HomeMy WebLinkAboutO-1961-438 „ T 1, a ORDINANCE NO. 438 AN ORDINANCE PROVIDING FOR THE INSTALLATION OF PARKING METERS AT DANIA BEACH, CITY OF DANIA FLORIDA; AND PROVIDING FOR A SYSTEM OF RATES AND FOR A PROCEDURE OF ADOPTING RATES IN CON- NECTION WITH THE OPERATION OF SAID PARKING METERS; AND PROVIDING FOR A SYSTEM OF ISSUANCE i OF TRAFFIC TICKETS FOR PERSONS PARKING AUTO- MOBILES IN PARKING SPACES CONTROLLED BY THE AFORESAID PARKING METERS WHEN SAID PERSONS DO NOT PAY THE PRESCRIBED RATE THEREFOR; AND PROVIDING FOR FINES TO BE IMPOSED UPON SAID PERSONS NOT PAYING SAID PRESCRIBED RATES; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF i ORDINANCES IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING i THAT THIS ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION, ON TIHRD READING. i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF TIIE CITY OF DANIA, FLORIDA: i I � Section 1. That the installation of parking meters at the public i parking spaces at Dania Beach, Dania, Broward County, Florida, be and the same is hereby authorized, with said meters to be installed at all public parking spaces at Dania Beach, Dania, Florida, with the exception of I certain spaces or areas which may be selected by the City Commission, City of Dania, Florida, as free parking spaces. Section 2. That immediately prior to the installation of said parking meters, the City Manager and the Chief of Police shall prescribe a proposed i t rate schedule concerning the charges to be collected by City of Danis., Dania, Florida, for the use of said parking spaces, and that said rate schedule shall become effective at such time as same is adopted by proper Jresolution of the City Commission of the City of Dania, Florida; that any subsequent modifications or changes in said rate schedule shall be made by proper resolution of City Commission of City of Dania, Florida. That the City Manager of City of Dania, Florida, be and he is hereby authorized to have a quantity of traffic tickets printed in substantially the form which is attached hereto as Exhibit "All, with the form of said ticket to contain a envelope to be used in the manner j hereinafter described, and said ticket be and the same is hereby authorized I i as a proper notice to be given by the Police Department of City of Dania, i Florida, to persons parking automobiles at said ,parking spaces controlled i jby parking meters in cases where automobiles are parked without payment of the prescribed rate or where automobiles are parked overtime. Service of said ticket may be made by leaving same in or on the automobile parked i without payment of the prescribed rate schedule. Further, the City Manager is directed to install a proper box or receptacle at Dania Beach, Dania, Florida, for the collection of the fine hereinafter described. Section 4. In the event an automobile is parked at a public space at Dania Beach, Florida, where the space is controlled by a parking meter i and in the event a traffic ticket is given by the Police Department because i of non payment of the rate charged by City of Dania, the owner of the auto- mobile or any representative of the owner of the automobile in violation shall pay a fine of Twenty five cents ($. 25), provided that payment of such fine is made within twenty four (24) hours after the time shown on the traffic ticket, and further provided that such payment is made by depositing said ifine in the envelope attached to the traffic ticket into the receptacle installed for such purposes. Section 5. In the event a person receives a traffic ticket as afore- said, for parking an automobile at a space controlled by a parking meter P g at Dania Beach without paying the prescribed rate therefor, and in the further event said person does not pay the fine of twentyfive cents ($. 25) within -2- I - I 4. • � lr !Y l 1 twenty four (24) hours as above prescribed, then in such events, the Person shall be deemed guilty of a violation of this ordinance and may be fined in the Municipal Court, Dania, Florida, in an amount not to exceed Fifteen dollars, ($15. 00). Section 6, All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 7. This ordinance shall be in force and take effect im- mediately upon its passage and adoption, i PASSED AND ADOPTED on First Reading this day of i 1961.
