AN ORDINANCE PROHIBITING NEW OR ADDI-
TIONAL GASOLINE SERVICE STATIONS IN THE
CITY OF DANIA, FLORIDA; PROVIDING A
PENALTY FOR THE VIOLATION HEREOF; PRO-
VIDING A SAVINGS CLAUSE: AND REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH.
WHEREAS, the City Commission has had occasion to observe
the influx of gasoline service stations into the City of Dania, and the
detrimental effect that same has had upon the value of property, the City
tax assessment roll, the progress and future improvements of said City,
the physical appearance of the City of Dania, and the general welfare of
the citizens of the City of Dania, and,
WHEREAS, the said City now has I_ gasoline service
stations in operation or approved for operation, although said City has
only a population of about 540O and,
WHEREAS, the main street of the said City, to-wit, U. S.
Highway No. 1, is now called "gasoline alley" in derision by the citizens
of said City; and,
WHEREAS, the said Commission has determined that said City
has a super-abundance of gasoline service stations with which to serve its
citizens and visitors, and that, after careful consideration, the addition of
any new or additional gasoline service stations within the said City would
be positively detrimental to the public health, safety, morals, and wel-
fare of the citizens of the City of Dania, Florida;
j NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM-
MISSION OF THE CITY OF DANIA, FLORIDA:

Section 1: That it shall be unlawful for any person to install,

erect or operate any gasoline service station, other than those already in

operation or approved for operation, East of the Florida East Coast Rail-
road, within the corporate limits of the City of Dania, Florida.
Section 2: The word "person" as used herein shall be con-
strued to extend and apply to associations, firms, partnerships, and
bodies politic and corporate, as well as to individuals.
Section 3: It shall be the duty of the City Manager and the
Police Department of the City of Dania, Florida, to strictly enforce all
the provisions of this ordinance.
Section 4: Any person who violates the provisions of this
ordinance, or assists in any violation of this ordinance, shall, for each
and every violation, upon conviction be punished by a fine not exceeding
$500. 00, or by imprisonment not exceeding 60 days, or by both fine and
imprisonment, in the discretion of the Municipal Judge.
Section 5: In the event any section, sentence, clause, or
phrase of this ordinance shall be declared or adjudged to be invalid or
unconstitutional, such adjudication shall in no manner affect the remaining
portion hereof which shall remain in full force and effect as if such invalid
jy or unconstitutional section, sentence, clause, or phrase had not originally
been a part of this ordinance.
Section 6: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent of such conflict.
Section 7: This ordinance shall be in force and take effect
immediately upon its passage and adoption.
