ORDINANCE NO.

AN ORDINANCE AMENDING SECTION 17-26,
CODE OF ORDINANCES, CITY OF DANIA,
FLORIDA, CONCERNING THE ISSUANCE OF
INTOXICATING BEVERAGE LICENSES TO PER-
SONS WITHIN CERTAIN LOCATIONS IN PROXI-
MITY TO SCHOOLS AND CHURCHES BY DELETING
THEREFROM THE PHRASE, "MEASURED BY
FOLLOWING THE SHORTEST DISTANCE BY
I PEDESTRIAN TRAVEL, AND SUBSTITUTING
THEREFOR THE PHRASE, "BY SHORTEST
STRAIGHT LINE;" AND RECITING THE EXACT
WORDING OF SAID ORDINANCE, AFTER SAID
AMENDMENT; AND PROVIDING THAT ALL
ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH BE REPEALED TO THE
EXTENT OF SUCH CONFLICT; AND PROVIDING
THAT THE ORDINANCE SHALL BECOME EFFECT-
IVE AS OF ITS PASSAGE AND ADOPTION ON THIRD
READING.

j BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA, AS FOLLOWS:
-..� Section 1. That Section 17-26, Code of Ordinances, City of
Dania, Florida, be and the same is hereby amended by deleting therefrom the

phrase, "measured by following the shortest distance by pedestrian trave;, "
and substituting therefor the phrase, "measured by shortest straight line, "

j Section 2, That Section 17-26, Code of Ordinances, City of
Dania, Florida, after the aforesaid amendment provided for in Section 1, herein
shall read as follows: "No license shall be issued under the provisions of this
Ichapter to any person at any location within three hundred feet (3001) from any
established church or school, measured by shortest straight line from main
entrance to main entrance, except that in case of a school, to the nearest point
of the school grounds used as part of the school facilities. Whenever a license
has been lawfully procurred and thereafter a church or school be established

j within a distance otherwise prohibited by law, the establishment of such church
r
or school shall not be cause for revocation of the license or prevent the sub-
sequent renewal of same.

Section 3. All ordinances or parts of ordinances in conflict here-
with be, and the same are hereby repealed to the extent of such conflict,

Section 4. This ordinance shall become effective as of its passage !�
and adoption on third reading.
