AN ORDINANCE STATING AND SETTING FORTH
THE QUALIFICATIONS REQUIRED OF ALL
PERSONS, INCLUDING DEPARTMENT HEADS,
EMPLOYED BY CITY OF DANIA, FLORIDA; AND
PROVIDING THAT ALL EMPLOYEES OF CITY
OF DANIA, FLORIDA, INCLUDING DEPARTMENT
HEADS, SHALL FILE A ,SET OF FINGERPRINTS
AND A PHOTOGRAPH WITH THE CITY COM-
MISSION; AND PROVIDING THAT THE ORDINANCE
SHALL NOT APPLY TO MEMBERS OF THE CITY
COMMISSION AND TO CANDIDATES FOR THE
OFFICE OF CITY COMMISSION, BUT FURTHER
PROVIDING THAT CITY COMMISSIONERS AND
CANDIDATES MAY VOLUNTARILY SUBMIT
THEIR FINGERPRINTS AND HAVE ANY FACTS
SHOWN AS THE RESULT OF SUCII SUBMISSION
DISCLOSED AT A REGULAR MEETING OF THE
CITY COMMISSION, WITH THE PROVISIONS
GOVERNING CITY COMMISSIONERS AND CANDI-
DATES TO BE OPTIONAL RATHER THAN
MANDATORY; AND PROVIDING THAT ALL ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH BE REPEALED TO THE EXTENT OF
SAID CONFLICT AND THAT THIS ORDINANCE
SHALL BECOME EFFECTIVE UPON ITS PASSAGE
AND ADOPTION, ON THIRD READING.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF'
DANIA, FLORIDA:
Section 1. That only persons of good moral character, who are
not less than twenty-one (21) years of age, shall be employed by City of
Dania.
Section 2. No person shall be employed by the City of Dania,
Florida, who has been convicted within the last past five (5) years of any
offense against the beverage laws of State of Florida the United States or,
any other state or who has been convicted within the last past five (5) years
in the State of Florida or any other state in the United States or the United
States of any offense involving prostitution, gambling, keeping a disorderly

place or illegally dealing in narcotics; or who has been convicted in the last

past fifteen (15) years of any felony in the State of Florida; or who has been 1
convicted in any other state or the United States of any offense designated as
a felony by such state or the United States. The term "conviction" shall
include an adjudication of guilt on a plea of guilty or nolo contendere or the
forfeiture of a bond when charged with a crime.
Section 3. Prior to any applicant being approved for employment
by City of Dania, Florida, the applicant shall file a set of fingerprints on

regular United States Department of Justice forms for himself and shall also
file a photograph of such size and type as may be required by the City Com-
mission.
Section 4. Within ninety (90) days after the effective date of this
ordinance, all present employees of the City of Dania, Florida, shall submit
fingerprints and photographs, as aforesaid, when requested to do so by the
City Commission, in writing, and, thereafter, all present employees of City
of Dania, Florida, shall be governed by the provisions of this ordinance. As
used herein, the reference to "employee" shall include department heads.
Section 5. The provisions of this ordinance shall not apply to
members of the City Commission and to candidates for the office of City
Commissioner. However, any City Commissioner and any candidates to the
office of City Commissioner may voluntarily submit his fingerprints, as
aforesaid, and may direct the Chief of Police, in writing, to file with the
City Commission at a regular City Commission meeting any facts disclosed

by such fingerprints as to the background or past record of the particular
Commissioner or candidate. The provisions of this section are optional and
shall not be mandatory.
Section 6. All ordinances or parts of ordinances in conflict here-
with be and the same are hereby repealed to the extent of such conflict.
I Section 7. This ordinance shall become effective as of its passage

and adoption on third reading.
