AN ORDINAICE AMENDING ALL R-APARTMENT ZONING ORDINANCES
] AND R-3 ZONING ORDINANCES, INSOFAR. AS DENSITY OF MAXI-
MUM NUMBER OF LIVING UNITS PERMITTED PER ACRE, TO PROVIDE
THE CREATION OF THREE SUBCLASSIFICATIONS WITHIN EACH .
CATEGORY AND TO PROVIDE LIMITATIONS, RESPECTIVELY, AS
TO EACH OF SAID CATEGORIES AT 21 UNITS PER ACRE, 17
UNITS PER ACRE AND 12 UNITS PER ACRE; AND PROVIDING
i THAT, BY UNANIMOUS CONSENT OF ALL COMMISSIONERS PRESENT,
i THE ORDINANCE HAS BEER INTRO➢UCED, READ THE FIRST TIME,
READ BY TITLE ONLY THE SECOND AND THIRD TIMES, AND PASSED
ON ALL THREE READINGS AT THE CITY COMMISSION MEETING OF
THE CITY OF DANIA, FLORIDA, HELD ON MARCH 19, 1973; AND
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCFS IN CON-
FLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has previously adopted zoning ordinances creating
a R-Apartment classification and an R-3 (multiple family) classification; and
WHEREAS, one of the matters controlled by each of such classifications is i

the matter of density (or the number of independent family living units per acre) ; and
) WHEREAS, as to each of said zoning classifications, the City Commission is of �
i
the opinion that subclassifications should be created to provide various density limit-
ations as to each of said subclassifications, !

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA,
j FLORIDA:
Section 1. As to all ordinances of the City of Dania providing for, or other-
. j wise creating, a R-Apartment zoning classification, the said ordinances are hereby

I amended to provide, after the effect of the amendment, that there should be three sub-
classifications within the general R-Apartment classification with the subclassifications
to be known and designated as follows and with .the maximum number of living units per
acre premitted in each subclassification being as indicated, to wit:

R-Apartment-A 17 units per acre
R-Apartment-B 12 units per acre '
Section 2. As to all ordinances of the City of Dania providing for, or other-
wise creating, a R-3 (multiple family) zoning classification, the said ordinances are
hereby amended to provide, after the effect of the amendment, that there should be three :
subclassifications within the R-3 (multiple family) clasuificatio❑ with the ntibclassi.fi-
cations to be known and designated as follows and with the maximum number of living units
per acre permitted in each subclassification being as indicated, to wit:

:j Section 3. That all other conditions and restrictions regarding building,
3 zoning and related matters, as specified in the existing R-Apartment ordinances and
the existing R-3 ordinances, shall be in full force and effect, respectively, as to
1 each of the above subclassifications,

Section 4, That by unanimous consent of all commissioners present, this
ordinance has been introduced, read the first time, read by title only the second and -
. third times and passed on three readings at the meeting of the City of Dania, Florida,
F held on March 19, 1973,

Section 5, That all ordinances or parts s of ordinances in conflict herewith •
jIare hereby repealed to the extent of such conflict.
Section 6. That this ordinance shall become effective as of its passage and
adoption,

On March 19, 1973, the City Commission adopted the captioned
i ordinance and we read same into their record at the time of the
j meeting.
{ As to most of the zoning ordinances adopted since the 1971
Code of Ordinances of City of Dania, we have tried to follow certain
recommendations of Municipal Code Corporation to the Affect that
each zoning ordinance might be "codified" or compiled into Chapter
32. In effect, this requires a certain renumbering in order to try
to keep the entire chapter up-to-date.

As to the above ordinance, we held off on submitting the
final copy because we had understood that substantial revisions would
j be made as to other zoning ordinances and we were trying to follow
through on the "codification" process at the same time.
i
By the end of the summer, we realized that there would be
delays regarding the other ordinances. Therefore, we hand delivered
the captioned ordinance to Mr. Hampton on September 4, 1973.
You have indicated that you do not have the ordinance in your
file book. Accordingly, I enclose a copy of our letter dated September
4, 1973, and a copy of the ordinance in question.

I respectfully suggest that you may want to double check with
Mr. Hampton as I assume that he has overlooked giving the earlier
letter to you.
The ordinance should be placed in your book and should be
assigned a number.

Dear Woody:
On March 19, 1973, the Commission adopted on three read-
ings the ordinance creating the sub-classifications as to R-Apartment
and R-3 classifications regarding density.

We had a draft of the ordinance ready at the time of its
adoption. We had a further feeling that the Commission was enter-
taining a wholesale revision of the two classifications and,
g the ordinance for filing in the
therefore, hold off in submittin
ordinance book until we saw what other changes might be made.
The matter of further revisions seems to have died down.
Therefore, I am enclosing the original form of the ordinance in
the exact form which same was adopted on March 19, 1973.
Please ask the City Clerk to assign a number and then to
file same in the ordinance book.
