ORDINANCE NO. 472

AN ORDINANCE AUTHORIZING THE MAYOR-COMIViIS-
SIONER, CITY MANAGER AND CITY CLERK-AUDI'TOR
TO EXECUTE ON BEHALF OF THE CITY OF DANIA
A CERTAIN LEASE AGREEMENT BETWEEN THE CITY
j OF DANIA AS LESSOR AND MARINE LIFE OF FLORIDA,
INC., AS LESSEE CONCERNING CERTAIN PROPERTY AT
DANIA BEACH, DANIA, FLORIDA, AND PROVIDING THAT
ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWI'TH BE REPEALED TO THE EXTENT OF
SUCH CONFLICT: AND PROVIDING THAT THIS ORDI-
NANCE SHALL BECOME EFFECTIVE UPON I'TS PAS-
SAGE AND ADOPTION, ON THIRD READING.
WHEREAS, City of Dania, Florida, has the right under its charter
to lease parts of the public beach area to lessees in order to permit a lessee
to construct buildings or improvements, for a period of time not exceeding
twenty (20) years; and
WHEREAS, Marine Life of Florida, Inc. , has negotiated with
City of Dania for leasing of a certain area at Dania Beach under the terms

of a proposed lease agreement, a copy of which is attached hereto; and
WHEREAS, the City Commission deems it for the best interest of

the City of Dania to enter into a lease with Marine Life of Florida, Inc. , a
Florida corporation, under the terms hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMIS-
SION OF THE CITY OF DANIA, FLORIDA:
Section 1. That the Mayor-Commissioner, City Manager and City
Clerk-Auditor of City of Dania, Florida, be and they are hereby authorized
and directed to execute a lease agreement on behalf of City of Dania, as

Lessor, and William G. Rhodes, as Lessee, in accordance with the terms
and conditions of the certain lease agreement, a copy of which is attached
i
hereto and made a part hereof.

Section 2. All ordinances or parts of ordinances in conflict here-
with be and the same are hereby repealed to the extent of such conflict.

i Section 3. This ordinance shall be in force and take effect imme-
diately upon its passage and adoption,
PASSED AND ADOPTED on First Reading this 21st day of
September, 1964.
PASSED AND ADOPTED ON Second Reading this 5th day of
October, 1964.
PASSED AND ADOPTED on Third Reading this 19th day of
October, 1964.
