AN ORDINANCE PROVIDING FOR CHARGES
FOR PICK-UPS OF GARBAGE AND TRASH
AT RESIDENCE SITES AND COMMERCIAL j
SITES UNDER THE TERMS AND CONDI-
TIONS STATED HEREIN; AND PROVIDING
FOR AN EXTRA CHARGE OF $5.00 PER
UNIT FOR PICK-UPS OF REFRIGERATORS ,
STOVES, FURNITURE AND OTHER UNUSUAL
TRASH PRODUCTS ; AND PROVIDING THAT
ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH BE REPEALED TO
THE EXTENT OF SUCH CONFLICT; AND
PROVIDING THAT THIS ORDINANCE SHALL
BE IN FULL FORCE AND TAKE EFFECT

Section 1. 1 For the purposes of this ordinance,
certain words and phrases are defined as follows : f i
(a) "Garbage" , as used herein, shall
mean and refer primarily to food I
wastes consisting principally of
animal and vegetable matter, sub-
ject to decay, and sacks, cans, I
" bottles or tins used for the pur-
pose of storing or containing
foods, meats and vegetables;
(b) "Trash", as used herein, shall
mean and refer to cartons, news- i
papers, magazines, grass cuttings,
tree branches and shrubbery trim- e
r
mings . However, the definition
shall not include tree trunks and I
shall not include tree limbs which
are more than three feet in length.
Further, the definition of "trash"
shall not include refrigerators,
stoves, hot water heaters, furni-
ture, building materials, products
that are not organic in nature and
articles that are not the natural
products of a yard, tree or shrubbery.

(c) "Residence site,,, as used herein,
I shall mean and refer to the lot or
Parcel of land on which is con-
structed a single family home, a
duplex apartment or a multiple
family type of building not to I
contain more than four independent I
living units. Such definition of
"residence site,, shall not include
any sites on which are located
apartment houses containing more
than four independent living units,
hotels, motels and similar j t commercial accommodations. types of j

J (d) "Commercial site", as used herein, II
I( shall mean and refer to the location
of any apartment house having more
I than four independent living units,
motel having more than four rental
units and trailer park having more
than four trailer spaces . Further,
the definition of "commercial site"
1 shall mean and refer to the address I
of any business in the city where !
the occupant of the premises holds
a valid occupational license from
the city. r

(e) "Pick-up „
point as used herein, p
shall mean and refer to the parti-
cular location on a residence site i
or a commercial site which is desig-
f nated by the city for the pick-up of
garbage or trash.
Section 2 , S
For each residence site and for each
commercial site located in the City of Dania, the city shall

free of charge, not more than four 20-gallon cans of €E'
garbage or trash with the frequency of pick-up to be two pick-
ups per week. For the purpose of clarifying the exact meaning
and intent of the within section and, by way of example, the t
city declares that a residence site shall be entitled to a

maximum pick-up of four 20-gallon cans twice
per week, regard- I
less of whether the residence site contains one single family
living unit or a maximum of four independent living units.

That is, the residence site shall not be entitled to the pick-

up of a greater number of cans because the site consists of
i
(for example) a duplex apartment unit, an apartment building
containing three independent units or an apartment building
containing four independent units . Further, as to commercial
sites, each motel shall be entitled to a pick-up of a maximum
I
of four 20-gallon cans without regard to the number of units i
in the motel, each hotel shall be entitled to a maximum pick-up
of four 20-gallon cans without regard to the number of units in
the hotel and each trailer court shall be entitled to a maximum '
i
pick-up of four 20-gallon cans without regard to the number of
i
trailer spaces in the trailer court. Further, as to trailer
I

courts, each individual house trailer shall not be entitled to i
I
any pick-up by the city. In addition, regardless of size,
I
volume of business or amount of occupational license, each

commercial establishment in the city paying an occupational
i
j license fee shall be entitled to a pick-up of four 20-gallon

Section 3 . All pick-ups at residence sites and

commercial sites shall be at pick-up points designated by
representatives of city of Dania.

Section 4. Upon payment of a fee of $5.00 per unit, ,
the city shall pick-up individual units of refrigerators,

stoves, furniture and other unusual trash products . If, for C
jexample, a person desires a pick-up of a used refrigerator, a

used stove and a used article of furniture, he shall pay on R

the basis of $5.00 per unit, or a total of $15.00. Payment
of such charges shall be made, in advance, to the city clerk-
auditor.

Section 5 . That all ordinances or parts of ordi-
nances in conflict herewith are hereby repealed to the extent

of such conflict.
Section 6 . That this ordinance shall be in full
force and take effect immediately upon its final passage and
adoption.
