HomeMy WebLinkAboutO-1953-311 I I I ORDINANCE NO . AN ORDINANCE VACATING AND ABANDONING A ONE FOOT STRIP LYING ALONG THE EAST RIGHT-OF-WAY LINE OF POINSETTIA STREET (NOW N.E. SECOND AVENUE) IN POINCIANA PARK, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 7, PAGE 17, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. WHEREAS, the City Commission of the City of Dania, Florida, has determined that the following described strip of land is not necessary i for public facility and use, and further that said strip of land has not been generally used by the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM- MISSION OF THE CITY OF DANIA, FLORIDA: Section 1: That the following described strip of land lying along the East right-of-way line of Poinsettia Street (now N. E. Second Avenue) in POINCIANA PARK, be and the same hereby is vacated and abandoned. Said strip of land is described as follows, to-wit: A parcel of land in POINCIANA PARK, according to the plat thereof recorded in Plat Book 5, page 17, of the public records of Broward County, Florida, bounded as follows: On the East by the Easterly right-of-way line of Poinsettia Street (N. E. Second Avenue), as shown on POINCIANA PARK, according to the plat thereof recorded in Plat Book 5, page 17, of the public records of Broward County, Florida; on the West by a line one (1) foot West of, and parallel to the East right-of-way line of said Poinsettia Street (N. E. Second Avenue); on the North by the projection of the North property line Eastward of Lot 5, Block 3, of said POINCIANA PARK; on the South by the projec- tion of the South property line Eastward of Lot 17, Block 2, of said POINCIANA PARK. Section 2: The City Commission of the City of Dania, Florida, deems that said strip of land is not necessary for public convenience or use of inhabitants and citizens of the City of Dania, and that said parcel has not I been used generally by the public. j -1- 1 L� II J i i i Section 3: The City Commission of the City of Dania, Florida, deems that the public convenience and welfare is best served by the aban- donment and vacation of said strip of land as provided herein, and the Mayor, City Manager and City Clerk are hereby authorized and directed to execute and deliver deeds conveying said strip of land to the property owners lying west of said parcel upon an equitable basis. Section 4: All ordinances or parts of ordinances in conflict herewith be aid the same are hereby repealed to the extent of such conflict. Section 5: This ordinance shall take effect immediately upon its passage and adoption. PASSED AND ADOPTED on First reading this day of e�'wDti�e+J A. D. 1953.
