AN ORDINANCE REQUIRING ENCLOSURES AROUND EX-
ISTING SWIMMING POOLS WITHIN SIXTY (60) DAYS
FROM THE EFFECTIVE DATE OF THIS ORDINANCE, AND
REQUIRING THAT ALL PLANS FOR NEW CONSTRUCTION
OF SWIMMING POOLS PROVIDE FOR ENCLOSURES; AND
MAKING IT AN OFFENSE TO VIOLATE THE PROVISIONS
j OF THE ORDINANCE; AND PROVIDING FOR A PENALTY;
it AND PROVIDING THAT ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH ARE HEREBY
REPEALED TO THE EXTENT OF SUCH CONFLICT; AND
PROVIDING THAT THIS ORDINANCE SHALL BECOME
EFFECTIVE AS OF ITS PASSAGE AND ADOPTION.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF DANIA, FLORIDA:
Section 1.- The record owner of every site within the
city limits of City of Dania, Florida, on which there is con-
structed a swimming pool shall be responsible, within sixty

(60) days from the effective date of this ordinance, for con-
structing an enclosure around such swimming pool so that per-
sons desiring to use the swimming pool facility may not gain
JJ access to the swimming pool without going through such en-
closure. The enclosure may be either a fence, screen or wall
or, where the swimming pool is an inside swimming pool con-
structed as an integral part of some building unit, the walls

of the building unit may constitute a part of the enclosure.
j All gates or other means of entrance through the enclosure
, .` shall contain locks and all such gates shall be maintained in
a locked condition when the swimming pool is not in use.
Section 2.- The building inspector of City of Dania,
Florida,shall not issue any permit for the construction of
a swimming pool unless the plans make provisions for an enclo-
sure of the type described in Section 1. it
Section 3 .- Any violation of the provisions of Section 1.

4 shall be deemed an offense and shall be punishable under the pro- '

visions of Section 1-8, Code of Ordinances, City of Dania,

Florida.
Section 4.- That all ordinances or parts of ordinances �
' in conflict herewith be and the same are hereby repealed to the
extent of such conflict. f

Section 5.- That this ordinance shall be in force and take

effect immediately upon its passage and adoption.

June, 1973.
PASSED and ADOPTED on Second Reading on the 18th day of
June, 1973.
PASSED and ADOPTED on Third Reading on the 18th day of
June, 1973.
