AN ORDINANCE AMENDING ARTICLE IV, CHAPTER 28,
CODE OF ORDINANCES, CITY OF DANIA, FLORIDA, TO
CREATE A NEW DIVISION KNOWN AS "AP-1. AMUSEMENT
PARK DISTRICT"; AND FURTHER AMENDING ARTICLE IV,
CHAPTER 28, CODE OF ORDINANCES, CITY OF DANIA,
FLORIDA, CONCERNING SAID "AP-1. AMUSEMENT PARK
DISTRICT" BY ADDING SECTIONS GOVERNING OR
SPECIFYING PURPOSE OF DISTRICT, USES PERMITTED,
USES PROHIBITED, PLOT SIZE LIMITATIONS, HEIGHT
LIMITATIONS, SETBACK AND PARKING: AND PROVIDING
THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF
SUCH CONFLICT: AND PROVIDING THAT THE ORDINANCE
SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND
ADOPTION, ON THIRD READING.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF DANIA, FLORIDA:
Section 1. That Chapter 28 of the Coda of Ordinances, City of
Dania, Florida, be and the same is hereby amended by adding a division
to Article IV. of said Chapter 28 entitled "Division B. AP-1. Amusement
Park District", with the following sections also being amendments to said
Article IV. Chapter 28, Code of Ordinances, City of Dania, Florida, to be
deemed sections under said Division B.
Section 2. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a

section to be known as "Sec. 28-106. Purpose of District" which shall
read, after the effect of such amendment, as follows:
Sec. 28-106. Purpose of District. The AP-1 Amusement
Park District is intended for amusement parks, including
but not limited to: exhibits, shows, golf course, miniature
golf course, golf driving range, club house, swimming
pool, museums, stadium, amphitheatre, exhibition arena,
boat docking and launching facilities, family entertainment
center, tennis courts, baseball park, rides, gift and
I souvenier shops, eating concessions, and similar facili-
ties and accessory uses.

Section 3. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a
section to be known as "Sec. 28-107. Uses Permitted" which shall read,
after the effect of such amendment, as follows:
Sec. 28-107. Uses Permitted. Buildings, structures
and appurtenances to be used for exhibits, shows,
rides, gift and souvenier shops,and eating concessions.
Section 4. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a
section to be known as "Sec. 28-108. Uses Prohibited" which shall read,
after the effect of such amendment, as follows:
Sec. 28-108. Uses Prohibited. The permissible uses
enumerated in Sac. 28-107 above shall not be con-
strued to include as a principal or accessory use any
of the following, which are expressly listed only for
emphasis and not as a list of the sole prohibited uses:
industrial or manufacturing use; wholesale, ware-
house or storage establishment; junk yards, house
wrecking yards, automobile wrecking yards or used
auto parts establishments; automobile, truck or
trailer establishments, whether for display, storage,
service, repair or sale; building supply and material
establishments, whether for display, storage or sale;
drilling, removal, storage, processing or sale of
oil, asphalt or petroleum products; construction
_• _ ' yards or equipment yards; gasoline service stations;
or drive-in types of food and food service businesses.
Section 5. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a
section to be known as "Sec. 28-109. Plot Size" which shall read, after
the effect of such amendment, as follows:
Sec. 28-109. Plot Size. The minimum plot size
shall be twenty-five (25) contiguous acres.
Section 6. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a
section to be known as "Sec. 28-110. Height Limit" which shall read,

after the effect of such amendment, as follows:
Sec. 28-110. Height Limit. The maximum building
or structure height shall be 150 feet.
Section 7. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a

section to be known as "Sec. 28-111. Set Back" which shall read, after

the effect of such amendment, as follows:
Sec. 28-111. Set Back. No building or structure
except fences and walls shall be permitted within
an AP-1. District closer than 35 feet to any
property not zoned as "AP-1. District"
Section 8. That Article IV, Chapter 28, Code of Ordinances,
City of Dania, Florida, be and the same is hereby amended by adding a
section to be known as "Sec. 28-112. Parking" which shall read, after
the effect of such amendment, as follows:
Sec. 28-112. Parking. Parking areas shall be sur-
faced with either asphaltic or concrete paving.
Section 9. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent of such conflict.
Section 10. That this ordinance shall become effective as of its
1 passage and adoption on third reading.
