OR MISL.iADING ADVERTISING; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE; PROVIDING A SAVINGS CLAUSE; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. I BE IT ORDAINED BY THE CITY COIiMISSION OF THE CITY OF i DANIA, FLORIDA: Section 1: It is hereby declared to be unlawful to j i make, publish, disseminate, circulate or place before the pub- lie, or to cause, directly or indirectly, to be made, published, disseminated, circulated or placed before the public, in the City of Dania, in a newspaper or other publication, or in the jform of a book, notice, handbill, poster, bill, circular, pamphlet or letter, or in any other way, an advertisement of any sort re- garding merchandise, securities, service or other thing offered ! to the public for sale or distribution and containing any i assertion, representation or statement of fact w_iich is untrue, i deceptive or misleading, with intent to sell or in any way dis- pose of such merchandise, securities, service or other thing, or ° with intent to increase the consumption thereof, or to induce I the public in any manner to enter into any obligation relating j thereto or to acquire title thereto or an interest therein. Section 2: It shall be unlawful to advertise, or j I otherwise represent to the public, in any manner whatsoever., the i prices, rates or fees to be demanded or charged for any merchan- dise, facilitieB, services or accomodations offered to the public, which prices, rates or fees are so represented or stated as to be incomplete, untrue, deceptive or misleading. i Section 3: It shall be unlawful to advertise or otherwise represent to the public, in any manner whatsoever, i j the brand, quality, quantity, trade name or other character of any goods, wares or merchandise, or service or facility of what- soever kind, which advertisement or other public representation I 1 is i,-trust deceptive Ql. TI1{ AIen(ii 1g. � 1 -1- Y J I I i 1 1 i 1 1 i Section 4: It shall be unlawful to advertise, or other- wise represent to the public, in any manner whatsoever, a reduc- tion in the price of any goods, wares, merchandise, service, i I facility or accomodation, of whatsoever kind offered to the • ? i jpublic, whether such price reduction is represented in complete i price figures or by(percentage of reduction under a previous price, where said reduction is not based upon a previous bona fide sale price or cost price theretofore advertised or repre- sented to the public for the articles or services so offered to I the public. i Section 5: It shall be unlawful by means of exaggerated I variations in the comparative size, location or position of ! jletters, figures or other markin„s or characters in any price- tag, sign poster, notice, display or advertisement or other public representation of any nature whatsoever, to mislead or i deceive, or to attempt to mislead or deceive the public as to i j the true nature, price, quantity, quality, brand or character of i any goods, wares, merchandise, services, facilities or accomoda- { tions, or as to the nature of, or the reason, if any is offered, j for the sale or offering for sale so being made to the public. 3 Section 6: Any person, firm, or, in the case of a I corporation the officers thereof violating any of the provisions J of this ordinance shall, upon conviction, be punished by fine not exceeding five hundred dollars N500.00), or by imprisonment not exceeding thirty (30) days, or by both such fine and im- prisonment. Each such person, firm, or corporation shall be deemed guilty of a separate offense for every day during any portion of which any violation of any provisions of this ordi- nance is committed or continued or 3 permitted by such person, firm, or corporation, and shall be punishable therefor as pro' vided by this section. Section 7: In the event any section, sentence, clause, or phrase of this ordinance shall be declared or adjudged to be I i ii'valld or unconstitutional, such adjudication shall in no manner i -2- J i l a affect the remaining portion hereof which shall remain in full force and effect as if such invalid or unconstitutional section, i sentence, clause, or phrase had not originally been a part of { this ordinance. Section 8: All ordinances or parts of ordinances in j conflict herewith be and the same are hereby repealed to the extent of such conflict. i Section 9: This ordinance shall be in force and take effect immediately upon its passage and adoption.
