ORDINANCE NO. 522

AN ORDINANCE GIVING A POLICE OFFICER
AUTHORITY TO STOP ANY PERSON IN A PUB-
LIC PLACE WHOM HE HAS PROBABLE CAUSE
j TO BELIEVE MAY BE COMMITTING, MAY
HAVE COMMITTED, OR IS ABOUT TO COMMIT
A FELONY, IN ORDER TO DEMAND OF SUCH
PERSON HIS NAME, ADDRESS AND AN EXPLAN-
ATION OF HIS ACTIONS; AND PROVIDING FOR
THE RIGHT OF SEARCH; AND PROVIDING THAT
ANY WEAPON DISCLOSED BY SUCH SEARCH
MAY CONSTITUTE AN OFFENSE; AND PRO-
VIDING FOR A PENALTY; AND REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES
1 IN CONFLICT HEREWITH; AND PROVIDING
THAT THIS ORDINANCE SHALL BE IN FORCE
AND TAKE EFFECT IMMEDIATELY UPON ITS
PASSAGE AND ADOPTION.
• BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA, AS FOLLOWS:
Section 1. - A police officer may stop any person in a public place
whom he has probable cause to believe may be committing, may have com-
mitted, or is about to commit a felony and may demand of such person
his name, address and an explanation of his actions.

Section 2. - When a police officer has stopped a person for ques-
tioning, pursuant to Section 1. of this ordinance, and when such police offi-
cer has probable cause to believe that he is in danger of life or limb, he
may search such person for a dangerous weapon. If the police officer

finds such a weapon, the possession of which may constitute an offense,

he may take and keep it until the completion of the questioning, at which
time he shall either return it, if lawfully possessed, or arrest such person.
Section 3. - Any person convicted of violating any provisions of
7 this ordinance shall be guilty of an offense, punishable by a fine not

ex-
ceeding500. 00 or$ y imprisonment in the municipal jail, in the discre-
tion of the court, for a period not exceeding 60 days, or by both such fine

or imprisonment.
Section 4. - That all ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
Section 5. - That this ordinance shall be in force and take effect
immediately upon its final passage and adoption.
PASSED and ADOPTED on First Reading on the 24th day of June,
1968.
PASSED and ADOPTED on Second Reading on the 1st day of July,
1968.
PASSED and ADOPTED on Third Reading on the —� day of
