WHEREAS, a hearing was held before the Planning and Zoning
a ! i Board of: City of. Dania, Florida, on January 8, 1974, regarding the

conducted a further public hearing on the matter on January 21, 1574 ,

1971 Code of Ordinances, City of Dania, Florida, the Planning and
Zoning Board further recommended to the City Commission that it give

a permanent type of permit to Mobil Oil Company, its successors or
assigns, which will allow the construction, building, altering, re-
modeling, repair, relocating, reconstruction and rebuilding of various
types of gasoline service station improvements on said property with-
out the need of obtainingfurther
permission from City of Dania to
establish the right to use the property as a site for a gasoline

service station; and
i
WHEREAS, the City Commission of City of Dania, by the adoption
i
of this ordinance, also desires to accept such recommendation of
the Planning and Zoning Board regarding the said permit,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
{ CITY OF DANIiA, FLORIDA:

Section 1. That the zoning classification of the following
described lands situate, lying and being in Dania, Broward County,
Florida, to wit,
Portions of Lots 1, 2, 3, „ 5, 6, and 7, and all
of Lot 8, Bloc); 23, Town of Modelo, as recorded in
Plat Bock B, page 49, of the Public Records of Dade
f County, Florida, in Section 34, Township 50 South,
Range 42 East, and being all more fully described
I as follows:
Beginning at the Southeast corner of said I,ot 8,
thence S 871 29' 00" l0 along the South lines of
Lots 8 and 7, a distance of 186 feet to a point on
the East right-of-way line of U. S. Highway No. 1;
thence N 2° 20' 00" W along the said East right-of-
way ling a distance of 155. 16 feet to a point of
curve; thence Northeasterly along a curve to the
right, with a radius of 25 feet and a central angle
of 89' 49 ' 1017 , an arc distance of 39. 19 feet to a
poil't of tangency and a point cal tha So..ith right-
of-way line of Dania Beach Boulevard (State Road AlA) ;
thence Easterly along the said South right-of-way
line the following three (3) courses and distances;
N 870 29' 10" E, a. distance of 99. 27 feet; thence
N 2° 30' 50" W a distance of 0. 78 feet; thence N
87` 29' 10" E a distance of 0 .80 feet to the point
of termination of the said three (3) courses and
distances; thence S 2° 20' 00" E, 'a distance of 110. 85
feet; thence N 870 29 ' 00" E a distance of 61 feet to

be and the same is hereby changed from existing zoning classification
to C-1 (commercial) zoning classification under the application ordi-
nances of City of Dania, Florida, so that, from the standpoint of
zoning classification, the property may be used as the site for the
operation of a gasoline service station.
Section 2, By the adoption of this ordinance, the City
Commission recognizes that full compliance has been had with the
requirements of Section 32-13 (b) , Code of Ordinances, City of Dania,
1 Florida, .'regarding'the granting of a permit, or permission, for the
construction of a gasoline service station on the above described

property. Therefore, by the adoption of this ordinance, a permanent
permit is hereby given to Mobil Oil Compa.riy (the present owners of
the property described in Soction 1. herein) , their successors or

a assigns, which authorizes the construction, building, altering, re-
modeling, repairing, relocation, reconstruction and rebuilding of
each and ever type of

storage tanks, compressors, signs, hoists, lifts, gasoline service

gasoline and oil storage shed., and all related

types of facilities and improvements reasonably required to operate
a gasoline service station on the above described. property.
Section 3. The granting of the permit which is referred to in
Section 2. herein is for the primary purpose of recognizing the me •e
right itself to nse the aforesaid property as a site: for the operation
i
of a gasoline service station. In such connection, Mobil Oil Company,
i
jits successors or assigns, shall not be obligated to apply to City
j of Dania for future permits whose purpose is that of merely recognizing
i
the right to use the property as a site for a gasoline service station,
I
Notwithstanding the granting of such permit and the recognition of.

such right, Mobil Oil Company, its successors and assigns, shall a
always be obligated to comply with the requirements of any building
i
code which j may be in effect from time to t2me and shall always be_
obligated to comply with all types of set-back requirements, minimum
area requirements, safety requirements and other like conditions.
Further, at any time that application is made for a permit to allow
construction of improvements, Mobil Oil Company, its successors or
i
assigns, shall pay whatever permit fees are charged at the time by
City of Dania under any applicable building ordinance of the city.
Section 4 . That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed to the extent of
such conflict:.
Section 5. That this ordinance shall be in force and take

7 effect immediately upon its passage and adoption.
