ORDINANCE NO
AN ORDINANCE REGULATING THE SPEED OF BOATS IN
CANALS AND WATERWAYS WITHIN THE CITY OF DANIA,
FLORIDA, AND PROVIDING A PENALTY FOR PERSONS
FOUND GUILTY OF VIOLATIONS THEREOF; AND PROVID-
ING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF
SUCH CONFLICT; AND PROVIDING THAT THIS ORDINANCE
SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND
ADOPTION ON THIRD READING.
WHEREAS, the City Commission of the City of Dania, Florida, has
determined that substantial damage is being done to docks, wharves and
seawalls as the result of boats being operated at an excessive speed in canals
and waterways within the City of Dania, Florida; and
WHEREAS, the City Commission of the City of Dania, Florida, finds
that it is necessary to enact an ordinance governing the speed at which boats
may be operated in canals and waterways within the City of Dania, Florida;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF DANIA, FLORIDA:
Section 1. No boat or vessel shall be operated upon any canals and
waterways in the City of Dania at a rate of speed which causes waves to dam-
age docks, wharves, seawalls or boats moored or tied to docks or wharves
along such canals and waterways.
Section 2. Any person or persons violating the provision of any
section of this ordinance shall upon conviction be punished by a fine not ex-
ceeding $100.00 or imprisonment not exceeding 10 days, or by both such
fine or imprisonment.
Section 3. All ordinances or parts of ordinances in conflict herewith
be, and the same are hereby repealed to the extent of such conflict.
Section 4. This ordinance shall become effective as of its passage
and adoption on third reading.
