ORDINANCE NO. io R
AN ORDINANCE PROHIBITING FORTUNE TELLING
AND ALLIED BUSINESSES IN THE CITY OF DANIA,
FLORIDA; PROVIDING A PENALTY FOR THE VIO-
LATION HEREOF; PROVIDING A SAVINGS CLAUSE;
AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH.,I I
WHEREAS, the City Commission has had occasion to ob-
serve the conduct of the business of fortune telling and allied

businesses in the City of Dania, Florida, and, the Police Chief
I
has submitted a report to said Commission concernin6 said busi-
nesses, said report being that the operation of said businesses
i
has always resulted in a wave of thefts and complaints in the
City of Dania; and
WHEREAS, the City of Dania, Florida, is located in a
i
tourist area wherein large numbers of visitors travel the high-
ways and visit the City of Dania, said visitors being unusually
i
susceptible to businesses of this nature; and
WHEREAS, many serious complaints have been received by
i
I the City Commission concerning the operation of said businesses,
i
both by visitors and permanent residents; and
WHEREAS, the City Commission of the City of Dania has -
determined, after careful consideration, that the operation of
s
the business of fortune telling and allied businesses is posi-
tively detrimental to the public health, morals, safety, and wel-
fare of the citizens of the City of Dania, Florida;

NOW, THEREFORE;, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF DANIA, FLORIDA:

Section 1: That it shall be unlawful for any person
jto engage in the business of "fortune telling", "palmistry",
a
"astrology", "card reading", "phrenology" , or any other business

wherein and whereby a person professes to tell future and/or past
j events by means of any ruse, device, manner, or means whatsoever., I

S� Section 2: The word "person" as used herein shall be
construed to extend and apply to associations, firms, partnerships,
a
and bodies politic and corporate, as well as to individuals.
j Section 3: It shall be the duty of the City Manager and
the Police Department of the City of Dania, Florida, to strictly
enforce all the provisions of this ordinance.
Section Any person who violates the provisions of
{ this ordinance, or assists in any violation of this ordinance,
i
shall, for each and every violation, upon conviction be punished
by a fine not exceeding 0500.00, or by imprisonment not exceeding
60 days, or by both fine and imprisonment, in the discretion of
the Municipal Judge.
Section In the event any section, sentence, clause,

or phrase of this ordinance shall be declared or adjudged to be
invalid or unconstitutional, such adjudication shall in no manner
{ affect the remaining portion hereof which shall remain in full
i
force and effect as if such invalid or unconstitutional section,
sentence, clause, or phrase had not originally been a part of
i

this ordinance.
Section 6: All ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed to the extent
of such conflict.

Section 7: This ordinance shall be in force and take
effect immediately upon its passage and adoption.
