HomeMy WebLinkAboutO-1953-314 i ORDINANCE NO . 3/� AN ORDINANCE REGULATING THE ESTABLISH- MENT OF NEW OR ADDITIONAL GASOLINE AND OIL SERVICE STATIONS IN THE CITY OF DANIA, FLORIDA: PROVIDING A PENALTY FOR THE VIOLATION HEREOF: PROVIDING A SAVING CLAUSE: AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1: That it shall be unlawful for any person to install, establish, erect, or operate any gasoline and oil service station, other than those already in operation or approved for operation as of the date of this ordinance, within the corporate limits of the City of Dania, Florida, unless and until said person shall have first fully met the following require- ments and conditions: (a) A distance of One Thousand Two Hundred Fifty (1, 250) feet shall intervene between the nearest gasoline pump of any proposed gasoline and oil service station and the nearest gasoline pump of any existing and/or previously approved gasoline and oil service station, and said distance shall be measured along the shortest route of regular motor vehicle travel. (b) Said person shall apply to the Planning and Zoning Board of the City of Dania, Florida, for permission to erect, establish, install, and/ or operate any proposed gasoline and oil service station, and in making their decision, said Board shall consider the factors of layout, architectural treatment, location, public safety, public welfare, and esthetic values. Said person shall furnish said Board with blueprints of the said proposed station and give all such information as the said Board shall deem necessary in making their decision. After consideration, said Board shall then make i their recommendations to the City Commission, who shall then either ap- prove or deny said application. I f f { r 7 -1- 7 i y J Section 2: Gasoline and oil service stations be and the same are hereby defined as a structure or place where gasoline, oil, and greases are supplied and dispensed to the motor vehicle trade, but no mechanical service performed. Section 3: The word "person" as used herein shall be construed + to extend and apply to associations, firms, partnerships, and bodies politic and corporate, as well as to individuals. Section 4: It shall be the duty of the City Manager and the Police Department of the City of Dania, Florida, to strictly enforce all the pro- visions of this ordinance. Section 5: Any person who violates the provisions of this ordi- nance, or assists in any violation of this ordinance, shall, for each and every violation, upon conviction be punished by a fine not exceeding $500. 00, or by imprisonment not exceeding 60 days, or by both fine and imprtsonment, in the discretion of the Municipal Judge. Section 6: In the event any section, sentence, clause, or phrase of this ordinance shall be declared or adjudged to be invalid or unconstitu- tional, such adjudication shall in no manner affect the remaining portion hereof which shall remain in full force and effect as if such invalid or un- constitutional section, sentence, clause, or phrase had not originally been a part of this ordinance. Section 7: All ordinances or parts of ordinances, or resolutions or parts of resolutions, in conflict herewith be and the same are hereby re- pealed to the extent of such conflict. Section 8: This ordinance shall be in force and take effect im- mediately upon its passage and adoption.
