AN ORDINANCE PROVIDING FOR THE
SUPRESSION AND/OR PROHIBITION OF
VAGRANCY IN THE CITY OF DANIA,
FLORIDA.

t BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF DANIA, FLORIDA:
Section 1: Rogues and vagabonds; idle or dissolute persons
who go about begging; common gamblers; persons who use juggling or un-
lawful games or plays; common pipers and fiddlers; common drunkards;

common night walkers; thieves and pilferers; traders in stolen property;
lewd, wanton and lascivious person in speech and behavior; keepers of
gambling places; brawlers; persons who neglect their calling or employ-
ment, and mis-spend what they earn and do not provide for themselves or
for the support of their families; persons wandering from place to place,
who are able to work and who are without means, and who neglect to earn

their support and live by pilfering and begging; idle and disorderly per-
sons, including therein those who neglect all lawful business and habitually

i spend their time by frequenting houses of ill fame g i gamblin houses or

tippling shops; persons who are able to work but who are habitually idle
and live upon the earnings of their wives or minor children; and all able bodied
male persons over eighteen years of age who are without means of support,
j and whose parents or guardians are unable to support them, and who are
not usually in attendance upon some school or educational institution, but
who live in habitual idleness are declared to be vagrants, and shall be pun-
ished as hereinafter provided in this ordinance.
j Section 2: Any vagrant shall, upon conviction, be punished
by a fine not to exceed Five Hundred Dollars ($500. 00) or by imprisonment

f in the discretion of the Municipal Judge.
Section 3: Upon proper information made upon oath before
an officer authorized to act in such cases he shall issue his warrant for the
arrest of any person therein named or described who is charged therein
with being a vagrant under the provisions of Section 1 aforesaid, and such
warrant shall be executed by any police officer duly authorized thereto by
the officer issuing such warrant. Any police officer may arrest any vagrant
described in Section 1 aforesaid without a warrant in case delay in procur-
ing one would probably enable such alleged vagrant to escape arrest. Any
person so arrested by virtue of a warrant or without a warrant shall be
given a speedy trial, and upon conviction shall be fined as provided in Sec-

lion 2 aforesaid.
Section 4: All ordinances or parts of ordinances in conflict

herewith be and the same are hereby repealed to the extent of such conflict.
Section 5: This ordinance is hereby declared to be an emer-
gency measure on the ground of urger_t public need for the preservation of
peace, safety and property of the City of Dania, Florida.

Section 6: The reading of this ordinance on three separate
days is hereby dispensed with by unanimous vote of all Commissioners pre-
sent.
