ORDINANCE NO. 494
AN ORDINANCE DEFINING "ACCEPTANCE DATE" AS SAME
IS USED WITH RESPECT TO THE SANITARY SEWER SYSTEM
OF CITY OF DANIA, FLORIDA; AND PROVIDNG FOR THE
PUBLICATION AND PUBLICIZING OF NOTICE AS TO SUCH
( ACCEPTANCE DATE; AND PROVIDING THAT IT SHALL BE
j UNLAWFUL AFTER NINETY DAYS FROM THE ACCEPTANCE
DATE FOR ANY PERSON, FIRM OR CORPORATION OWNING
PROPERTY OR LEASING PROPERTY CAPABLE OF BEING
CONNECTED TO THE SANITARY SEWER SYSTEM OF THE
CITY OF DANIA TO USE SEPTIC TANKS ON SUCH PROPERTY;
AND PROVIDING THAT THE PENALTY FOR VIOLATIONS OF
' SUCH PROVIBIONTS SHALL BE AS SET FORTH IN SECTION 1-6
CODE OF ORDINANCES, CITY OF DANIA, FLORIDA- AND
PP,OVIDING FOR A PERMIT, TYPES OF PIPE, GENERAL
CONDITIONS, .-)ERSON QUALIFIED TO PERFORM WORK
WITH RESPECT TO THE CONSTRUCTION OF LATERAL LINES
ACROSS PRIVATE PROPERTIES FOR THE CONNECTION OF
PRIVATE PROPERTIES TO THE SANITARY SEWER SYSTEM
OF CITY OF DANIA, FLORIDA; AND PROVIDING THAT THE
PERMIT FOR THE CONSTRUCTION OF LATERAL LINES
SHALL CONTAIN TERMS AND CONDITIONS PROHIBITING
THE USE OF SEPTIC TANKS ON PROPERTIES SERVED BY
THE LATERAL LINES.
WHEREAS, during recent years and because of population growth, state and
county health authorities have demanded from time to time that City of Dania initiate
sanitary sewer programs which would serve to alleviate, and cause the discontinuance
of, the use of septic tanks; and
IWHEREAS, because of population growth and based on advices from sanitary
engineers, State Board of Health and Broward County Health Department, the City of
Dania determined as a matter of policy in recent years that the use of septic tanks
should be discontinued wheresoever possible; and
WHEREAS, as a result of its studies, the City Commission passed enabling or-
dinances in 1965 which ordered the construction .;i sanitary sewers within the more
populated areas of City of Dania; and
WHEREAS, said sanitary sewer program is near completion; and

WHEREAS, as a result, it is now necessary that the City Commission pass and
adopt enabling legislation providing for the discontinuance of septic tanks in areas
served by said sanitary sewers and further providing for a procedure whereby properties
served by said sanitary sewers may be connected to said sanitary sewer system,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE

I CITTY OF DANIA, FLORIDA:

Section 1. That with respect to the sanitary sewer system now under construc-
tion in the major parts of City of Dania, Florida, the "acceptance date" be and.the same

is hereby defined as the date on which the consulting engineers employed by City of
Dania, Florida, with respect to the project advise the City of Dania that such system
has been constructed in accordance with various contracts for construction and that
such system is in operation.
Section 2. That when the acceptance date is known the City Manager shall im-
mediately thereafter publicize the acceptance date by placing an advertisement in The
Dania Press, Dania, Florida, advising the public generally of the acceptance date. Said
advertisement shall be published weekly for three consecutive weeks. In addition, the
City Manager shall mail a notice showing such acceptance date to all persons and firms
customarily receiving water bills from the City of Dania, Florida.
Section 3. That after ninety (90) days from the acceptance date, it shall be un-
lawful for any person, firm or corporation owning property or leasing property capable

of being connected to the sanitary sewer system of the City of Dania to use septic tanks
on such property for the purpose of disposing of sewerage and wastes. If a parcel of
property is capable of being connected to the sanitary sewer system, the disposal from
every type of plumbing fixture located within improvements on the parcel shall drain
into the sanitary sewer system and no separate drain fields or septic tanks shall be

allowed. The penalty for any violation of this section shall be as set forth in Section
1-6, Code of Ordinances, City of Dania, Florida.
Section 4. Any property owner desiring that his property be served by said k

sanitary sewer system, where the property is capable of being served by such system,
may cause sewer or plumbing lines to be connected from the house, building or other
improvement on said property to the sanitary sewer system by obtaining a permit from
the City of Dania, Florida. The cost of the permit shall be $5. 00 and shall include
one (1) inspection. If the said connection is not approved at the first inspection of

City of Dania, the City of Dania may charge $5. 00 for each additional inspection re-
quired.

j Section 5. Any persons obtaining such permit may install a lateral line across

his property from the house, building or other improvement being served to the near-
est sanitary sewer line adjacent to the property being served. The lateral lines shall
be either cast iron pipe or vitrified clay pipe. The installation of said cast iron pipe
or vitrified clay pipe shall conform with the minimum requirements of the South
Florida Building Code, copies of which are on file at the City Hall, Dania, Florida,
and are available for examination by the public.
Section 6. The said connections of lateral lines across private properties to
the sanitary sewer system shall be done by plumbing contractors, general contractors
or engineering contractors who are licensed in the City of Dania, Florida; provided,
however, that an individual property owner may connect his property to said sanitary
Auk! + sewer system, without employing any of the said classes of contractors, on condition
I that he furnish a copy of his deed or other title evidence to the City Building Inspector
showing that he has a record interest in the property on which said lateral line is being
constructed.
Section 7. The permit allowing such connections shall specifically provide that
all septic tanks on properties connected to the sanitary sewer system shall be drained,
shall have a hole punched in the bottom and shall be filled with sand after the aforesaid
lateral lines are connected to the aforesaid sanitary sewer system and the Building In-
spector of the City of Dania shall have the right to withhold the approval of the connec-
tion until the requirements with respect to the discontinuance of septic tanks have been

Section 8. That all ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed to the extent of such conflict.
Section 9. That this ordinance shall be in force and effect immediately upon its

final passage and adoption.
