HomeMy WebLinkAboutO-1956-349 ORDINANCE NO. ` 9 AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA RELATING TO INTOXICATING BEVERAGES, BY ADDING A NEW SECTION TO BE NUMBERED SEC- TION 45 TO PROVIDE THAT IT SHALL BE UNLAW- FUL FOR ANY HOSTESS, WAITRESS, FEMALE ENTERTAINER OR FEMALE EMPLOYEE IN A PLACE DISPENSING ALCOHOLIC BEVERAGES FOR CON- SUMPTION ON THE PREMISES TO BE SERVED ANY BEVERAG ;, WHETHER AN ALCOHOLIC BEVERAGE OR OTHERWISE, FOR WHICH THE CUSTOMER OR PATRON IN SUCH ESTABLISHMENT PAYS; AND BY ADDING A NEW SECTION TO BE NUMBERED 46 TO PROVIDE THAT IT SHALL BE UNLAWFUL FOR AN OWNER, OPERATOR OR MANAGER OF A BAR TO EMPLOY ANY FEMALE EMPLOYEE FOR THE PURPOSE OF SOLICITING DRINKS FOR HERSELF OR ANY OTHER EMPLOYEE OF THE ESTABLISH- MENT; AND BY ADDING A NEW SECTION TO BE j NUMBERED 47 TO PROVIDE THAT IT SHALL BE UNLAWFUL FOR ANY WOMAN TO FREQUENT OR �- LOITER IN ANY TAVERN, CABARET OR NIGHT CLUB FOR THE PURPOSE OF SOLICITING MEN TO PUR- CHASE DRINKS; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING THAT THE PROVISIONS OF THIS SECTION OF THE CODE SHALL NOT REPEAL ANY OTHER PROVISIONS OF THIS CODE UNLESS THE SAME BE IN DIRECT CONFLICT WITH THE PROVISIONS HEREOF. i j WHEREAS, certain establishments in the City of Dania which i dispense alcoholic beverages on the premises employ or permit on the I premises female persons for the purpose of encouraging patrons to drink { and soliciting alcoholic drinks from the patrons; and WHEREAS, the Commission of the City of Dania finds that such a practice is detrimental to the health, safety and welfare of the • City of Dania and its inhabitants and should be corrected; i I NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1: That Chapter 17 of the Code of Ordinances of the 1 City of Dania, Florida, relating to intoxicating beverages be and is hereby I 8 I -1- i f J S 1 amended by adding a new section to be numbered Section 45 to read as I follows: "Section 45. It shall be unlawful for any hostess i waitress, female entertainer or female employee in a place dispensing alcoholic beverages for con- sumption on the premises to be served any beverage, whether au aL,.)'iolic beverage or otherwise, for which the customer or patron in such establishment i pays. Section 2. That Chapter 17 of the Code of Ordinances of the City of Dania, Florida, relating to intoxicating beverages be and is here- by amended by adding a new section to be numbered Section 46 to read as follows: "Section 46. It shall be unlawful for an owner, operator or manager of a place dispensing alcoholic beverages for consumption on the premises to employ or permit on the premises any person to solicit drinks for himself or herself or any other person. " Section 3. That Chapter 17 of the Code of Ordinances of the City of Dania, Florida, relating to intoxicating beverages, be and is here- by amended by adding a new section to be numbered Section 47 to read as „u follows: "Section 47. It shall be unlawful for any woman to frequent or loiter in any tavern, cabaret or night club for the purpose of soliciting men to purchase drinks. " Section 4. That if any clause, sentence, paragraph, section or other part of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invali- date the remainder hereof, but shall be confined in its operation and effect to that specific part of this ordinance which was directly involved in the controversey in which such judgment was rendered. -2- I i l I 1 Section 5. That the provisions of this section of the Code shall be cumulative with similar existing provisions and shall not repeal any other provision of this code unless the same be in direct conflict with I the provisions hereof. i j Section 6. All ordinances parts of ordinances or resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 7• This ordinance shall be in force and take effect immediately upon its passage and adoption. i PASSED AND ADOPTED on First reading this S z�t day of July, A. D. 1955.
