I ORDINANCE N0, AN ORDINANCE STATING THE TERMS, CONDITIONS AND RESTRICTIONS CONCERNING THE REQUIRE_- MENTS TO BE FULFILLED BY APPLICANTS FOR PERMITS TO MOVE BUILDINGS TO NEW LOCATIONS WITHIN THE CITY LIMITS OF THE CITY OF DANIA, FLORIDA; AND PROVIDING THAT NO PERMIT SHALL BE ISSUED ALLOWING THE MOVING OF A BUILDING TO A NEW LOCATION WITHIN TIIE CITY LIMITS OF THE CITY OF DANIA, FLORIDA, UNTIL SUCH TIME I AS THE APPLICANT FURNISHES A WRITTEN STATE- MENT FROM ALL PROPERTY OWNERS WITHIN THREE I HUNDRED (300) FEET OF THE PROPOSED LOCATION WHEREIN SUCH OWNERS STATE THAT THEY HAVE NO I OBJECTIONS TO THE GRANTING OF THE PERMIT; AND PROVIDING AN ALTERNATIVE PROCEDURE WHEREBY A PUBLIC HEARING MAY BE HELD AFTER i NOTICE TO ALL PROPERTY OWNERS WITHIN THREE HUNDRED (300) FEET, GRANTING SUCH PROPERTY OWNERS THE RIGHT TO APPEAR AT SUCH HEARING 1 TO VOICE THEIR OBJECTIONS TO THE GRANTING OF THE PERMIT; AND PROVIDING THAT AT THE TIME APPLICATION IS MADE FOR SUCH PERMIT, TIIE APPLICANT SHALL FILE A STATEMENT FROM A GENERAL CONTRACTOR LICENSED UNDER THE ORDI- NANCES OF TIE CITY OF DANIA, FLORIDA, STATING THE ESTIMATED COST, IF ANY, TO REMODEL OR IMPROVE SUCH BUILDING SO THAT SAME WILL COMPLY WITH ALL BUILDING ORDINANCES OF THE CITY OF DANIA, FLORIDA; AND PROVIDING THAT BEFORE ANY j PERMIT IS GRANTED, THE APPLICANT SHALL FURNISH A GOOD AND SUFFICIENT FE RFORMANCE BOND IN AN AMOUNT EQUAL TO THE ESTIMATED COST OF REMODEL- ING OR IMPROVING SUCH BUILDING TO COMPLY WITH ALL BUILDING ORDINANCES OF THE CITY OF DANIA, FLORIDA, PLUS AN ADDITIONAL AMOUNT OF TEN PERCENT (1076), SAID BOND TO BE CONDITIONED ON THE COMPLI- ANCE BY THE APPLICANT WITH ALL BUILDING ORDINANCES OF THE CITY OF DANIA, FLORIDA, WITHIN SIX (6) MONTHS AFTER THE DATE OF THE GRANTING OF THE PERMIT;AND FURTHER PROVIDING THAT NO PERSON OR PERSONS SHALL OCCUPY THE BUILDING DESCRIBED BY THE PERMIT, IF GRANTED, UNTIL SUCH TIME AS THE I BUILDING COMPLIES WITH THE BUILDING ORDINANCES OF THE CITY OF DANIA, FLORIDA; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT 3 HEREWITH BE REPEALED TO THE EXTENT OF SUCH CON- FLICT; AND PROVIDING THAT THE ORDINANCE SHALL t BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION ON THIRD READING. i I BE IT ORDANIED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA, AS FOLLOWS: Section 1. That no person, firm, corporation or other entity shall move a building of any type to a new location within the city limits of I i � the City of Dania, Florida, without first obtaining from the Building Inspector � I i I 1 i of the City of Dania, Florida, a permit approving the mobing of such building I ito a new location. Section 2, That no permit shall be granted until the applicant furnishes a written statement from all property owners within three hundred (300) feet of the proposed location for such building, wherein such owners state j I that they have no objections to the granting of the permit. In the event the applicant is unable to furnish a written statement from such owners, wherein 'i they state they have no objections to the granting of the permit, the applicant may request that a public hearing be held before the City Commission of the City of Dania, Florida, in which event the applicant shall pay a reasonable deposit designed to cover all expenses incurred by the City of Dania, Florida, 1 i in giving notice of such hearing. Notice by publication shall be given of the date of said hearing with at least one publication being required and with the 1 date of the publication being seven (7) days or more prior to the hearing date. On or before the publication date for such notice, the City Clerk - Auditor shall mail by certified mail a copy of the notice of hearing to all known property of the proposed site i+C'u/, j owners within three hundred (300) feet of the building being moved and such A notice shall provide that said property owners, as well as any other parties in interest, may appear at the hearing and voice their objections to the granting of the permit. I i Section 3. At the time of the filing of the application for a permit to move a building to a new location within the city limits of the City of Dania, i Florida, the applicant shall file a statement from a general contractor licensed i under the ordinances of the City of Dania, Florida, stating the estimated cost, i if any, to remodel or improve the building being moved so that same will comply j with all building ordinances of the City of Dania, Florida. Section 4. Further, before a permit is granted to move a building to a new location within the city limits of the City of Dania, Florida, the applicant j shall furnish a good and sufficient performance bond in an amount equal to the i estimated cost of remodeling or improving such building to comply with all j f , f j - 2 - I t' f,. building ordinances of the City of Dania, Florida, plus an additional amount 1 7] of ten percent (1017o), said bond to be conditioned on the compliance by the i applicant with all building ordinances of the City of Dania, Florida, within six (6) months after the date of the granting of the permit. Section 5. No person or persons shall occupy the building described by the permit, if granted, until such time as the building complies 1 i with the building ordinances of the City of Dania, Florida, and no certificate of occupancy shall be issued concerning such building until same complies with the building ordinances of the City of Dania, Florida. Section 6. All ordinances or parts of ordinances in conflict here- j� with be, and the same are hereby repealed to the extent of such conflict, I Section 7.
