HomeMy WebLinkAboutO-1968-517 i i ORDINANCE NO. 517 i AN ORDINANCE AMENDING ALL EXIST- ING ORDINANCES CONCERNING THE SALE, RECEIPT, PURCHASE, POSSESSION, CON- SUMPTION, HANDLING, DISTRIBUTION AND USE OF CIGARETTES SOLD OR TO BE SOLD AT RETAIL WITHIN THE TERRITORIAL LIM- ITS OF THE CITY OF DANIA, FLORIDA; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDINANCE SHALL BE IN FORCE AND TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE AND ADOPTION; AND PROVIDING THAT BY UNAN- IMOUS CONSENT OF ALL COMMISSIONERS PRESENT FOR THE INTRODUCTION OF THE ORDINANCE ON FIRST READING, SECOND READING AND THIRD READING AT THE MEETING OF THE CITY COMMISSION HELD ON MARCH 18, 1968. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. - That all ordinances of the City of Dania, Florida, concerning the imposition of an excise or privilege tax upon the sale, re- ceipt, purchase, possession, consumption, handling, distribution and use of cigarettes sold or to be sold at retail within the territorial limits of the City of Dania, Florida., be and the same are hereby amended to j read, after amendment, as follows: i Section 1. Tax imposed; Amount. (1) An excise or privilege tax, in addition to all other taxes of every kind imposed by law, is im- posed upon the sale, receipt, purchase, posses- sion, consumption, handling, distribution and use of cigarettes sold or to be sold at retail within the territorial limits of the City of Dania, Florida, in the following amounts, except as otherwise pro- vided by general law, for cigarettes of standard ! dimensions: i� (a) Upon all cigarettes, as herein de- fined, four inches long or less, five and I s r i I one-half mills on each cigarette. (b) Upon all cigarettes, as herein defined, more than four inches long and not more than six inches long, eleven mills on each cigarette. (c) Upon all cigarettes, as herein defined, 9 more than six inches long, twenty-two mills on each cigarette. (2) The description of cigarettes contained in para- graphs (a), (b) and (c) of subsection (1) are hereby de- clared to be standard as to dimensions for taxing pur- poses as provided in this ordinance and should any i cigarette be received, purchased, possessed, sold, offered for sale, given away or used of a size other than of standard dimensions, the same shall be taxes at the rate of one cent on each such cigarette. (3) Where cigarettes as described in subsection (1) (a) above, are packed in varying quantities of twenty (20) cigarettes or less, the following rate shall govern: (a) Packages containing ten (10) cigarettes or less require a five and one-half cent i (52'0 tax; and (b) Packages containing more than ten (10) but not more than twenty (20) cigarettes require an eleven cent (11�) tax. i � - (4) Where cigarettes, as described in subsection (1) (b) above, are packed in varying quantities of twenty (20) cigarettes or less, the following rates shall govern: ! I (a) Packages containing ten (10) cigarettes or less require an eleven cent (11�) tax; { and (b) Packages containing more than ten (10) but not more than twenty (20) cigarettes re- quire a twenty-two cent (22�) tax. (5) Where cigarettes, as described in subsection (1) (c) above, are packed in varying quantities of twenty (20) cigarettes or less, the following rates shall govern: 1 (a) Packages containing ten (10) cigarettes or less require a twenty-two cent (22�) tax; and (b) Packages containing more than ten (10) t but not more than twenty (20) cigarettes re- quire a forty-four cent (44�) tax. -2 �— t i a Section 2. - That all ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict. i Section 3. - That the effective date of this ordinance shall be i midnight, March 31, 1968. Section 4. - That a certified copy of this resolution shall be furn- ished to the Director, State Beverage Department of Florida, by the city i manager, with a request that State Beverage Department of Florida collect i I the tax imposed herein for City of Dania in accordance with §210. 03, i Florida Statutes, 1967. Section b. - By unanimous consent of all commissioners present, i this ordinance has been introduced, read the first time and read by title i 7 only the second and third time and passed on first reading, second read- ing and third reading at the meeting of the city commission held on March 18, 1968. i PASSED and ADOPTED on First Reading on March 18, 1968. i j PASSED and ADOPTED on Second Reading on March 18, 1968. { '•° PASSED and ADOPTED on Third Reading on March 18, 1968.
