ORDINANCE NO..5
AN ORDINANCE AMENDING CHAPTER 5, CODE OF OR-
DINANCES, CITY OF DANIA, FLORIDA, BY ADDING
A SECTION KNOWN AS SECTION 5-9, MAKING IT UN-
LAWFUL TO SWIM OR BATHE OUTSIDE CERTAIN AREAS
AT DANIA BEACH; BY ADDING A SECTION KNOWN AS
SECTION 5-10, MAKING IT UNLAWFUL TO OPERATE
A BOAT IN CERTAIN AREAS AT DANIA BEACH; BY ADD-
ING A SECTION KNOWN AS SECTION 5-11, MAKING IT
UNLAWFUL TO PICNIC UPON THE PUBLIC BEACHES
AT DANIA BEACH; BY ADDING A SECTION KNOWN AS
SECTION 5-12, MAKING IT UNLAWFUL TO FISH ON THE
PUBLIC BEACHES AT DANIA BEACH; AND BY ADDING
A SECTION TO BE KNOWN AS SECTION 5-13, GIVING
CERTAIN POLICE POWERS TO .LIFEGUARDS ON DUTY
AT DANIA BEACH.
WHEREAS, the City Commission of the City of Dania, Florida,
has considered certain practices now existing upon the public beaches
at Dania Beach, in Dania, Broward County, Florida; and
WHEREAS, it is the opinion of the City Commission that said

practices constitute nuisances and are detrimental to the welfare and safety
of the public enjoying the facilities at Dania Beach, Dania, Broward County,
Florida; and
WHEREAS, the City Commission of the City of Dania, Florida,
deems it for the best interests of the public to amend the existing Code of
Ordinances of the City of Dania, Florida, by adding sections which prohibit

the aforesaid practices;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM-
MISSION OF THE CITY OF DANIA, FLORIDA:
Section 1. That Chapter 5 of the Code of Ordinances of the City of
Dania, Florida, is amended by adding a section to be known as Section 5-9,
to read as follows:
"Sec. 5-9. Swimming or bathing outside certain areas
"It shall be unlawful to swim outside of the area extend-
ing 50yards eastward from the high tide water mark of
the Atlantic Ocean at the public beach, and beyond control
and supervision of the lifeguard, unless express permis-
sion has been obtained from the supervising lifeguard to I
do so. Any person requested by the lifeguard to come in
j must do so and failure to do so shall constitute an offense. It

Section 2. That Chapter 5 of the Code of Ordinances of the City
of Dania, Florida, is amended by adding a section to be known as Section
i
5-10, to read as follows:
"Sec. 5-10. Operating boat in certain areas:

"It shall be unlawful to operate or pilot a boat
inside the 50 yard area distance off shore or
elsewhere along the public beach, in such a
manner as to create a hazard to the bathers. "

Section 3. That Chapter 5 of the Code of Ordinances of the City
of Dania, Florida, is amended by adding a section to be known as
Section 5-11, to read as follows:
"Sec. 5-11. Picnicking on the public beach:
"It shall be unlawful to picnic or eat or to consume
food upon the public beach, except in designated
areas developed for that purpose. "
Section 4. That Chapter 5 of the Code of Ordinances of the City
of Dania, Florida, is amended by adding a section to be known as
Section 5-12, to read as follows:
"Sec. 5-12. Fishing on public beaches:
I "It shall be unlawful to fish or surf cast from any
part of the public beach between the hours of
9:00 A.M. and 6:00 P.M. on any day. "
Section 5. That Chapter 5 of the Code of Ordinances of the City
of Dania, Florida, is amended by adding a section to be known as
j Section 5-13, to read as follows:
"Sec. 5-13. Authority of lifeguards to arrest:
".Lifeguards are hereby given authority to arrest
any person committing an offense or doing an
unlawful act upon the public beaches of the City
of Dania, or adjacent areas, and for that purpose
are given full police authority. .Lifeguards shall
have this authority only while on duty between the
hours of 9:00 A.M. and 6:00 P. M. "
Section 6. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent of such conflict.

Section 7. This ordinance shall be in force and take effect
immediately upon its passage and adoption.
