HomeMy WebLinkAboutO-1966-497 i oft i ORDINANCE NO. 497 AN ORDINANCE GOVERNING THE POSTING OF PO- LITICAL SIGNS WITHIN THE CITY LIMITS OF THE CITY OF DANIA, FLORIDA- AND PROVIDING FOR THE ISSUANCE OF A PERMIT BY THE CHIEF OF POLICE TO AUTHORIZE THE POSTING OF SUCH SIGNS; AND PROVIDING THAT AN APPLICANT FOR SUCH PERMIT SHALL GIVE A CASH BOND, CONDI- TIONED TO REMOVE SUCH SIGNS; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BE IN FORCE AND EFFECT IMMEDIATELY UPON I'I'S PASSAGE AND ADOPTION. WHEREAS, candidates for public office have posted various political signs on telephone poles, buildings, store windows and other types of improved real prop- erty located within the city during recent years; and WHEREAS, many of the candidates have not assumed the responsibility for removing such signs, after the elections so that said signs become unsightly, and WHEREAS, while many of the signs violate various provisions of the sign ordinances of the city, the City Commission recognizes that such signs are of a tern- porary nature and that same should be allowed to be posted if adequate provisions are made for the removal of same; and WHEREAS, by this ordinance, the City Commission desires to adopt a pro- cedure for controlfng the posting of such political signs. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. Before a political candidate or his representatives shall be per- mitted to post political signs advertising the candidacy of the candidate to public offfice, the candidate shall first obtain a permit from the Chief of Police, City of Dania, Florida. Said permit shall allow the candidate to post signs of a temporary nature advertising the candidacy of the applicant to political office at locations within the city limits of the City of Dania, Florida, and under such terms and conditions as may i L� 1 be approved by the Chief of Police. The Chief of Police is authorized to adopt and use a rubber stamp showing that a permit has been issued to the applicant and such rubber stamp shall be impressed on every sign allowed by the permit for the purpose of indicating that the sign has been approved. If, because of unusual circumstances, the rubber stamp may not be imprinted on the sign, the Chief of Police may use some other method for stamping or marring the sign to indicate that a permit has been given to allow its posting within the city. Section 2. At the time that an application is made for the permit described in Section 1. herein, the applicant shall enter into a good and sufficient cash bond with the city, the condition of which is that all signs permitted by the permit shall be re- moved by the applicant within ten (10) days after the general election at which the applicant seeks office. Said bond shall be in the principal sum of $35. 00 and shall k, contain language which authorizes the city to use all or any part of the principal of the bond to cover its expenses in removing the signs if the applicant for the permit does not remove said signs within said period of ten (10) days. Section 3. If political signs are posted to advertise a candidacy and if the candidate does not obtain the aforesaid permit, the Chief of Police is hereby authorized • ' and directed to cause said signs to be removed immediately from public display. The Chief of Police shall keep an estimate of his expenses in removing such signs and no permit will later be granted to any applicant unless the applicant first pays the expenses of removing such signs, as estimated by the Chief of Police. Section 4. The Chief of Police shall have no responsibility or liability to any political cMMidate for any damages as the result of signs removed or destroyed under the provisions of Section 3. of this ordinance. Section 5. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 6.
