AN ORDINANCE PROVIDING FOR THE EX-
CHANGE OF CERTAIN PROPERTIES SO AS
TO PROVIDE STREET RIGHT OF WAYS IN
THE PLAT OF GEO. M. PHIPPEN'S RE-
SUBDIVISION, AS SHOWN IN PLAT BOOK 35,
AT PAGE 4, OF THE PUBLIC RECORDS OF
'BROWARD COUNTY, FLORIDA; AND DE-
CLARING THIS ORDINANCE TO BE AN
EMERGENCY MEASURE.
WHEREAS, the street right of ways as shown on the plat of
Geo. M. Phippen's Subdivision, according to the plat thereof recorded in
Plat Book 2, at page 90, of the public records of Broward County, Florida,
do not conform to the patterns of existing streets in the City of Dania,
thereby causing traffic congestion and hardships to the owners of lands in

said subdivision and to the citizens of Dania as a whole, on account of
having to detour around and about said subdivision; and,
WHEREAS, it would be beneficial to the City of Dania and to
;. all citizens if said subdivision be replatted so as to conform to the growth
and traffic patterns of said City; and,
WHEREAS, the owners of lands in said subdivision are willing
to relocate their lots and lands in said subdivision so as to allow proper and
efficient street right of ways; and,
WHEREAS, the City of Dania will neither gain or lose land on
• account of said relocation, but will benefit to the extent that usable streets
are provided and dedicated for the use and enjoyment of the public; and,
WHEREAS, the official charter of the City of Dania fails to
provide a procedure in order to accomplish the hereinabove described ex-
change and relocation; and, I

WHEREAS, a plat showing the foregoing relocation and ex-
change has been admitted to record, same being entitled Geo M. Phippen's
Re-Subdivision and recorded in Plat Book 35, at page 4, of the public re-
cords of Broward County, Florida; and,
WHEREAS, it is vital and necessary that said plat and re-
location entailed therein be further confirmed so that mortgage companies
may be assured as concerns the title of the owners of lands in said new
subdivision, said need being of an emergency nature;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM-
MISSION OF THE CITY OF DANIA, FLORIDA:
Section 1: That the action of this Commission on theE /
day of 1954) in accepting and approving for record
the amended plat of Geo. M. Phippen's Re-Subdivision according to the plat
thereof recorded in Plat Book 35, at page 4, of the public records of Broward
County, Florida, be and the same is hereby confirmed.
Section 2: That all the right, title, interest, and claim of the
City of Dania in and to the following named lots, which are as shown on the
plat of Geo. M. Phippen's Re-Subdivision, according to the plat thereof re-
corded in Plat Book 35, at page 4, of the public records of Broward County,
Florida, be and the same are hereby assigned, transferred, and conveyed
to the persons named opposite said lots:

Section 3: That the Mayor/Commissioner, City Manager,
and City Clerk, be and they are hereby authorized and directed to execute
and deliver quitclaim deeds to the lots to the persons named, as described
in Section 2 above.
Section 4: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent of such con-
flict.
Section 5: This ordinance shall be in force and take effect.
immediately upon its passage and adoption.
Section 6: By unanimous consent of all the commissioners
present, this ordinance has been introduced and read for the first time,
and read for the second and third time; and passed on all three readings at
this meeting of the City Commission of the City of Dania, Florida; and has
been passed by a unanimous vote of all the commissioners present at this
meeting.
