AN ORDINANCE PROVIDING FOR AAFF'EE OF $6. 00 FOR COSTS IN EACH CASE IN THE MUNICIPAL COURT, CITY OF DANIA, FLORIDA; AND PROVID- ING THAT $2. 00 OF THE AMOUNT OF COSTS ASSESSED IN ALL CASES BEFORE THE MUNICIPAL COURT SHALL BE UTILIZED TO COMPENSATE OFF DUTY POLICE OFFICERS FOR TIME EXPENDED IN TESTIFYING IN CASES BEFORE THE MUNICIPAL COURT; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION, ON THIRD READING. WHEREAS, the City Commission has been advised that police officers are frequently required to testify in prosecutions before the Muni- cipal Court during their off duty hours, and WHEREAS, the City Commission has determined that it is in the best interests of the City that off duty police officers required to testify in prosecutions before the Municipal Court be compensated for the time ex- pended in so testifying, NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMIS- SION OF THE CITY OF DANIA, FLORIDA: i Section 1. In all cases before the Municipal Court, there shall be assessed a flat fee of Six Dollars ($6. 00) for costs in such cases. Any individual, except authorized police officers or the head of any City Department instituting suit in the Municipal Court shall pay the aforesaid cost in advance. Section 2. In the event that on final disposition of any case the Court assesses the costs against the defendant and the same is paid, it i j shall be the duty of the Clerk of the Court to return the costs to the indivi- dual who has heretofore paid in advance the costs in such action. Section 3. Two Dollars ($2. 00) of costs assessed as herein 'd r Is' t (( E a:d } J g4, 1 provided shall be utilized by the City for the purpose of compensating off duty police officers who are called upon and who testify in cases appearing I before the Municipal Court. If a police officer makes one appearance but testifies in more than one case during such appearance, he shall not be I entitled to additional compensation beyond said Two Dollars ($2. 00) per appearance. Section 4. That all ordinances, or parts of ordinances, in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 5. This ordinance shall become effective as of its passage and adoption on Third Reading. PASSED and ADOPTED on First Reading this 1:5 day of September, A. D. 1965.
