AN ORDINANCE PROVIDING FOR RECIPRO-
CITY WITH REGARD TO THE ISSUANCE OF
CERTIFICATES OF COMPETENCY TO GENERAL
CONTRACTORS, PLUMBERS AND ELECTRICIANS
BY THE EXAMINING BOARDS OF THE CITY OF
DANIA, FLORIDA, IN SITUATIONS WHERE
APPLICANTS PRESENT CERTIFICATES OF
COMPETENCY ISSUED BY OTHER JURISDIC-
TIONS WHICH HAVE ADOPTED SOUTH FLORIDA
BUILDING CODE; AND PROVIDING FOR THE
VARIOUS TERMS AND CONDITIONS BY WHICH

RECIPROCITY WILL BE ALLOWED; AND PRO-
VIDING THAT ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH BE
REPEALED TO THE EXTENT OF SUCH CONFLICT;
AND PROVIDING THAT THIS ORDINANCE SHALL
BE IN FULL FORCE AND EFFECT AS OF ITS
PASSAGE AND ADOPTION ON THIRD AND FINAL
READING.
WHEREAS, Board of County Commissioners, Broward County,
Florida, acting for and on behalf of Broward County, Florida, and
various municipalities located within the limits of Broward
County, Florida, have adopted the so-called South Florida

Building Code; and
WHEREAS, Broward County, Florida, and the various
I
municipalities in Broward County, Florida, which have adopted
South Florida Building Code each have various examining boards
whose primary purpose is that of giving written examinations to
general contractors, plumbers and electricians to determine,

j respectively, the knowledge of said general contractors,
plumbers and electricians of the various provisions of South i
Florida Building Code; and
WHEREAS, it is the practice and procedure of said

jurisdictions to issue certificates, commonly known as certi-
ficates of competency, to general contractors, plumbers and {

electricians to demonstrate that they have learned the provisions

of South Florida Building Code as a result of passing such
written examinations; and

WHEREAS, City of Dania has recently adopted South j
Florida Building Code; and
j WHEREAS, through reciprocity, City of Dania is willing

to recognize certificates of competency issued by examining

boards of other jurisdictions (that is, Broward County, Florida,
i
and municipalities in Broward County, Florida) where the appli-
cant before such other jurisdiction has passed a written exami-
nation based on the South Florida Building Code and where such
i
i
jurisdiction, by reciprocity, is willing to recognize certi-
ficates of competency issued by the various examining boards of
the City of Dania, Florida,

NOW, THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF DANIA, FLORIDA, as follows:

Section 1. That, as used herein, the following words
and phrases are defined as follows:
"South Florida Building Code" -
"South Florida Building Code" , as
used herein, shall mean and refer to
the certain building code promulgated

commonly referred to in the building
trades as the "South Florida Building
Code" .

"Other jurisdictions"

"Other jurisdictions", as used herein,
sshall mean and refer to Board of County

i Commissioners, Broward County, Florida,
jas the political body having jurisdiction
over the unincorporated areas of Broward
County, Florida, and any municipalities i

in Broward County, Florida, which have I

adopted South Florida Building Code.
"Certificate of competency" - I'

"Certificate of competency" , as used
i
herein, shall mean and refer to the certi-
ficate, document or other written evidence
(even though the exact phrase, certificate
I
of competency, is not actually used) issued
by the various general contractors ' exami-
ning boards, plumbers' examining boards and
electricians ' examining boards of other
jurisdictions to indicate, respectively,
that general contractors, plumbers and
electricians of said jurisdictions have
a
satisfactorily passed written examinations

jto determine the knowledge of said classes

Code.

"Person" -
"Person", as used herein, shall mean,

where proper, individuals, partnerships
and corporation.
Section 2 . In any situation where an applicant who
makes application to the proper examining board of City of
Dania, Florida, for either a general contractors ' occupational
license, plumbers ' occupational license or electricians ' occu-
pational license and submits written evidence to such examining
board of City of Dania, Florida, that he holds a current certi-
ficate of competency issued by any other jurisdiction, the City

Manager of City of Dania shall automatically issue to such appli-
cant a certificate of competency which will permit the applicant
to practice his trade in the City of Dania, without requiring

v I that the applicant take any type of examination before the
examining board in City of Dania, Florida, on condition that the
City Manager in City of Dania first makes the following deter-

minations:
(a) The applicant before the examining board of City

of Dania, Florida, must prove that the South Florida Building
Code is in effect in the other jurisdiction.
j (b) The applicant must further prove that he success-
{ fully passed a written examination conducted by the other juris-
diction, based on his knowledge of South Florida Building Code.
(c) Written evidence must be furnished from the
other jurisdiction that it has adopted an ordinance (or reso-
lution) which will cause the other jurisdiction to recognize,
by reciprocity, certificates of competency issued by all
examining boards of City of Dania, Florida, without requiring
that applicants before such other jurisdictions (holding

f certificates of competency from City of Dania, Florida) take

written examinations as to their knowledge of South Florida
i
Building Code.

Section 3. Notwithstanding the aforesaid provisions,
i
the examining boards of City of Dania, Florida, shall not
recognize certificates of competency issued by other juris-
dictions, even though such jurisdictions may have adopted
I
South Florida Building Code and even though such jurisdictions
may have reciprocity with City of Dania, Florida, if the certi-
ficates of competency were issued by virture of so-called
"grandfather clauses" or savings clauses or if such certificates
i
of competency were issued by other jurisdictions prior to their j
adoption of South Florida Building Code.
Section 4. In determining whether other jurisdictions
have adopted South Florida Building Code or whether such juris-
dictions have administered written examinations to applicants
t appearing before City of Dania or determining whether such other
I
j jurisdictions have reciprocity with City of Dania, Florida, the
i
various examining boards of City of Dania, Florida, are authorized
a
to recognize written communications from the proper officials
of Broward County, Florida, or from the city managers, mayors
I or administrative heads of the various municipalities in Broward
j
# County, Florida.

! Section 5 . That all applicants before City of Dania,
i
Florida, shall continue to pay all fees and charges heretofore
imposed by City of Dania, Florida.

Section 6 . That ordinance no. 446, adopted on
July 2, 1962, and recognizing certificates of competency
I
j issued by central examining board shall remain in full force
i
j and effect.
I
Section 7. That all ordinances or parts of ordi-
nances in conflict herewith be and the same are hereby
lrepealed to the extent of such conflict.
i

Section B. That this ordinance shall be in full
i
force and effect as of its passage and adoption on third and
final reading.
