AN ORDINANCE PROHIBITING LOUD, UNNECESSARY
{ OR UNUSUAL NOISE OR ANY NOISE WHICH ANNOYS,
DISTURBS, INJURES OR ENDANGERS THE COMFORT,
REPOSE, HEALTH, PEACE OR SAFETY OF OTHERS
WITHIN THE CITY OF DANIA, FLORIDA; AND
DECLARING CERTAIN ACTS TO BE LOUD, DISTURB-
ING AND UNNECESSARY NOISES IN VIOLATION OF
THIS ORDINANCE; AND REPEALING ALL ORDIN-
ANCES OR PARTS OF ORDINANCES IN CONFLICT
{ THEREWITH; AND PROVIDING THAT THIS ORDIN-
ANCE SHALL BE IN FORCE AND TAKE EFFECT
IMMEDIATELY UPON ITS FINAL PASSAGE AND
ADOPTION

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA:
Section 1. It shall be unlawful for any person to make, con-
tinue or cause to be made or continued any loud, unnecessary or unusual
noise or any noise which either annoys, disturbs, injures or endangers

the comfort, repose, health, peace or safety of others within the City

of Dania.
Section 2. The following acts are declared to be loud, dis-
turbing and unnecessary noises in violation of this section, however,
the following enumeration is not intended to be exclusive:
(1) Horns and signaling devices. The sounding of any horn or
signaling device on any automobile, motorcycle or other vehicle on any

street or public place within the City of Dania, Florida, except as
a danger warning; the creation by means of any such signaling device
of any unreasonably loud or harsh sound; the sounding of any such j
device for any unnecessary and unreasonable period of time; the use

of any signaling device except one operated by hand or electricity;
J{J the use of any horn, whistle or other device operated by engine ex- F

haust; the use of any such signaling device when traffic is for any
reason held up.

j (2) Radios, televisions Radios, televisions and phonographs. The using, operat-
ing or permitting to be played, used or operated, of any radio or
i
television set, musical instrument, phonograph or other machine or

i I
devise for the producing or reproducing of sound in such manner as to
disturb the peace, quiet and comfort of the neighboring inhabitants
i
or at any time with louder volume than is necessary for convenient
hearing for the persons who are in the room, vehicle or chamber in

{ which such machine or device is operated and who are voluntary listen-
ers thereto. The operation of any such set, instrument, phonograph,
machine or device between the hours of 11:00 p.m. and 7:00 a.m. in

{ such a manner as to be plainly audible at a distance of three hundred
i
feet from the building, structure, or vehicle in which it is located
i

shall be prima facie evidence of a violation of this subsection.

a (3) Loud-speakers and amplifiers for advertising.and amplifiers for advertising. The using,
operating or permitting to be played, used or operated of any radio
or television receiving set, musical instrument, phonograph, loud-
speaker, sound amplifier or other machine or device for the producing
or reproducing of sound which is cast upon the public streets for the

purpose of commercial advertising or attracting the attention of the
public to any building or structure.
(4) Defect in vehicle or load. The use of any automobile,
motorcycle or vehicle so out of repair, so loaded or in such manner
as to create loud and unnecessary grating, grinding, rattling or j

(5) Loadin�or unloading vechiles. The creation of a loud

{ or excessive noise in connection with the loading or unloading of a

vehicle.

of a loud and excessive noise by opening, sealing or destruction

(7) Construction or repairing of buildings. The erection,
including excavating, demolition, alteration or repair of any build-
ii
ing other than between the hours of 7 :00 a.m, and 6 :00 p.m. on any
1 day except Sundays and except in cases of urgent necessity in the
i
interest of public health and safety and then only with a permit from
the building inspector, which permit may be greanted for a period not
i
to exceed three days or less while the emergency continues, and which
1
permit may be renewed for periods of three days or less while the
emergency continues. If the building inspector shall determine that
i
the public health and safety will not be impaired by the erection,
i
demolition, alteration or repair of any building or the excavation of
streets and highways within the hours of 6 :00 p.m. and 7 :00 a.m. and
if he shall further determine that loss or inconvenience would result
to any party in interest, he may grant permission for such work to be
done within the hours of 6:00 p.m. and 7 :00 a.m. upon application being
i made at the time the permit for the work is awarded or during the pro-
gress of the work.

l (8) Schools, courts, churches and hospitals. The creation
of any excessive noise on any street adjacent to any school, institu-
tion of learning, church or court while the same are in use, or adjacent
j to any hospital, which unreasonably interferes with the workings of
f
such institution, or which disturbs or unduly annoys patients in the
i
hospital;i provided, that signs shall be displayed in such streets
I
indicating that the same is a school, hospital, church or court street.
j (9) Vendors and peddlers. The shouting and crying of peddlers,

and vendors which disturbs the peace and quiet of the neighborhood.
(10) Amusement parks, stadiums circuses and carnivals.stadiums circuses and

Any sound including but not limited to music, both live and reproduced,
which sound is either amplified or non-amplified, which emanates from
such amusement park, stadium, circus or carnival, if audible more than
a distance of three hundred feet from any boundary of such amusement
park, stadium, circus or carnival.
Section 3. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent of such

conflict.

Section 4. That this ordinance shall be in force and take effect
immediately upon its final passage and adoption.
