HomeMy WebLinkAboutO-1960-407 ORDINANCE NO. 1 n AN ORDINANCE ADOPTING BY REFERENCE ORDINANCE NO. 1578 OF THE CITY OF HOLLYWOOD, FLORIDA, THE TITLE OF WHICH READS ORDINANCE NO. 1578 CONSn- TUTING THE "BUILDING CODE" OF THE CITY OF HOLLY- WOOD AND PROVIDING FOR ALL MATTERS WHICH AFFECT OR RELATE TO THE CONSTRUCTION, ERECTION, ALTERA- TION, REPAIRING, REMOVAL, DEMOLITION, OCCUPANCY AND USE OF ANY AND ALL STRUCTURES ERECTED OR TO BE ERECTED IN THE CITY OF HOLLYWOOD, AND INCOR- PORATING HEREIN BY REFERENCE THE SOUTH FLORIDA BUILDING CODE, THE ELECTRICAL CODE OF THE CITY OF HOLLYWOOD, AND THE PLUMBING AND GAS CODE OF THE CITY OF HOLLYWOOD, WITH CERTAIN EXCEPTIONS AND ADDITIONS THERETO, SAID ORDINANCE BEING ADOPTED ON SECOND READING BY THE CITY COMMISSION OF THE CITY OF HOLLYWOOD, FLORIDA, ON JUNE 4, 1957, AND ADOPTING BY REFERENCE ORDINANCE NO. 1579 OF THE CITY OF HOLLYWOOD, FLORIDA, THE TITLE OF WHICH READS AN ORDINANCE AMENDING ORDINANCE NO 1578 BEING THE BUILDING CODE OF THE CITY OF HOLLYWOOD BY MODIFYING PROVISIONS CONTAINED THEREIN RELATING TO LICENSES ISSUED TO OWNER-BUILDERS AND DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE AND DISPENSING WITH THE READING OF THIS ORDINANCE AT TWO SEPARATE MEETINGS BY A FOUR-FIFTHS VOTE OF THE CITY COMMISSION, SAID ORDINANCE BEING ADOPTED ON SECOND READING BY THE CITY COMMISSION OF THE CITY OF HOLLYWOOD, FLORIDA, ON JUNE 4, 1957, AND PROVIDING THAT WHEREVER THE WORDS "CITY OF HOLLY- WOOD" ARE USED THEY SHALL BE HELD TO MEAN THE CITY OF DANIA, FLORIDA, AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT THE ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION ON THIRD READING BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA, AS FOLLOWS: Section 1. Subject to the changes or modifications set forth in Sections 2 and 3 herein, it is hereby adopted by the City for the purpose of providing for all matters which affect or relate to the construction, erection, alteration, repairing, removal, demolition, occupancy and use of any and all structures erected or to be erected in the City of Dania, those certain ordinances of the City of Hollywood, Florida, identified as City of Hollywood Ordinance No. 1578 and City of Hollywood Ordinance No. 1579. Section 2. The following sections or parts of City of Hollywood Ordinance No. 1578, as adopted by the City of Dania, Florida, are hereby J , aft modified or amended to read as follows: I. 1 Section 9, Article 1, City of Hollywood Ordinance No. 1578, as adopted by the City of Dania, shall read as follows:- Section 90 Sub-paragraph (a), Article (1). There is hereby created a Contractor's Qualifying Board, which shall be appointed by the legislative authority, consisting of six (6) members, one who shall be an architect, if available, one a professional engineer and the remainder of whom shall be general contractors, all licensed to do business in their respective fields and residents of the general area; and, in addition thereto, alternates shall be appointed for each of;the above members in the same field of endeavors, which alternates shall not vote on the Board unless the regular member is not present. (2) Board members shall be appointed for a term of three years, except the term of the first created Board may be for lesser periods so that the expiration of the members' terms shall be staggered. (3) Vacancies occurring in the membership of the Board shall be filled by appointment of a member from the same branch of the contracting business as was the branch of the member whose terms has terminated, for any reason whatsoever. (4) Each member shall hold office until his successor has been duly appointed and qualified. (5) Board members shall be paid the sum of $20. 00 for attendance at each regular meeting of the Board, the amount limited to each member to no more than twelve regular meetings per year. In the event the Board is required to hold a special meeting for the purpose of giving a special examination, one-half of the special examination fee shall be paid to the Board members attending the special examination. (6) The Board shall elect its officers for the ensuing year..in the month of September of each year. (7) The legislating authority may remove any member of the Board for misconduct, incompetency or neglect of duty, provided that any member so removed may request, within 10 days, and shall receive a public review by the legislating authority before such removal shall become final. Section 2. Any and all references to "City of Hollywood" and "City of Hollywood Ordinances No. 1578 and No. 1579" shall be deemed to refer to City of Dania. Section 3. Those parts of South Florida Building Code, said South Florida Build- ing Code being a part of Ordinance No. 1578 of City of Hollywood, Florida, by I reference contained in said Ordinances, as adopted by the City of Dania, Florida, are hereby amended as follows: I Section 302. 2, Sub-Paragraph (f), shall read as follows: Application for permit for new construction and additions shall be accompanied by a registered land surveyor's certificate, plot plan with square footage on which shall be clearly indicated: The pro- perty-corner stakes, property-line dimensions, existing structures and their location, existing right-of-way, sidewalks, easements, street zoning and property zoning of records, critical elevations and building setbacks required by law, general block plan and other pertinent survey data which may be required. The Building Official may waive the re(Tiirements for such survey when property-line stakes are existing and known to be in place, and the work involved is minor and/or is clearly within building lines. Section 303. 2 , Sub-paragraph (a), shall read as follows: Estimated Costs: For the purpose of determining the permit fee, the estimated cost of the building will be computed by the Building Official in the following manner: Living areas----- ------------------- 9. 00 Square Ft. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 5.
