HomeMy WebLinkAboutO-1960-417 J, ORDINANCE NO. ! ! 7 AN ORDINANCE AMENDING SECTION 3-8, CODE OF ORDINANCES, CITY OF DANIA, FLORIDA, CON- CERNING PROHIBITIVE SIGNS IN THE CITY OF DANIA, FLORIDA, AND PROVIDING FOR AND ENACTING A NEW SECTION TO BE KNOWN AS SECTION 3-8, LIMI- TATIONS ON CERTAIN TYPES OF SIGNS WITHIN THE CITY LIMITS OF THE CITY OF DANIA, FLORIDA; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT THE ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION ON THIRD READING, j BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA, AS FOLLOWS: j Section 1. That Section 3-8, Code of Ordinances, City of Dania, Florida, be, and the same is hereby repealed in its entirety. i Section 2. That a new section to be known as Section 3-8, Limita- tions on Certain Types of Signs in the City of Dania, Florida, be and the same is hereby enacted and adopted, which said section shall read as follows: This section applies to and specifies signs on which certain limitations are imposed i by the City Commission of the City of Dania, Florida, 1 (a) Banner signs of any type or material maybe erected only by permission of the City Commission. i i (b) Billboards, directional signs, and ground signs, i as defined in Section 28-1, except those erected and displayed by public authority, ,. 6 jshall not be erected, constructed or displayed within one hundred fift�(60 feet I of the center line of U. S. Highway No. 1, also known as Federal Highway, to the extent that such highway lies within the city limits of the City of Dania, Florida, and billboards, directional signs, and ground signs, except those erected and 1 displayed by public authority, shall not be erected, constructed or displayed j within one hundred fifty (150) feet of the center line of State Highway A-l-A, also known as Dania Beach Boulevard, to the extent that such highway or boulevard lies within the city limits of the City of Dania, Florida, (c) Ground signs, as used in this chapter, shall mean j i any sign board erected, constructed or maintained for the purpose of displaying i - 1 � I rw outdoor advertising, as posters, pictures, pictorial or readin matters, when ( g such sign is supported by uprights or braces placed upon the ground and not attached to any part of any building, i (d) Objectional signs. No sign shall be erected or maintained in the city that creates a traffic or fire hazard, or is dangerous to the general public. i I (e) Obscenity. No sign shall display any statement, word, character, or illustration of any obscene, indecent or immoral nature. (f) Repair permits. All signs must be kept in good 1 condition, neat appearance, and good state of repair; and any sign at least fifty (50) percent destroyed must be immediately removed and a new permit secured before the sign is replaced or repaired. All such repaired or replaced signs must conform to this chapter. (g) Painted signs on streets, sidewalks or other public I property are not allowed other than those placed there by public authority for the convenience and safety of the public. (h) Snipe signs of any material including paper, card- board, wood or metal, shall not be tacked, nailed or fastened in any manner to trees, posts or other objects on public property where such signs does not apply to premises whereon it is located f (i) The City Commission may, upon proper application i being made, grant a variance permit or exceptional permit to permit the j construction of any type of sign prohibited by this ordinance, provided that such f a � variance permit or exceptional permit is granted under the terms and conditions i provided for in the ordinance of the City of Dania, Florida, concerning variance permits and/or exceptional permits. All ordinances or parts of ordinances in conflict here- I with be, and the same are hereby repealed to the extent of such conflict. I Section 7.
