ORDINANCE NO. 498
AN ORDINANCE LEVYING A TAX UPON ADMIS-
SION TICKETS SOLD BY ANY PERMANENT OUT-
DOOR RECREATIONAL PARK LICENSEE WHO IS
LICENSED TO OPERATE WITHIN THE CORPORATE
LIMIT'S OF THE CITY OF DANIA, FLORIDA- FIXING
THE AMOUNT OF SAID TAX, AND IMPOSING UPON
SAID LICENSEE THE BURDEN OF ADDING SAID TAX
TO THE COST OF EACH AND EVERY ADMISSION
TICKET SOLD, AND OF COLLECTING SAME; AND
AUTHORIZING THE MAYOR-COMMISSIONER, CITY
MANAGER AND CITY CLERK-AUDITOR OF THE
CITY OF DANIA, FLORIDA, TO ENTER INTO AGREE-
MENTS WITH ANY PERMANENT OUTDOOR RECREA-
TIONA L PARK LICENSEE, CONSISTENT WITH THE
TERMS OF THIS ORDINANCE, CONCERNING THE
LEVYING AND COLLECTION OF SUCH TAXES; AND
PROVIDING THAT ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH BE RE-
PEALED TO THE EXTENT OF SUCH CONFLICT;
AND PROVIDING THAT THE ORDINANCE SHALL BE-
COME EFFECTIVE AS OF ITS PASSAGE AND ADOP-
TION ON THIRD READING.
BE IT ORDAINED BY TIIE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA, AS FOLLOWS:
Section 1. That a tax of 5� upon each and every admission ticket sold by
any licensee who is licensed by the City of Dania, Florida, to operate a perman-
ent outdoor recreational park within the corporate limits of the City of Dania,
Florida, be and the same is hereby levied subject to the following conditions:

(a) Whenever any ticket is sold for said permanent outdoor recrea-
tional park which is good for ten (10) days or more, then a tax of five cents (5�) per
day is hereby assessed against said ticket, and said sum shall be in lieu of all other
special admission taxes specified in this ordinance,

(b) Provided, however, that said city shall be prohibited from
levying said admission tax upon any ticket or pass issued to any official agent or

employee of any permanent outdoor recreational park operating in the said city,
j or to any representative of the Press; neither shall said tax be collected upon any

ticket or pass issued to any person employed in any capacity upon the premises of
any such licensee. The licensee shall have the right to issue free passes or tickets
marked tax paid or tax .free to any person provided said licensee assumes liability
for the payment of the special tax provided herein and pay same.
(c) Any licensee owning and/or operating a permanent outdoor
recreational park in the City of Dania, Florida, is hereby required to levy and
collect the tax upon admissions and admission tickets, provided in this ordinance.
(d) Any licensee of any permanent outdoor recreational park
failing to assess and collect the tax aforesaid shall be liable to the City of Dania
upon each admission sold to the extent of the tax, and upon the aggregate amount
of tickets sold, with exceptions hereinbefore designated, in the aggregate amount
of taxes herein provided, and said licensee shall be required to make a monthly
IN accounting of the number of tickets sold and admissions to said permanent outdoor
recreational park, and shall, on the first of each month pay to the City of Dania,
all taxes so assessed and collected.
(e) The terms and provisions of this ordinance shall not be con-
strued in limitation of but in addition to any and all other taxes and license pro-
visions of the City of Dania imposed upon a licensee who is licensed by the City of
Dania, Florida, to operate a permanent outdoor recreational park.
(f) All the revenue derived from the imposition of this tax upon
admissions of a licensee of any permanent outdoor recreational park shall be placed
in the general revenue fund of the City of Dania, Florida.
Section 2. The Mayor-Commissioner, City Manager and City Clerk-Auditor
be and they are hereby authorized to enter into agreements with any licensee licensed

to operate any permanent outdoor recreational park for the purpose of implementing
jthe terms of this ordinance as to details of handling collections, methods of collec-
tions, location of outdoor recreational parks and as to any other details not incon-
sistent with the terms of this ordinance.

Section 3, In the event any section, sentence, clause or phrase of this

ordinance shall be deemed or adjudged to be invalid or unconstitutional, such adjud-
ication shall in no manner affect the remaining portions hereof, and the same shall
remain in full force and effect as if such section, sentence, clause or phrase had
not originally been a part of this ordinance.
Section 4, All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed to the extent of such conflict.
Section 5, This ordinance shall be in force and take effect immediately
upon its passage and adoption.
