regulations has been determined on the basis of information submitted in such affidavit and that the issuance of a Certificate of Use and Occupancy for a change or conversion i 1 ! -4- d of use will be dependent upon any additional off-street parking being provided, as may be required by the proposed new use. Off-street loading facilities, of a minimum size of 10' x 25 ' at each loading and unloading door, must be provided for all industrial uses, such facility and area required { for the activity to be of such size and properly located to serve the industrial uses concerned; said facility shall not conflict in any manner with the off-street parking facilities or the traffic on the adjacent public right-of-ways. 1 The application for a building permit and/or Certificate of Use and Occupancy for a conversion of use, shall C i contain a detailed plot use plan, including a floor plan, showing i ., . i full compliance with the regulations. E t 6 I Section 2 . Applications for building or use permits t i i shall indicate the area to be used for parking and permits shall I be issued stating that such area shall be so reserved and developed. Recordable restrictions so reserving such area may be required at the discretion of the City Commission. Such area reserved for , parking area will be marked on the zoning maps and no permits for i additional use of such area shall be issued. Area reserved for i parking in connection with any use shall be under the same owner- ship as that of the use itself. i Section 3 . Any activity combining two or more uses indi- cated in the foregoing schedule shall provide parking space re- quired by all such uses, except in those cases where the proposed project complies with existing off-street parking ordinances. Section 4. The area reserved for off-street parking shall be hard-surfaced. Where the parking area is hard-surfaced the same shall consist of a good rolled rock base, well tamped, 1 -5- � � i 9�9 j and topped with asphaltic concrete in accordance with the paving specifications of the City of Dania. Occupancy of a given struc- ture or premises shall be prohibited until the required parking i ! area has been improved, inspected, and approved . Section 5. Off-street parking spaces shall not be loca- ted in a required front q yard except as follows: i � f � I j (a) In any single family or two family district off-street parking may be located in a required front yard. � I (b) In the multiple family and business districts, required off-street parking spaces may be located in a required front yard provided the spaces are so arranged as to preclude jbacking out on the traveled way of a public street, and meet the j provisions contained in the parking design standard on file in , the building department . l (c) In any district where a parking structure is I permitted to project into a required front yard, off-street parking spaces within the structure may be located in a required front i yard. i (d) Driveway space for access to parking area or drive-ins service facilities may be located in a required front I yard. (e) in any district, 40 per cent of the front set- . i 3 back area may be used for off-street parking if a 30 foot setback is provided and access to the public right-of-way is from con- trolled exists and entrances. Section 6. Off-street parking areas shall be located on the same lot, parcel or premises as the use to be served or on a parcel of land within one hundred feet, provided there is a j I � I i � 4 unity of title between the parcel being served and the parcel on which such off-street parking is located . i Section 7. In all zones other than the single family, I the parking area shall be marked, either by painted lines, pre- cast curbs, or in a similar fashion, indicating the individual parking spaces or stalls. i (a) Specifically, and without limitation on the I foregoing and with respect to the computation of proper parking a i I spaces for multiple family apartment units, it is hereby ordained f that a parking space shall not be recognized as a proper parking space, in computing the availability of the minimum spaces re- quired by other ordinances, if such parking space is so designed or located that an operator of a motor vehicle cannot reasonably gain access to a public street, from the parking space, by opera- i i ting the vehicle in a forward gear only. However, with respect to living units that constitute either single family dwellings f or duplex apartment buildings, a parking space shall be deemed to be proper parking space even though it is necessary to back into a public street (from the parking space) in order to gain i access to the public street. I i l (b) Drainage and Maintenance Off-street parking 1 facilities shall be drained to prevent damage to abuttingf property f and/or public streets and alleys and surfaced with erosion-resis- tant material in accordance with applicable city specifications. Off-street parking areas shall be maintained in a clean, orderly, and dust-free condition at the expense of the owner or lessee and not used for the sale, repair, or dismantling or servicing of any vehicles, equipment, materials or supplies. 1 l -7- I i j (c) A landscape plan shall be submitted to the jCity with the off-street plans for any structure other than single i family and duplex for the approval of the building department. (d) Entrance and Exits: Location and design of entrances and exits shall be based upon reasonable requirements for safety traffic regulations and standards, landscaping, curbing, i or approved barriers shall be provided along lot boundaries to I 1 i r control entrance and exit of vehicles or pedestrians. All egress and ingress to off-street parking areas shall be so designed as to prohibit backing out of vehicles into public right-of-ways, r � j except as provided for in Section 7 (a) . This shall not be con- ! I strued to prevent backing out into an alley. (e) Plan Approval and Permits: Prior to the I j issuance of any building permits for any building or structure f k subject to this Ordinance or for structurally altering or con- ff verting any existing building or structure of for paving, grading, leveling or other permits, a suitable plan shall be submitted to r � t the Zoning Director indicating the landscaping as well as the i j parking layout, proposed drainage on the premises, proposed i i j lighting on the premises and all driveways extending beyond the II i � property line into the public right-of-way. The landscaping plan i shall be approved by an architect or landscape architect . The (, 3 landscape plan for the parking area shall meet with the approval d, i of the Building Director who shall review the proposed parking area and its landscaping to ascertain that the plan will promote �I and facilitate the objectives of this Ordinance. Any deviation I from the plan approved by the Zoning Director shall constitute a violation of this ordinance. Plans shall be drawn to an accurate r � rye. I' 4 (I(P 1 I scale, and shall show the layout of the lot entrances and exits, i drainage, provisions, lighting provisions, surfacing curb barriers and location and type of landscaping. Section 8. That all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such j conflict. Section 9. That this ordinance shall be in force and I I take effect immediately upon its final passage and adoption.
