ORDINANCE NO. 459
AN ORDINANCE AMENDING SECTION 27-13(b), CODE
j OF ORDINANCES, CITY OF DANIA, FLORIDA, CON-
CERNING THE PENALTY FOR TURNING ON AND
SHUTTING OFF WATER SUPPLY BY A CONSUMER TO
PROVIDE THAT THE PENALTY FOR THE FIRST
OFFENSE SHALL BE $50. 00 INSTEAD OF $5. 00; AND
PROVIDING THAT ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH BE REPEALED
TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING
THAT TIM ORDINANCE SHALL BECOME EFFECTIVE
AS OF ITS PASSAGE AND ADOPTION, ON THIRD READ-
ING.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA:
Section 1. That Section 27-13(b), Code of Ordinances of Dania,
Florida, be and the same is hereby amended to read, after amendment, as

follows:
"(b) Penalty. A violation of this chapter upon the
part of the owner, his employees or agents, shall
subject the owner or consumer to a penalty of fifty
dollars for the first offense and upon the second offense
the water department may at its option discontinue the
,,. service anddiut off the water supply to the premises so
long as the owner or consumer continues to reside at
the premises, "
Section 2. All ordinances or parts of ordinances in conflict here-
with be and the same are hereby repealed to the extent of such conflict
Section 3. This ordinance shall be in force and take effect imme-
diately upon its passage and adoption.

AN ORDINANCE AMENDING SECTION 27-12, CODE
OF ORDINANCES, CITY OF DANIA, FLORIDA, CON-
CERNING DELINQUENT WATER ACCOUNTS BY ADD-
ING AN UNNUMBERED PARAGRAPH TO PROVIDE
THAT ACCOUNTS DELINQUENT FOR A PERIOD OF
ONE MONTH SHALL BE CHARGED A PENALTY WITH
THE AMOUNT OF THE PENALTY TO BE TEN PER
CENT, (10%), OF THE AMOUNT OF THE DELINQUENCY
FOR EACH MONTH, OR PART OF A MONTH THEREOF,
THAT THE ACCOUNT IS DELINQUENT FOR A PERIOD
OF MORE THAN ONE MONTH; AND PROVIDING THAT
ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITH BE REPEALED TO THE EXTENT
OF SUCH CONFLICT; AND PROVIDING THAT THIS
ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS
PASSAGE AND ADOPTION, ON THIRD READING.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA:
Section 1. That Section 27-12, Code of Ordinances, City of Dania,

Florida, be and the same is hereby amended by adding to the existing Section
27-12 of such Code an unnumbered paragraph which shall read as follows:
All bills and accounts for water service shall
be subject to a penalty if delinquent for a period of
one month after the initial rendition of a bill or state-
went by City of Dania for water service rendered
during a previous period. The amount of the penalty I
shall be ten per cent, (10%), of the amount of the
delinquent account for each month, or part of a
month thereof, that the account is delinquent with
the account first becoming delinquent, for the pur-
poses of this paragraph, one month after the first
rendition of a bill or statement.
Section 2. All ordinances or parts of ordinances in conflict here-
with be and the same are hereby repealed to the extent of such conflict.
Section 3. This ordinance shall be in force and take effect imme-
diately upon its passage and adoption.
